‘Dear Mr. Daugherty and Ms. McDonald:
‘After extensive discussion and consideration, our client has authorized us to settle his
lawsuit for $150,000.00. This offer is expressly made in furtherance of settlement, and is in no
‘way intended to reflect our client’s evaluation o the damages. We realize that there are many
issues pending decision before the court at this time, and that depending on those rulings, there is
almost certainly much more time and expense that will be required to properly litigate this matter
in the event we are unable to resolve it through compromise.
My client extends this offer collectively to all the defendants in the case, as he would
prefer to resolve the matter completely and dismiss all claims against all defendants if settlement
is possible. It is abundantly clear that the parties remain polarized with respect to many legal
and factual issues in the case, and that this may or may not change as the case continues.
However, this seemed a good time to present an option that would allow all parties to put the
matter to rest.
| realize that this offer is made just after the Christmas holiday and that it may take some
time for you to discuss the matter with your respective clients. We will leave this offer open
until the close of business on January 8, 2010. Regardless, on behalf of my office and Mr.
Robinson, we wish you a happy, healthy new year. Thank you.
