1. This report pertains to a road accident that took place in

Brgy. Libas, San Julian, Eastern Samar involving on the one
hand a passenger jeepney owned and operated by Mr.
Romualdo dela Rosa and being driven by Mr. Felipe Beros and
on the other a Honda motorcycle being driven by Mr. Crisanto
Diga;
2. Mr. Beros was driving the said passenger jeepney going to
Borongan from Dolores at a moderate speed.
3. While cruising the bridge in Brgy. Libas, San Julian, Eastern
Samar, Mr. Beros saw a tricycle, which was parked and
stationary by the roadside. The tricycle was parked at a point
of about 30 meters before a sharp curve in Brgy. Libas, San
Julian, Eastern Samar;
4. Faced with the situation, Mr. Beros stopped the jeepney for
a short while. He then negotiated to the center lane of the
highway and swerved back to the proper lane as soon as he
passed by the stationary tricycle, considering there was a
curve ahead;
5. Mr. Beros already figured in the passenger jeepney to the
proper lane 10-15 meters before the sharp curve;
6. But to his shock, a speeding Honda XR 200 motorcycle with
plate number NH 6890 coming from the opposite direction
suddenly appeared and was out of control. Mr. Beros applied
the brakes to stop the passenger jeepney but to no avail since
the motorcycle was running at an uncontrollable speed. The
motorcycle rammed the left side of the passenger jeepney. As
a result of the collision, the motorcycle was thrown to the
sidewalk.
7. Right after the impact, Mr. Beros asked the passengers of
the jeepney to get out of the jeep so that he can immediately
transport the victims to the Borongan Provincial Hospital.
Afterwards, Mr. Beros surrendered to the police in Borongan
where he was detained for several days;
8. The victims, Mr. Crisanto Diga and his wife, Mrs. Annabelle
Diga were then brought to Tacloban City on the same date for
further treatment. Upon recent checking with the victims, Mr.
Diga’s left arm was amputated while the left leg of Mrs. Diga
was seriously hurt.
