All,

A notification letter has to be mailed to the landowner officially indicating the government's intent to
condemn the property needed for fence construction.

The Corps has submitted a draft letter, which has since been sent to DOJ for review/edit. We expect it
back this week, in which case it will be staffed through SBI/OBP/CBP & likely DHS for review and
approval.

We are hoping to get a final version by the end of next week.

Once the letter is mailed, it will be included as an enclosure to the condemnation package, which itself
has to undergo DOJ/CBP legal review prior to CBP-OFAM signature.

I have contacted the Corps asking whether legal review can commence given that the package is
complete but for the letter, and have not heard back yet.

I'll follow up on that tomorrow.

Hope that helps,

I reached out in hopes of gaining a sense of “where we are at” on this issue. I appreciate the
assistance. Certainly, you understand my concern. I1A Fencing Project (DNM 1.5 mi E to 3 mi E of
Columbus POE for a total of 2.56 miles) is around the corner.

I need solid information for my bosses, DNM Station management and SBI personnel. It’s an
uncomfortable feeling getting ready to put up fence when we don’t know what’s going on relative to the
real estate aspect of the project.

Regards,

Roy

Any word on the CCC ROE for Investigation court process? The EPT has a pre-comstruction meeting on
the 16th for I1A. Thanks.
