ORDER STAYING SUMMARY SUSPENSION: CONDITIONS OF STAY


On December 13, 2011, the Board summarily suspended the medical license of Brent R. Fox, M.D. (Dr. Fox) under Md. Code Ann., 10-226(c)(2) on the ground that the public health, welfare or safety imperatively required that emergency action. Pursuant to the Boards regulations at COMAR 10.32.02.05 D, a quorum of the Board held a post-deprivation hearing on December 21, 2011. Dr. Fox was present and represented by his counsel, Elliott A. Alman, Esq. The interests of the State were represented by Janet Klein Brown, Esq., the Administrative Prosecutor. Having heard and considered the evidence and arguments of the parties, the Board under the authority of COMAR 10.32.02.05 H (4) hereby ORDERS that its previous ORDER FOR SUMMARY SUSPENSION OF LICENSE TO PRACTICE MEDICINE issued on December 13, 2011 is STAYED as long as Dr. Fox complies with the following conditions: (1) Dr. Fox shall not prescribe any Controlled Dangerous Substances as defined in Maryland statute and regulations;

(2) Dr. Fox may continue to practice interventional pain management related only to the performance of percutaneous procedures but excluding oral or intravenous medical pain management; and (3) The stay is further conditioned on Dr. Foxs cooperation with any reasonable efforts of the Board to determine if the conditions are being met.

So ORDERED this 22nd day of December 2011.

Notice of Right to Appeal Dr. Fox may appeal this order and request a full evidentiary hearing on this summary suspension issue by filing a written request within 10 days with the Board, c/o Christine A. Farrelly, Chief of Compliance, Maryland State Board of Physicians, 4201 Patterson Avenue, Baltimore, Maryland 21215.
