Design concept
o A design refers to the features of
shape,configuration,pattern,ornamentation or
composition of lines or colours applied to any
article
Need for protection of a design
1. Make an article attractive and appealing – add to the commercial
value of a product
2. Exclusive right against unauthorized copying or imitation
3. Encouraging creativity
4. It increases interest in innovating more design in the field of
consumer products
5. The more successful a design, the higher its value to the company
6. A protected design may also be licensed or sold to others for a fee.
Essential requirement for the registration of Design

1. THE DESIGN SHOULD BE NEW OR ORIGINAL


2. The design should relate to feature of shape,configuration,pattern or
ornamentation applied or applicable to an art be article
3. The design should applied or applicable to any article by any industrial process
4. Should be visible
5. Any mode or principle of construction or operation o mechanical dive would not
be a registrable design
6. The design should not include any trademark or property mark or artistic works
7. It should be significantly distinguishable from known design or combination of
known design
8. Its should not comprise or contain scandalous or obscene matter
EXCLUSION FROM SCOPE OF DESIGN
 book jackets,calendars,certificates.forms and other documents,dressmaking patterns
Greeting cards,maps and plan cards,stamp,medals
Lables,tokens,cartoons
Building and structures
Parts of article not manufactured and sold separately
Mere workshop alteration of components of an assembly
Mere change in size of article
Flags,emblems or signs of any country
Layout design of integrated circuits
