Alternative Dispute Resolution

By Spencer & Silvia

Mediation

In mediation, there is a third party, a mediator, who facilitates the resolution process (and may even suggest a resolution, typically known as a "mediator's proposal"), but leaves the final decision up to the disputing parties.

Arbitration

This is when third party comes in and

reviews the case and decides who is to be awarded. This by the means of what is legally binding for both sides of the argument.

Conciliation

This is like Mediation and Arbitration but

instead of a face to face conversation a person would go back and fourth to people in different places so that there wouldnt be confrontation.

Negotiation

This means that people have a

representative to negotiate and hammer out an agreement.
