PURCHASE AGREEMENT
This agreement is made by and between:
___________________________________ hereafter referred to as Buyer, and
___________________________________ hereafter referred to as Seller. The
Buyer hereby agrees to purchase from the Seller, the following horse(s), hereafter
referred to as Horse:

This sale is subject to the following terms and conditions:
1. The purchase price of __________________________________________
(_______________) is to be paid in cash. There is a 25% non-refundable
deposit of _______________ in the form of cash, cashiers check/money
order (#_____________),or personal check (#_____________) is hereby
noted and allows Buyer to complete the contracted sale price and terms
herein on or before _________________ or prior to the removal of said
horse from Sellers property, whichever comes first. Final payment must be
made in the form of cash or a cashiers check/money order (#___________).
2. Buyer has the option at own expense to have said horse examined by a
veterinarian of choice, by evidence of a scheduled appointment provided to
Seller within two business days and veterinary examination completed in
fifteen business days or horse is accepted as is.

3. Upon signing this contract Buyer accepts the horse AS IS and the terms
contained herein. Risk of loss of the horse passes immediately to Buyer.
Buyer is responsible for any theft and/or mortality insurance.
4. Seller warrants the name, sire and dam, sex, and foaling date as
aforementioned.
5. Seller will provide Buyer with a current negative Coggins Test and Health
Certificate in accordance for entry into the state(s) of _________________.
Seller further agrees to provide all known health records of said horse.
Seller makes no warranties, express or implied, of merchantability,
suitability, or fitness for any particular purchase of the horse.
6. Transportation of said horse shall be the full responsibility of Buyer. Seller
shall assist in the arrangement of transportation at Buyers request.
7. Buyer acknowledges that Seller is not in the business of boarding horses. As
a courtesy to Buyer, Seller agrees to allow Buyer board for the agreed upon
cost of _$____________ a month _ (after ______________,______) until
transportation can be arranged on or before ________________, ______.
Buyer authorizes Seller to retain the services of a veterinarian, farrier and/or
trainer as deemed necessary due to emergency or reasonably prudent for the
maintenance of the horse while on Sellers property. All veterinary, farrier
and training costs shall be responsibility of Buyer. Buyer agrees to pay all
invoices upon receipt. Buyer has agreed upon the amount of
$________________________.
8. In the event of an emergency, Seller will make every attempt to notify
Buyer, immediately. However, due to the nature of an emergency, Buyer
grants Seller, or its agent, authority to secure emergency veterinary or farrier
care for said horse, including transportation to and from the attending
veterinary clinic/hospital while said horse remains in Sellers care.
9. Buyer shall indemnify Seller against any claims arising or related in any way
to the horse including the expense of defending such claim.

10.Upon clearance of Buyers funds in full, Seller shall sign a Bill of Sale, all
forms and documents necessary and pertaining to said horse allowing for
breed association recorded transfer of ownership to Buyer. All breed
association fees (i.e. transfer, DNA, etc.) are the responsibility of Buyer.
11.Buyer shall make no claim for any breach of this contract, for rescission or
revocation, nor for any warranty, misrepresentation, mistake, or other tort.
Buyers remedies in contract, tort or otherwise are limited to refund of the
paid contracted purchase price, upon the safe return of the Horse, in same
condition originally provided to Seller. ALL INCIDENTAL AND
CONSEQUENTIAL DAMAGES ARE EXCLUDED to the full extent
permitted by law.
12.All notices, requests, and consents required or permitted in this contract
shall be in writing, signed and delivered by Registered Mail, Express Mail,
UPS or Federal Express to the appropriate party.
13.This contract shall be construed and governed by the laws of __________
County, State of ______________. Jurisdiction and venue for any dispute
arising under or in relation to this contract shall lie only in the county and
state identified above.
14.This contract contains the entire understanding of the parties concerning its
subject matter. There are no oral or written promises or representations
upon which the Buyer is relying except as expressly set forth herein. This
contract may be modified only in writing executed by both Seller and
Buyer. The invalidity or unenforceability of any term or clause of this
contract shall not affect the validity and enforceability of any other terms or
clauses, but otherwise this contract is indivisible notwithstanding any
allocation of prices the parties may agree upon for tax, insurance or other
reasons.
15.The terms of this contract shall in all respects bind and insure to the benefit
of the heirs, executors, administrators, successors and assigns of the Buyer
and Seller.

16.Upon signing this contract, Buyer accepts the horse and terms contained
herein. Risk of loss now passes to Buyer. All parties have read, understand,
and accept all terms of this agreement.
17.Any additional agreements are set forth as follows:
