    PLEA AGREEMENT

    Neil H. MacBride, United States Attorney for the Eastern District of Virginia, John

    Eisingcr, Assistant United States Attorney, the defendant, Kevin Garfield Ricks, and the

    defendant's counsel, Brian Mizer, have entered into an agreement pursuant to Rule 11 of the

    Federal Rules of Criminal Procedure. The terms of the agreement are as follows:

    1. Offenses and Maximum Penalties

    The defendant agrees to waive indictment and plead guilty to a seven-count criminal

    informationcharging the defendant with six counts of production of child pornography, in

    violation of Title 18, United States Code, Section 2251(a) and one count of possession of child

    pornography in violation of Title 18, United States Code, Section 2252A(a)(5)(B). The

    maximum penalties for these offenses are: As to Count 1, a maximum term of imprisonment of

    ten (10) years, a fine of up to $100,000, a special assessment, and up to three (3) years of

    supervised release; As to Count 2, a maximum term of imprisonment often (10) years, a fine of

    up to $250,000, a special assessment; and up to three (3) years of supervised release; As to

    Counts 3-5, a mandatory minimum term of imprisonment often (10) years, a maximum term of

    imprisonment of twenty (20) years, a fine of $250,000, full restitution, a special assessment, and
