MINUTES OF A SPECIAL MEETING AND PUBLIC HEARING OF THE HYDE PARK TOWN BOARD, HELD AT TOWN HALL, 4383

ALBANY POST ROAD, HYDE PARK, NEW YORK, ON MONDAY, NOVEMBER 15, 2010 AT 7:00PM PRESENT: SUPERVISOR THOMAS J. MARTINO COUNCILMAN MICHAEL ATHANAS COUNCILMAN JAMES W. MONKS, SR. COUNCILMAN MICHAEL TAYLOR ATTORNEY TO THE TOWN JAMES P. HORAN DEPUTY TOWN CLERK PATRICIA COADY-CULLEN ABSENT: COUNCILWOMAN SUE SERINO TOWN CLERK DONNA McGROGAN Supervisor Martino called the meeting to order with the Pledge of Allegiance to the Flag. Supervisor Martino opened the continuation of the public hearing regarding the 2011 preliminary budget. He stated that they have put a lot of time into this budget and after much work have come up with a proposed rate increase of .9%. Councilman Taylor stated that they did everything they could to trim the budget and hopes to restructure spending and save to put money back into the fund balance. PUBLIC COMMENT: Joanne Lown, 24 Horns Park Road, spoke in favor of the reductions made in the budget. Lucine Barbeau, Horns Park Road, stated that the Town Board exceeded her expectations in keeping the tax increase low. Carol Lally Metz, 27 Beadart Place, thanked the Board for keeping the budget under 1% Herb Sweet, 6 Covey Road, questioned the Board as to what changes were made to the budget. John Bickford, 64 Rogers Road, stated he was confident that the Board would do a good job. MOTION: Councilman Athanas SECOND: Councilman Monks To close the public hearing VOICE VOTE: 40 CARRIED

MOTION: Councilman Taylor SECOND: Councilman Athanas To set the meeting date, to approve the 2011 Budget, as Friday November 19, 2010 at 7PM VOICE VOTE: 40 CARRIED

PUBLIC COMMENT ON RESOLUTIONS ONLY: Bob Clearwater, 9 Nichris Lane, stated that he would like to see the Town Board look into hiring apprentices for the construction of the Police/Court Facility. MOTION: Councilman Taylor SECOND: Councilman Athanas To close public comment on resolutions only. VOICE VOTE: 40 CARRIED OF 2010

RESOLUTION 11:15 - 1

RESOLUTION AUTHORIZING TOWN CLERK TO ADVERTISE FOR COMPETITIVE BIDS FOR CONSTRUCTION OF POLICE/COURT FACILITY WHEREAS, on August 24, 2009, the Town Board of the Town of Hyde Park adopted a resolution authorizing the issuance of serial bonds of the Town of Hyde Park in an aggregate principal amount not to exceed $2,800,000 to finance the construction of a new combined police and court facility of approximately 9,776 square feet at a parcel located at Crum Elbow Road and Cardinal Road in the Town of Hyde Park, Dutchess County subject to a mandatory referendum by the voters of the Town of Hyde Park to be held at the general election on November 3, 2009; and WHEREAS, the voters of the Town of Hyde Park at the duly held referendum on November 3, 2009, approved the issuance of serial bonds in an aggregate principal amount not to exceed $2,800,000.00; and WHEREAS, the Dutchess County Board of Elections certified the results of the election and a notice of estoppel has been published by the Town Clerk; and WHEREAS, by Resolution 11:23 - 21 of 2009, the Town Board engaged the services of Mauri Associates Architects, P.C. to design and prepare drawings and specifications for the construction of the Hyde Park Police and Court Facility, and WHEREAS, Mauri Associates Architects, P.C. has prepared the drawings and specifications for the construction of the Hyde Park Police and Court Facility, and WHEREAS, the subdivision of land owned by Golden & Golden Building Co. has been approved by the Town of Hyde Park Planning Board; NOW THEREFORE BE IT RESOLVED, that the Town Clerk is authorized to advertise for competitive bids to undertake the work shown in the specifications prepared by Mauri Associates Architects, P.C. in accordance with the provisions of Article 5-A of the General Municipal Law; and BE IT FURTHER RESOLVED, that the requirement of participating in an apprenticeship program pursuant to Chapter 36 of the Code of the Town of Hyde Park is hereby waived and shall not be included in the bid specifications because the budget for the project is extremely tight and it is in the best interests of the Town of Hyde Park to obtain as many qualified bidders as possible.
