A BILL FOR AN ACT


101 C ONCERNING A PROHIBITION ON INGESTIBLE MEDICAL
102 MARIJUANA-INFUSED PRODUCTS.

Current law permits a medical marijuana-infused products licensee


to produce edible products. The bill would prohibit medical
marijuana-infused consumable food and beverage product manufacturing
and sale.

1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. 12-43.3-104 (9), Colorado Revised Statutes, is
3 amended to read:
4 12-43.3-104. Definitions. As used in this article, unless the
5 context otherwise requires:
6 (9) "Medical marijuana-infused product" means a product infused
7 with medical marijuana that is intended for use or consumption other than
8 by smoking, including but not limited to edible products ointments and
9 tinctures, BUT DOES NOT INCLUDE A FOOD OR BEVERAGE PRODUCT THAT
10 IS INGESTED BY ORAL CONSUMPTION. These products, when manufactured
11 or sold by a licensed medical marijuana center or a medical
12 marijuana-infused product manufacturer, shall not be considered a food
13 or drug for the purposes of the "Colorado Food and Drug Act", part 4 of
14 article 5 of title 25, C.R.S.
15 SECTION 2. Safety clause. The general assembly hereby finds,
16 determines, and declares that this act is necessary for the immediate
17 preservation of the public peace, health, and safety.
