The Court’s November 10, 2010 Order set this case for a Hearing on December 8, 2010,
to address the issue of who has to raise the Fifth Amendment privilege during a deposition. The
Court now expands the December 8 proceeding to hear argument, as appropriate, on all pending
motions: 1) The November 1, 2010 Motion to Intervene by Media; 2) The November 9, 2010
Motion to Intervene; 3) Defendants’ Joint Motion to Dismiss Counts One, Three, and Four of
Plaintiff’s Complaint, or in the Alternative, for Summary Judgment; 4) Defendants’ Joint Motion
to Enjoin Legal Counsel From Making Extrajudicial Statements Regarding Litigation; and 5)
Plaintiffs’ November 19, 2010 Motion to Compel Deposition Testimony or Fifth Amendment
