A BROKER, DISTRIBUTOR OR FREIGHT FORWARDER IS NOT THE CUSTOM |. Customer understands that Holt Integrated Circuits (“Holt”) products (the “Products”) are subject to export, re-export, or other restrictions under the laws of the United States, as well as those of the country of the seller/distibutor and the country in which the Customer resides. Therefore, Customer, on its bwa behalf and on behalf of its subsidiaries and affiliaes, certifies that it will abide by all U.S. and other applicable laws and regulations relating to the export and re-export of the Preducts and any other product in which the Products are incorporated by or on behalf of Customer or its subsidiaries and aifiliates. 2. Customer certifies that the Products will not be used, sold, re-exported or incorporated into products used directly or indirectly, in the design, development, production, stockpiling, or use of chemical or biological weapans, nuclear programs (including activities related to nuclear explosive devices, nuclear reactors, and nuclear fuel-cyele activities), and maritime nuclear propulsion projects except as authorized under applicable laws and regulations relating to the export and/or re-export of these items. 5. Customer certifies that the Products will not be used, sold, re-exported ot incorporated into missiles (including cruise and ballistic missile systems, space launch vehicles, sounding rockets, target drones, remotely piloted vehicles, and reconnaissance drones) o missile-related programs or end uses except as authorized under applicable laws and regulations relating to the export and/or re-export of these items, 4. Customer certifies that, unless indicated below, to the best ofits knowledge, the Products are not intended, either directly or indirectly, fora military end use. 5. Customer certifies that the Products will not be used directly or indirectly, sold, re-exported or incorporated into products intended for ‘any nation under applicable U.S. embargo, except as may be permitted under applicable laws of regulations, or for ary person or entity to whom such export or re-export is prohibited under U.S. law, including but not limited to persons or entities identified on the Specially Designated Nationals and other Blocked Persons List maintained by the Treasury Department, or the Entity List and Denied Persons List maintained by the Department of Commerce. In any case where Customer is unable to certify the above, it will advise or cause to be advised Holt, in writing, at the time of the order. Breach of this Certification will subject the Customer and any broker, distributor or forwarder retained by the Customer to to Holt and under applicable U.S. law. Breach also will automatically and without notice void, nullify and invalidate any ties, maintenance or other support obligations by Holt with respect to that Customer and its broker, distributor or forwarder.
