Upon review of the Original Petition, Application for Writ and Affidavit in support thereof, the Court finds that Defendant SAFEGUARD SECURITY HOLDINGS INC., executed a promissory note in favor of Plaintiff, that Defendant R. MICHAEL LAGOW guaranteed same, that the note is in default and that the sum of $56,341.42 is currently all now due and payable. The Court further finds that Defendants are in default on other obligations, and as a result there is a substantial likelihood that if this relief is not granted then Plaintiff will be unable to collect on a judgment should she prevail in the trial of this cause. ‘The Court further finds that Defendants have no property in Defendants’ possession in Texas subject to execution sufficient to satisfy the debt, and that the garnishment is not sought to injure Defendants or the Gamishee. IT IS THEREFORE ORDERED that a prejudgment Writ of Garnishment issue against PROFESSIONAL BANK, N.A., for the property or indebtedness of SAFEGUARD SECUIRITY HOLDINGS, INC. and R.
