Box 1827 Mobile, AL 36633-1827 Dear Mayor Stimpson: In an effort to maintain peace and order, we, the Leaders of Truth and Justice, believe it is imperative that the entire City of Mobile pursue a course of action regarding the June 13, 2016 officer-involved shooting. This course of action should demonstrate lessons that the nation leamed from the recent events in Ferguson, Missouri and Baltimore, Maryland. We believe it is imperative that all of the facts are revealed surrounding the fatal shooting of Michael Moore (victim) by Mobile Police Department (MPD) Officer Harold Hurst (officer) on Wagner Street in the Toulminville area. While we are mindful that a complete and thorough investigation will take a reasonable amount of time, the disclosure of the requested information will not in any way interfere with or prohibit your ability to conduct such an investigation. This information would help answer the Mobile community's questions related to the circumstances surrounding this shooting Our questions and requests are as follows: Police Protoc 1) Was any part of the incident videotaped by officers at the scene using dashboard cameras or body cameras? Do any such videotapes exist? 2) If so, have the videotapes been made a part of the evidence? 3) Itis our understanding that MPD procedure requires officers to call for backup assistance immediately upon confirming that a felony has taken place. Did the officer call for backup immediately upon discovering that the victim gave a false name and was allegedly in a stolen vehicle? If not, why did he not call for backup assistance? 4) Provide the entire electronic chronology of incident 5) Why did the officer take the huge risk of not waiting for backup assistance — knowing there were multiple people in the vehicle and that there was a high probability that if they were indeed in a stolen vehicle, the incident could quickly become volatile? 6) In light of the circumstances stated in Question 5, what was the purpose of the officer asking the victim to step outside of the vehicle? 7) At what point did the officer fear for his life, and feel that he needed to shoot the victim? 8) Ajter the first shots were fired and the victim fell, was it necessary for the officer to fire additional shots into the victim? If so, why was this necessary? 9) What is the official cause and time of the victim's death, and who officially pronounced him dead? 10) If the victim was dead at the scene, why was the area not taped off and a forensic team brought in to gather all evidence related to the incident before removing the victim's body? 11) If the officer has given a formal statement as to what he says happened, please provide a copy. 12) In television interviews, MPD Chief Barber stated that the officer believed that the victim had a gun and actually reached for it. Is there any evidence (i.e. photographs or videotapes) from the scene of the incident of the victim's gun? 13) If the officer feared for his life, why did he not remove the weapon immediately after he shot and handcuffed the victim? 14) How many times was the victim shot, and how many rounds did the officer shoot? Discrepancies 15) There have been discrepancies regarding whether the victim had a weapon in his possession, Please explain this discrepancy. 16) According to news reports, the victim's gun was finally retrieved in the Emergency Room of the University of South Alabama Medical Center Emergency Room. When, where and by whom was the weapon actually found? Officer’s Conduct 17) Has Officer Harold Hurst been involved in any other shootings? Have any complaints been filed against him? Has he been the subject of any disciplinary actions? If so, please give us the reasons and dispositions. 18) If the answers are "Yes" to Question 17, why has this information not been reported via the media? ‘We the undersigned Leaders for Truth and Justice are expecting you to be forthcoming with the information we are requesting.
