"AN ACT FOR THE DEPARTMENT OF HIGHER EDUCATION APPROPRIATION FOR
THE 2010-2011 FISCAL YEAR."

Amendment No. 1 to Senate Bill No. 89.

Amend Senate Bill No. 89 as originally introduced:

Delete SECTION 16 in its entirety and substitute the following SECTION:

SECTION 16. APPROPRIATION - SCHOLARSHIP SHORTFALL RESERVE TRANSFER.

There is hereby appropriated, to the Department of Higher Education, to be
payable from the Higher Education Grants Fund Account, for transfer by
warrant of the set-aside funds for lottery scholarships to the Scholarship
Shortfall Reserve Trust Account for the fiscal year ending June 30, 2011, the
sum of........................................................$20,000,000.

AND

Delete SECTION 17 in its entirety and substitute the following SECTION:

SECTION 17. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE

ARKANSAS CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.
SCHOLARSHIP SHORTFALL RESERVE TRANSFER. Immediately upon the effective date
of this act, the Director of the Department of Higher Education shall
transfer by warrant the set-aside in reserve twenty million dollars
($20,000,000) in the Department of Higher Education Grants Fund Account to
the Scholarship Shortfall Reserve Trust Account of the Arkansas Lottery
Commission, as appropriated in Section 16 of this Act, to be used as
authorized by law."

AND

Delete SECTION 18 in its entirety and appropriately renumber the following
