RE: Civil Case No. 2015-42SCA (Judith E. Jacala represented
by her AIF Marciana E. Jacala v. Francis Joseph Ortiz for
Unlawful detainer and Damages)

GREETINGS:
To the above defendant FRANCIS JOSEPH ORTIZ and all others now in
possession of the below described premises:
A parcel of land located at Nijaga Street, Brgy.
Central, Calbayog City, covered by Tax Declaration No.
99-01007.
You are hereby notified, that by virtue of and in compliance with the Writ of
Execution issued by this Honorable Court, demand is hereby made upon you and all
persons claiming rights of possession under you or acting under your behalf to quit,
vacate and immediately desist from any possession of any portion of the disputed
premises above-described, restoring possession thereof to the plaintiff on or before June
24, 2016.
You are further notified that the questioned premises will be delivered to the
possession of the plaintiff JUDITH E. JACALA, who is adjudged to be entitled to the
physical possession of the subject property, thru her AIF MARCIANA E. JACALA, by way
of constructive delivery on June 24, 2016, at 10:30 oclock in the morning at the place
where it is located in Nijaga Street, Brgy. Central, Calbayog City.
In connection thereto, you are hereby requested to peaceably vacate from the
contested lot and remove all your possessions therefrom by this date and re-entry on
your part into the property in litigation after possession thereof has been delivered to the
prevailing party constitutes CONTEMPT punishable under Rule 71 of the Rules of Court.
Further, if there was an issue of ownership, please be informed that it is a matter
between the other claimants of the leased premises and plaintiff to settle in an
appropriate proceeding, Once again thank you for your cooperation.
