A Critique to The Flunker Jovhilmar Estoque

If one must study law, he must study its spirit by heart and not just the law itself.

The Flunker shows the scenario in the Philippine arena of Law Schools, Law Students, Law Professors, the Bar Exam and the Supreme Court which regulates the admission to the bar. It illustrates how brilliant but ordinary students turn into zombies after taking the Bar Exams only because of the system practiced in this country. If I may say, the author is right these law students are bombarded with this law books but at the end of the day, they do not serve their purpose as people who mastered these laws. Yes, these prestigious Law Schools dress these future lawyers the way which they think is the right manner to get them ready for practice. But from what I understood from the author is that their curricula lack areas on practical applications. And this I think deals on how they should act as lawyers to their clients. Ethics is not enough as a guide to the practice of the profession of law. We see lawyers which are known as the walking constitution but we also know that these people handle cases of more so criminals or per se, they even lie to people and to themselves at worst. Now, we cannot consider them as agents of truth and justice as what lawyers are ought to be.

If we must study law, we should apply to the manner which would materialize the intent of the framers. We should not take advantage of our knowledge of law to circumvent the same. We must apply it to the daily living.

The Bar Exams should be limited to areas which are needed the most in the practice of law. Those which are not of most importance in the practice should be excluded, anyway we study it in the Law School and the lawyers can review them during the practice. What should be strengthened is more than Ethics itself.

But at the end of the day, after the battles of these brilliant-law-students-turned-zombies, they should always be merited. I believe we should maintain the tradition of ranking the passers and salute the topnotchers. Remember, justice is giving what is due to the person as Plato once said.
