This Contract of Lease executed this 17 TH day of July 2010, by and between JUAN
DE LA CRUZ, Filipino, of legal age, single and a resident of Estaka, Dipolog City, hereinafter
called the LESSOR and PEDRO SAN JOSE, Filipino, of legal age, single and a resident of
Punta, Dipolog City, hereinafter called the LESSEE.
WITNESSETH:
That the lessor is the owner of a residential building single storey situated at General
Luna St., Corner Lapu-lapu St., Dipolog City, erected on the lot known as Lot No. 5252, Pls-
6, Dipolog Cadastre and covered by Transfer Certificate of Title No. T-10510 of the Registry
of Deeds of Dipolog City;
That the lessor leases unto the lessee the aforesaid residential building together with
the land on which it is erected under the following terms and conditions:

2. That the lessee shall be responsible for the payment of all water and electric bills

COMPLAINT
PLAINTIFF, by the undersigned counsel and to this honorable court most respectfully
alleges:
1. That he is of legal age, Filipino, single and a resident of Estaka, Dipolog City;
2. That while defendant is also a Filipino, single and a resident of Miputak, Dipolog
City, the place where he may be served with summons and other court notices;
3. That sometime on June 16, 2006 defendant borrowed from the plaintiff the sum of
One Million (P1,000,000.00) Pesos, promising to pay the same within a period of
one (1) year from said date said loan, as evidenced by promissory note, xerox
copy of which is hereto attached as annex A of this complaint;
4. That said indebtedness is now due and demandable and said defendant failed to
pay the same in spite of written demand given him;
5. That the cause of said defendant’s refusal to pay said obligation when it become
due, plaintiff brought the matter to the Barangay Captain of Estaka, Dipolog City
for conciliation but defendant refused to appear thereat as evidenced by
certification of the Lupon of said Barangay, hereto attached as Annex B;
6. That the cause of defendant’s unjustified refusal to pay his obligation to herein
plaintiff, the latter has to file his case in court in order to protect his interest and in
the process of which as he has to secure the services of counsel to whom he has
obligated to pay attorney’s fees in the amount of Fifty Thousand (P50,000.00)
Pesos and in the prosecution of the case he is forced to incur actual expenses of
litigation in the amount of Ten Thousand (P10,000.00) Pesos.
Wherefore, it is respectfully prayed of this honorable court that after hearing on the
merits, judgment be rendered in favor of the plaintiff and against the defendant, ordering the
latter to pay the former the sum of One Million (P1,000,000.00) Pesos legal rate of interest
and to pay attorney’s fees in the amount of Fifty Thousand (P50,000.00) Pesos and expenses
of litigation in the amount of Ten Thousand (P10,000.00) Pesos.
Plaintiff prays for such other relief and remedies just and equitable under the
premises.

ANSWER
DEFENDANT, by the undersigned counsel to this honorable court in answer

to the complaint respectfully avers:
1. That he admits the allegation of paragraphs 1 and 2 of the complaint;
2. That he denies the allegation in paragraph 3 and 4 of the complaint, that

sometimes on November 2009 he has paid said obligation of One Million
(P1,000,000.00) Pesos to said plaintiff as evidenced by a receipt hereto
attached as Annex 1 to this answer;
3. That he has no knowledge as to the truth of the allegation of paragraph 5 of

the complaint with respect to the amount of the attorney’s fees being paid
and expenses of litigation and therefore denies the same and respectfully
states that even if said allegation is true, defendant is not liable to pay the
same because he has already paid his obligation to the plaintiff;
4. With respect to allegation stated to paragraph 5 of the complaint,
