Vision

CII National Committee of IP Owners will emerge as a


Reference Point in India on IPR and would strive towards
making India a truly ‘IP Savvy Country’ encompassing
Policy, Innovation, Capacity Development, IP Protection &
Enforcements

Objectives
? Serve the interest of all intellectual property owners in
all industries and all fields of technology.

? Advocate effective and affordable IP ownership rights


and provide a wide array of services to members.
 
? Concentrate on supporting members interests relating
to legislative and international issues analyzing current
IP issues providing infor mation and capacity
development services and disseminating information
to the general public on the importance of intellectual
property rights.

? Help creating an “Eco System” fostering innovation in

The National Initiatives in Intellectual Property Rights are driven by:

? CII - National Committee of Intellectual Property (IP) Owners: This was headed
by Mr. Malvinder Singh, (2008-2009), CEO & MD, Ranbaxy Laboratories Ltd. The
Committee is represented by CEOs & Heads of IPR from Indian Industry & has special
Invitees from Academic Institutes & Law firms.

? CII -Andhra Pradesh Technology Development & Promotion Centre jointly


promoted by CII, TIFAC and Govt. of AP): The Governing Body is chaired by
Dr. T. Ramasami, Secretary, Department of Science & technology, Govt. of India.

Four Task forces were constituted under the National Committee of IP owners to have a special
focus:

? Task Force on IP Policy - Chaired by Ramesh Adige, President Corporate Affairs & Global
Corporate Communications, Ranbaxy Laboratories Ltd.
? Task Force on Anti Counterfeiting & Piracy - Chaired by Anubhav Jain, Brand Protection
Manager, South Asia, Mercedes-Benz India Private Limited
? Task Force on Capacity Building & Service Facilitation - Chaired by Suprio Dasgupta, Director & General
Counsel - HTS & Assistant General Counsel - IP, and Honeywell Asia Pacific Operations.
? Task Force on Centre of Excellence in IPR - Chaired by Rakesh Bakshi - Director Legal &
Corporate Affairs Microsoft Corporation (I) Pvt. Ltd.

The Highlights of the activities for 2008 -2009:

1. Current & Emerging National Legislative Issues

? The Task Force on IP Policy focused its activities this Year on: IP courts, Data
Protection and Utility Models of Patent Protection. It was actively engaged in
finalizing Indian Industry' View Points on designing exclusive IP courts in India;
Recommendations for data protection; and the feasibility of the utility model in
India's IPR regime. A discussion papers on these issues closely examined challenges
and opportunities such policies pose in India.

? The Task Force conducted roundtable discussions on Policy Interventions for


Strengthening IP Enforcement regime with Govt. of India and also with International
agencies like Quality Brand Protection Committee (China), The George Washington
Law University Indian Delegation (US), Swiss Federal Institute of Intellectual Property
& Japan Intellectual Property Association (JIPA).

? In July/ August 2008, the Members had a Series of Interactions with Department of
Industry Policy & Promotion (DIPP), Govt. of India on Patent Manual. These
Interactions were held in all four metros. The Interpretation of Patentability Criteria
especially on Software Patents was debated extensively and CII' Detailed
recommendations on Patent Manual &Patent Prosecution issues in India was
submitted to the Controller General of Patents, Designs & Trademarks.

2. Awareness & Outreach Programs - Partnership with Govt. of India

? World Intellectual Property Day: National Dialogue on Leveraging


Knowledge Arbitrage for India's Innovation Economy

CII in Collaboration with Department of Science & Technology, Govt. of India launched on
Exclusive national Dialogue on Leveraging Knowledge Arbitrage for India's Innovation Ecology

on the 24 April 2008 on the eve of World Intellectual Property Day Celebrations.

The objective of the dialogue was to:


(1) Focus the attention of the people on the importance of scientific & technological
innovation and IP creation
(2) Appreciate the role & contribution of Intellectual Property in socio-economic
prosperity of the nation
(3) Create an innovation eco-system in the country
(4) Recognize and reward inventions/ innovations those impacted most in socio-
economic growth.

National Dialogue on Leveraging Knowledge Arbitrage for India's Innovation Economy, 24 April, 2008, New Delhi

The programme was held concurrently (video-linked) in New Delhi, Pune and Bangalore. The
forum was graced by Kapil Sibal, Minister for Science & Technology & Earth Sciences,
Government of India .Delivering the inaugural address, Mr. Sibal urged the Indian Industry to
step forward and collaborate more actively with the government and academia to encourage
research and innovation and to enable India to leverage its knowledge in today's globalizing
economy. Some of the eminent Policy & Industry thought leaders linked through the National

India. The session was moderated by Dr. Prabuddha Ganguli, CEO - VISION-IPR.

? CII DIPP Nationwide Intellectual Property Rights Awareness Campaign
(Jan- March 2009)

CII in collaboration with Department of Industrial Policy and Promotion (DIPP) under the
Ministry of Commerce and Industry and the Office of the Controller General of Patents, Designs
and Trademarks (CGPDTM) organized a nation wide Awareness Campaign on Intellectual
Property Rights for various stakeholders, focusing the attention of the Industry on the role &
importance of Intellectual Property in their business. As a part of the campaign, awareness
sessions are being organized in 14 different locations from January to March 2009: Indore, Pune,
Mysore, Bhubaneswar, Cochin, Madurai, Trichy, Goa, Chandigarh, Mumbai, Bangalore,
Ahmedabad, and Vizag & Hyderabad. More than 1500 Stakeholders participated in this
Campaign.

Inaugural Sessions at CII DIPP Nationwide Awareness Campaign; Jan March 2009

The objective of the awareness campaign is to:

? To nurture an eco-system in the country for encouraging Innovation, Inventions


& Creation of Intellectual Property.
? To create a delivery mechanism for comprehensive awareness & training in IPR to
all stake holders of IP in India.
? To facilitate conducive mechanism in the country for IP Protection &
Enforcement.
? To introduce recognition & award Innovators & Innovators who demonstrate
excellence in Creation of Intellectual Property and which benefits the nation as a
whole.
? Sharing of IP best practices.

? CII-DIPP National Seminar & Workshop of Stakeholders of Geographical


Indications

CII jointly with Department of Industrial Policy and Promotion, Government of


India organized a National seminar& workshop of stakeholders of Geographical
Indications on 18-19 September 2008 at New Delhi.

National Conference on Geographical Indications (GI)
Intellectual Property Protection through Gl for Sustainable Development

The main objectives of the Conference were:

? To elucidate the emerging importance of Geographical Indications for


Intellectual Property Protection

? To share International & National experience protection & enforcement issues on


GI

? To calk out a position paper on important issues of importance for developing


countries which needs multilateral Cooperation

? To create a network for common interest group for GI protection across the
world.

? A total of 400 participants along with stakeholders from 15 states have


participated in the conference.

GI Sensitization Workshops in Moradabad and Hyderabad

CII in collaboration with GI Registry, Govt of India conducted Gi sensitization programme


in Moradabad, Uttar Pradesh on 3rd May 2008 and Hyderabad, Andhra Pradesh on 31st May
2008. The Sensitization Programme is a nation wide inititiative supported by GI Regiatry
Govt of India is to disseminate the importance of GI protection across the country. Since
2004 CII has been partnering in this importance initiative and has organized sensitization
Programme in all parts of the country.

3.Anti Counterfeiting & Piracy Initiatives

CII task force on Anti Counterfeiting/Piracy' Campaign in India focused on Sensitizing


Top government officials, business leaders and senior law enforcement authorities to engage in
the battle against counterfeiting and piracy. The call for increased action came a t C I I ' s 2 n d

? International Conference on Combating Counterfeiting & Piracy:

Confederation of Indian Industry (CII) in collaboration with Quality Brand Protection


Committee (QBPC), China organized its 2nd International Conference on Combating
Counterfeiting and Piracy, held in Mumbai from 12-13 November 2008. The two-day
conference was organized to enable participants to identify actions and solutions to the growing
problem of product counterfeiting and piracy .The two-day conference was organized to enable

Special focus of the conference was two exclusive roundtables with the Customs & the Indian
patent official's .The roundtable was attained by the members of CII-National Committee of IP
owners & the members of Quality Brand Protection Committee, China. The agenda for the round
table was to share the best practices. The Principal Sponsor was Microsoft India and Corporate

? Interactive session with Customs Officials on Counterfeiting & Piracy-Border


Issues:

One of the objectives of CII initiative against Counterfeiting & Piracy is to facilitate a conducive
climate for IPR enforcement by building strong & prolonged partnership between industry and
enforcement agencies and to strengthen coordination between various enforcement agencies.

As a follow up of this objective, CII organized an interactive session with the custom officials at
NACEN on Custom rules / IPR rules with the Industry representatives and on product
identification on 5 September 2008. Representative from auto, FMCG & Pharmaceutical sector
were present to discuss the custom related issues and to help Custom officials in recognizing &
identifying the original & Counterfeited products.

4. IP Protection Services

Some of the highlights for IP Protection Services were:

? Patent Protection for Micro Small & Medium Enterprises:Elico Ltd an electronic
and instrumentation company in the field of spectrophotometers based at
Hyderabad has filed 15 no's of IPR's. Dairy Den a start up company in Ice Creams &
frozen foods has sought International Patent Protrction in USA, Europe & China
for it's Innovative way of Packaging and presentation of Ice Creams in the form of
Scoops.

? Handholding IP Protection for Individual Inventors: A Progressive farmer


from AP - Mr. Venkat Reddy Obtained Patent Grant in Multiple Countries -
Eurasia, Europe, South Africa, Nigeria & Madagascar. His Invention relates
to a novel method of improving soil fertility leading to high yields of cereals
traditionally grown crop like rice in said ari-zone. Kusuma Rajajiah, an
entrepreneur from AP pioneered the non violent Process
of preparing Silk - AHIMSA SILK. The logo of this Unique Product is in the
process of being granted a Trademark.

? Leveraging Inherent IP in Traditional Products: GI has been granted to Nirmal


Paintings, Nirmal Furniture and Leather Puppetry of AP. GI applications for
Uppada Jamdhani Sarees and Gadwal Sarees have been filed with support of
Dept. of Handlooms and Textiles (Govt. of AP), AP Handicrafts Development
Corporation (APHDC), Textile Committee (Govt. of India) and NABARD.

? Sectoral IP Management Interventions in Indian Corporates: CII-APTDC teamed
up with In-house IP Team of Mahindra & Mahindra and conducted a focused IP
Management Orientation Program on 11-14 Nov 2008 at the R&D Centre at Nashik
and Kandivali. The programme was tailor made to address the need of M&M.
Interactive Case studies on IP management /IP infringement/ IP Valuation were
the Highlights. CII- APTDC is replicating Similar Interventions in Indian corporates
across the Country

5. International Linkages: Sharing of Best Practices

? 6 IPR SUMMIT-2009
CII in association with George Washington University Law School (GWULS) and United States

India Business Council (USIBC) organized its flagship event the 6 IPR SUMMIT from 22-24
February 2009 at the India Habitat Centre, New Delhi .The summit kick started with a Dialogue
with the Indian judiciary and the GW delegates followed by two day International Conference on
IPR on 23-24 February and ended with a round table with the Indian IP owners and the GWLU
delegates .Ranbaxy, LS Davar, Intellectual Ventures and Lex Orbis were the corporate sponsors
for the event. The objective of IPR Summit 2009 was to:

? Foster Partnership between US, European & Asian Industry leaders for
Collaborative Projects in IPR
? An Endeavor for Mutual Cooperation with Indian Judicial & Administrative
Systems for IPR Enforcement
? Disseminating International best Practices in IP Protection & enforcement

The summit was a Platform for eminent Indian & International Bureaucrats, Hon'ble Judges,
Industrialists & academicians to deliberate on important national & international issues on IPR.

? CII USPTO Road Shows: Geographical Indications - A need for protection


& enforcement
CII in Collaboration with The United States Patent & Trademark Office (USPTO)
organized road shows on Geographical Indications on Indo US Initiatives &
Perspectives on September 3, 5, 16&30 2008 at Guwahati, Siliguri, Kota &Bhubaneshwar
respectively.The road shows was supported by the Department of Industrial Policy and
promotion (DIPP) Govt of India. These road shows gave an opportunity for various stakeholders
of GI and producer groups from potential products of GI to showcase their success stories and
discuss on the road map for collaborative work on potential GI's of India.

? Interaction with Swiss Federal Institute of Intellectual Property


CII met a delegation from the Swiss Federal Institute of Intellectual Property led by Dr Felix
Addor, Chief Negotiator IP of Switzerland and Deputy Head of Swiss Federal Institute of
Intellectual Property, along with representatives from the Intellectual Property Office, New
Delhi, in November 2008.

The Swiss delegation shared with CII their experiences in setting up and executing the Stop Piracy
project. It is a very laudable initiative in the anti-counterfeiting and anti-piracy arena, and is an
example of how innovative solutions can be found in challenging markets. From an Indian
perspective, while the Swiss experiences offer a model to be developed upon, CII has to factor in
distinctive socio-economic circumstances within India that demand tailored methods to tackle the
menace of piracy.

It was of particular interest to learn of the Swiss Federal Institute of IP's activities in Geographical
Indications, and the similarities between the two countries in the wealth of traditional products
they possess. This is one arena where CII can look for further partnership with the Swiss.

An emerging challenge in IPRs in Indian industry relates to how SMEs can be encouraged to
recognize IP as an independent company asset, and how it can be appropriately valued and
leveraged upon for business profitability. CII, on its part, pro-actively offers IP support for SMEs
in the form of various services and capacity building programmes. In this context, CII learnt of
the Swiss Institute's ongoing studies on establishing linkages between IPRs and the success of
SMEs. CII keenly awaits the results that these studies will bring forth.

? Interaction with Japanese Intellectual Property Association (JIPA)


Delegation
The delegation from JIPA interacted with CII in November 2008 at New Delhi .The delegation
was briefed on the genesis of CII-National Committee of IP Owners, its objectives & desired
goal. They were also given a brief detail on the initiative taken by the Committee in the financial
year (2008-09). The delegation was particularly keen on learning about CII's IP support for SMEs,
and related services they provide for entrepreneurs.

The delegation was then guided to an interaction with members of CII's National Committee of
IP Owners, at the Global Corporate Headquarters of Ranbaxy, in Gurgaon. Mr. Ramesh Adige,
Executive Director; Ranbaxy welcomed all members present and initiated the discussions.

The members discussed issues of :

! Anti-Counterfeiting mechanisms in Indian industry,


! Enforcement capabilities of Indian administration
! Procedural and regulatory aspects of Indian laws (both civil and criminal remedies
available under IP laws; relatively stronger protection available in copyrights and
trademarks, compared with patents and designs).
! Rights of Consumer Protection, protection related to trade secrets, etc.

On behalf of the CII-National Committee of IP Owners Mr. Adige proposed that the delegation
could make this visit an annual event, and perhaps engage on a thematic basis, addressing specific
topics at each meeting.

The members represented an array of IP Owners, including Ranbaxy, Pfizer, Microsoft, Hewlett
Packard, as well as law firms Singh and Singh, and Anand and Anand.

? CII-Qualcomm Seminar on “Diffusion of wireless innovation Enriching


Lives”
Confederation of Indian Industry (CII) in collaboration with Qualcomm organized a Seminar on

“Diffusion of wireless innovation Enriching Lives” on 7 November 2008 at Hotel Taj Mansingh,
New Delhi. In the recent past, India has witnessed a landmark development in Information and
Communication Technology (ICT). Innovation in the field of wireless communication
technology is of special importance where value added applications in mobile phones are
practically transforming mobile phones to computers. Novel applications are being developed to
support services like e-banking, and to reach people at the grassroots e.g. fishermen and farmers.
With the coming of 3G technologies in India, people will be benefited with numerous additional
services.

6. Training

? Program on Strategic Innovation, Product Design& Development and


Intellectual Property Management
Confederation of Indian Industry (CII) in Collaboration with the WIPO World Wide Academy
organized a four day training programme on Strategic Innovation, Product Design&
Development and Intellectual Property Management from 2-5 December 2008 at Chennai.

The Faculty for this Program was Professor James Conley - Professor, Kellogg School of
Management, Mr. Gerhard Bauer - Chief Trademark Counsel, Intellectual Property &
Technology Management, Daimler AG, Sven Beyer - Partner, Advisory Corporate Finance,
KPMG, Richard Butrick - Senior Vice President, Phillips Intellectual Property & Standards,
Prof. Ashok Jhunjhunwala - Professor, Indian Institute of Technology, Madras, Anil Sinha -
Academic Director, Head, Research & Executive Program, WIPO Academy, Himanshu
Goswami - IP Attorney, Microsoft Corporation.

The program blended innovation with product design and development and intellectual property
management to offer a unique learning experience. Thought leaders from leading business schools
and the corporate world revealed unique insights and experiences using lectures, case studies, best
practices and group discussions.

?IP Capacity Building Program on Freedom to Operate FTO, Hyderabad

Confederation of Indian Industry (CII) & Andhra Pradesh Technology Development and
Promotion Centre organized an IP Capacity Building Programme on FTO Analysis on 29-31
August 2008 at Hyderabad.

India is growing in technology in leaps and bounds yet there exists a dearth of professionals who
understand the dynamics involved in the field of Intellectual Property. To bridge this lacuna,
APTDC under the aegis of CII has organised a series of IP Capacity Building programmes. The
skill building programme aims to enhance the practical skills of practitioners and to demonstrate
the possibilities of Patent Analytics.

The module on FTO Analysis covered:

? Risk Evaluation and claim interpretation


? Landscaping, FTO searching and competitor analysis
? Potential blocking patents and how they are addressed best
? Product analysis and related FTO Decisions with related exercise and so on.

The programme was well attended by members of the India representing sectors such as
Pharmaceutics, Agri Biotech & Automobile Industry.

?Workshop on IP for State level Judicial Officers

CII- APTDC in association with the A.P. Judicial Academy conducted a one day workshop on IPR
for State level Judicial Officers on 18th October 2008 in Hyderabad.

Hon'ble Sri. Justice A. Gopal Reddy, senior judge, High Court of Andhra Pradesh & Member,
Board of Governors APJA in his Inaugural Address welcomed such an intervention from CII-
APTDC and discussed the importance of understanding the nuances of Intellectual Property by
the judges which help them in making decisions in IP related cases. A series of technical sessions
ranging from IP Protection, Enforcement and Infringement were dealt in detail by eminent
faculty members. :Mr. Subodh Kumar, Head- APTDC & IPR, Mr. Raju Bhupatiraju, Fox mandal
Little, Late.Mr. Rama Sarma, Partner, Kocchar & Co. and Mr. Ramesh Vishwanath, Vishwanath
& Global Attorneys.

7. Research Publications

? Launch of Manual on “Technology Solutions: A Primer for Combating


Counterfeiting & Piracy:

The manual was released on 5th December 2008. It is designed for brand owners, to provide a
comprehensive and objective appraisal of currently-available anti-counterfeiting technologies;
and also a pointer on how to proceed in identifying the right technology, and the pitfalls to avoid.
The manual lists five critical Golden Qualities to help brand owners assess technologies and
assesses the different technology solutions along the five Golden Qualities. The manual concludes
with a database of anti-counterfeiting and brand security companies, and the category of
technology solutions they offer.

? Geographical Indications study and documentation of Sarees of Siddipet Gollabama, Narayanpet,


Mangalagiri, Venkatagiri in the Textile Sector & Kurnool Rice & Tirupathi Ladoo in Agri & Food Sector have
been conducted to channelise the intangibles in the Traditional products of India to tangible assets like Geographical
Indications which is one form of Intellectual Property Rights.

8. Special Initiatives: Centre of Excellence of Intellectual Property Rights

The Task Force on Centre of Excellence under the CII National Committee of Intellectual Property has taken the
pioneering initiative to formulate a Proposal to establish a Centre of Excellence of IPR Based on last five years of
extensive work done by CII for the industry, it is evident that there is a huge need of industry across the country in the
areas of Policy Reforms, capacity development, IP Management, IP protection. The current industrial growth,
presence of leading Global MNCs in India and growing needs from various stakeholders have necessitated
establishment of a state of the art Centre of Excellence of IPR that will work primarily for the benefit of Indian
industry.
