OVERVIEW:

Lawsuits were all filed on October 26, 2010. Copies of the lawsuits were posted to target
properties with a full 8.5 by 11 color logo of the “Campaign to End Blight” as printed on the
cover of this report. Lawsuits were also noticed by publication in the Memphis Daily News.
Of 138 filed cases, we have good service on 70 defendants.
Eighteen (18) of the defendants have retained legal counsel.
Forty-nine (49) Orders have been entered. The Order certifies the public nuisance, requires the
submission of a development plan and proof of financial capacity, and bars transfer of the
property until the nuisance has been abated. Hearings on the sufficiency of proposed
development plans are currently underway.
Four orders to complete development plans are pending, and one case has been settled, with
the property being fully rehabbed and the owner paying all costs and fees incurred by the City.
The cases against the 68 defendants not served prior to the first setting were reset for further
attempts at service. Shelby County Sheriff is making a second attempt of service for in town
defendants not reached by Certified Mail. Secretary of State service is being attempted for
corporate form defendants not reached by Certified Mail.
Ongoing property research for some of the target properties has revealed title confusion,
potential unrecorded foreclosure sales, in process tax sales, and other issues which will require
more time to resolve.

POTENTIAL TARGETS AND TIMELINE FOR SECOND WAVE:

We have identified four ready sources of new cases for a second wave of filings.

Working with the Memphis Daily News, I have identified several hundred long-vacant
bank or investor owned single family houses. The largest numbers of these properties
are held by Wells Fargo, Bank of New York, Deutsche Bank, US Bank, and several local
property management companies (REO Property Co., Tennessee Investment Properties,
and Hans Guenther).
The District Attorney’s office delivered approximately 90 property addresses which have
been the subject of Blue Crush actions, most of which continue to be vacant and
nuisance properties.
The Mayor’s Action Center has a backlog of thousands of complaints which we could
pull from, and they have recently received a dozen or so specific requests that certain
addresses be targeted by the Mayor’s anti-blight initiative.
The Fire Department and Community Enhancement also continue to develop new
potential cases on their own.

Housing Code Enforcement inspectors and Fire Department Anti-Neglect inspectors could be sent out to
evaluate the current status of any of these properties, to inspect and take photographs, and to
determine whether nuisance lawsuits would be appropriate at this time. Given approximately 30 days
notice, we are prepared to initiate another wave of at least 100 lawsuits; and could initiate another 100
each two months thereafter until the goal of 500 in one year’s time is reached.
