Dated 10th January 1890-Read again Petition, dated
the 9th instant, from Nadamuni Ranga Iyengar and others of
Srirangam, stating that Tengalai Vedvyasa Bhattar and others
are attempting to perform the ceremony of Brahmaratham
similar to Iyal procession in the streets of Srirangam against
the custom to wound the religious feelings of Vadakalai people
and requesting that orders may be passed under section 144,
Criminal Procedure Code, as there is a likelihood of a breach
of the peace in consequence of a man being taken in
procession in a car with divine honours. Heard Vakils on
both sides. The Tengalais of the temple at Srirangam propose
to carry out a procession called Brahmaratham this afternoon,
tomorrow and the day after in which one of the disciples of the
Diety belonging to the sect is to be carried in a palanquin or
other Vahanam of the Deity and honoured as a God. The
Vadagalais object saying that the rendering of such honors to
man would be contrary to custom and would be hurtful to their
religious feelings and that if such procession is allowed, there
would be a danger of a breach of the peace. Vakil Sanjiva
Row on behalf of the Madhva Brahmins also objects to the
processions, but does not say that there is any likelihood of

Read again petition dated 21st November 1890 pre-
sented by Mr. S.T.Rangaswami Iyer High Court Vakil on behalf
of the Vadagalai sects and the Madhvas of Srirangam object-
ing to the performance of Brahmaratham procession on the
morning of the 23rd November of which occasion the Rota-
tion Manager Veda Vyasa Alasinga Bhattar was proposed to
be carried on a pedestal (called Tholookiniyan) with all
honours.
Read also letter No.A.dated 22.11.90 from the Taluq
2nd Class Magistrate of Trichinopoly with its enclosures re-
porting on the said petition. Read also petition dated 22nd
November 1890 presented by. S.T.Rangasami Iyer on
behalf of Srinivasa Iyengar and other withdrawing their
objections for the Brahmaratham procession referred to
above.
ORDER.
The papers read above show that the Brahmaratham
in question is one of the under mentioned several of the kind
observed in the Srirangam temple every year.
(a) Two Brahmarathams to Veda Vyasa Bhattar and
Parasara Bhattar each in turn. These to be taken in
Tholookiniyan.
(b) one Brahmaratham to Arayer as above.
(c) Two Brahmarathams or Sreemookha Kattiapaddi
and Pavithroachava Mariyadai to Annangar and Rangachariar
in turn. These are to walk with all honours.
(d) One Brahmaratham to Amoothanar to be taken in
Tholookiniyan. (In the year 2010 not in useage.
(e) One Brahmaratham or Yelavelakken Mariyadai to
Wothamanambi Iyengar to walk with all honours.

I visited Srirangam this morning to enquire in the mat-
ter. I questioned the Deputy Magistrate, the Taluq Magistrate
and the Police Inspector, who are all stopping in Srirangam
for the festival, and they all assured me: (1) that the Tengalai
sect doing nothing contrary to custom and (2) that there is
no danger whatever of a breach of the peace.
The Vadagalai Vakils have produced absolutely no
evidence to show that the contemplated procession is
contrary to custom but they explain this by saying that the
question never arose before, so that there can be nothing on
record. The Tengalais produce a deposition given in 1825 by
the Peshkar, a Government servant, before M.Philips, then
Collector, and also an order of the collector dated .... referring
to the Brahmaratham. Practically no evidence has been pro-
duced before me by either side on the question of custom.
The Taluq magistrate Kandasami pillai has, however been here
for several years and must be familiar with the custom on the
occasion. Whatever, may be the custom, there is no case for
the interference of a Magistrate unless there is an ascertained
danger of a breach of the peace.

The procession objected to is not a new one and the
objection is not therefore valid. As however the Vadagalais and
the Madhvas sect have asked permission to withdraw their
objection petition the withdrawal is accepted.

lating their ideas in verse form, a poetic style, spiced
with symphony, suited to the dignity of the subject on
hand. In the book published now , Sri.Venugopalan a
devotee of Sri Ramanuja has rendered in English all the
108 hymns of Ramanuja Nootrantathi. It is noteworthy that
Ramanuja gave the appellation of 'Amutanar', the
nectarean, to the poet whose original name was Periya
Koyil Nambi but Ramanuja is the poet's nectar-see hymn
19.
The English translation, of Sri. Venugopalan on
hand, needs special commendation as it is not merely a
translation of words but of the underlying ideas, as well.
This book deserves all congratulations for the excellent
work of translation of an intricate poetic composition, of
a high order.
To know God is to love God and to love Him is to
love His devotees with an intensity surpassing even that
of love for Him. This is indeed the quintessence of all
the esoteric teachings of our illustrious preceptors of
yore, purvacharyas. Sri Ramanuja got this secret of se-
crets duly purveyed to Amutanar of Tiruvarangam
(Srirangam) after making him the disciple of the illustri-
ous Kurattalvan.
A junior contemporary of Saint Ramanuja, belong-
ing to the clan known as 'Munkirkuti' the hymnographer
was an influential resident of Srirangam. He was popu-
larly known as Peria Koil Nambi because of his long
standing, affluence and close association with the Temple
of Lord Ranganatha. Besides his proficiency in the
Sastras, Nambi held an important position in the Temple
with a vested interest in many sevices. However ob-
sessed with a feeling of special importance, he did not

Ramanuja Nutrantathi is the best specimen of a
compostion in the 'Antathi' type of 'Kalitturai' metre. This
hymnal, comprising 108 stanzas, is also known as
'Prapanna Gayatri' to be uttered like the Gayatri Mantra
by every 'Prapanna' (one who submits himself to the lov-
ing protection of Lord Narayana, rather to saint Ramanuja,
in this special context.)
It is quite befitting that Manavala Mamuni, the
Yatindra pravanar, saturated with devotion to Ramanuja,
the king of ascetics, should have written a glowing Com-
mentary on this work. In his rapturous outpourings,
'Arthiprabandham', Stanza 40, he calls upon all the vota-
ries to chant this 'Antathi' ('Enrum avan antathi thannai
anusantiyum'.) Pillailokam Jiyar followed suit. After him,
many scholars have shown their depth of erudition in
writing commentaries on this unique prabandham. Still
others have attemped to render these Tamil verses in
sanskrit, and English. Thirumalai Nallan Chakravarthi
Sri.Ue.Ve. Ramakrishna Iyengar Swamy had written a
Tamil Commentary which is known as 'Amudhavirunthu'
elaborating the commentaries of Sri Manavala Munigal
and Pillailokam Jeeyar.

and stray elsewhere, in their wild-goose-chase in quest
of a guardian angel who can work out their salvation-
See stanszas 79 and 90. In stanza 43, the poet calls upon
the people around to utter the nectarean name,
'Iramanucan' and instantly reap the rich harvest of eter-
nal bliss. Actually the poet's address to his mind, in the
opening song, reveals his original intention to chant, to
his heart's content, the several names borne by
Ramanuja but he could hardly get beyond that one name
'Iramanucan', as one can very well see on going through
all the hymns.
The 108 hymns of Ramanuja Nootranttati has been
translated into English by Ramanujadasa
(Sri.S. Venugopalan) keeping in mind the esoteric mean-
ing of each hymn. It is a simple rendering in English which
can be easily understood by all. The verses of Ramanuja
Nootrantathi are themselves in simple Tamil and also the
translation. Among the Srivaishanava literature Ramanuja
Nootrantathi is held at high esteem. On all 'sapthavarnam'
days of Brahmotsavams at Srirangam there is a proces-
sion in the holy streets of Srirangam at that time
Namperumal moves close to Iyal goshti who recite
Ramanuja Nootrantati and after the procession He goes
over to Udayavar Sannithi Where he is welcomed by the
Archavathara idol of Ramanuja himself who offers ten-
der coconuts. It is told that during the life time of
Ramanuja on Sapthavaranam days, Namperumal ordered
Sri Ramananuja not to accompany the Iyal gosthi but to
remain at his mutt only. During the end of the procession
Namperumal would go over to Cheran matam which was
the residence of Sri Ramanuja.
After reciting Nalayira Divya Prabantham it is cus-
tomary for srivaishnavites to render Ramanuja
show due respect for Saint Ramanuja who, at that time,
was the Supreme leader of the srivaishnava community.
Nevertheless, in the exercise of his sweet, spontane-
ous grace, Ramanuja thought in terms of pruning the
pride of Nambi and putting him on the right track, To this
end, he entrusted to his illustrious disciple, Kurattalvan,
the task of inducing in Periya Koil Nambi the requisite
spiritual awakening. Kurattalvan carried out his mission
with great success and the spiritually regenerated Nambi
sought asylum at Sri Ramanuja's lotus feet. Showering
his grace on the supplicant, the great Acharya made
Nambi the disciple of Kurattalvan under whose care the
disciple made repid progress and became an ardent
devotee.
Stressing his unflinching faith in his Acharya
(Kurattalvan) in stanza 7 and using it as a spring board
for his ardent admiration of the 'pracarya' (Sri Ramanuja)
the poet pours out his heart to the Saint, in all the other
stanzas. Sri Ramanuja's adoration of the alvar Saints and
the Acharyas preceding him has been brought out in stan-
zas. 1,2,8 to 21, 29, 60, 64 and 88. The reader cannot but
be thrilled by stanzas 36 and 41 which show where and
how Sri Ramanuja excels even God. In stanza 33, the
poet even goes to the extent of declaring that the vast
array of Lord Narayana's lovely weapons of rare excel-
lence came into Ramanuja's possession for performing
the benevolent role of that protecting Deity. By adoring
Sri Ramanuja's devotees and looking upon them as his
own masters, the poet has brought into focus the glory
of 'Carama parva nistai' mentioned in stanzas 2 to 11, 12,
29, 37, 55, 68, 75, 76, 80, 84, 85, 86, 96, 97, 104, 106 and
107. Full of compassion and fellow feeling, the poet de-
plores the fate of the misguided worldlings who ignore

2. Judges must avoid baseless remarks: Bill

New Delhi: The government has endorsed a recommenda-
tion of Parliament's standing committee to restrain judges from
making baseless comments against constitutional and statu-
tory bodies and their functionaries even in cases which don't
concern them directly.
The decision forms part of the Judicial Standards and
Accountability Bill, which is to be discussed by the Union Cabi-
net on Tuesday.
The government al so expanded the standi ng
committee's recommendation-that close relatives of judges
should not practise in the same court-to include even close
social acquaintances.
The Judicial Standards and Accountability Bill is part
of a bouquet of anti-graft legislation the Cabinet intends to dis-
cuss on Tuesday.
(For a sitting judge to make unsubstantiated comment
on person holding constitutional office or statutory bodies, and
not connected with the case, is unwarranted. It gives rise to
controversies and affects the working of constitutional body
against which comment has been made by any judge.)

In the Affidavit filed in the High Court by the Secre-
tary, Department of Tamil Development and Religious En-
dowments, Fort st. George Chennai-60009 in the Year 2007
It is Stated that
"The appointment of an Executive Officers only to
look after the administration of the Temple and management
of the properties, and to realize the income due from them,
so that the income may be appropriated for the purpose for
which the endowments were created. so it does not mean
that it will interfere with the rights of Dikshidars relating to
their religious practices in the temple."
Section 23 in Chapter III of the Tamil Nadu Hindu
Religious & charitable endowments Act, 1959 under the head
Interference with Religious practice and Religious affairs pro-
hibited.- This section deals with the powers of the Commis-
sioner in respect of the administration of all charitable and
Hindu Religious Institutions and Endowments. It may be
pointed out that the powers of the Commissioner are limited
only to the adminstrative aspect of the Hindu Religious insti-
tutions and he should not interfere with the religious prac-
tices and religious affairs of a temple, and any such interfer-
ence would offend article 26 of the Constitution.
Section 25 of the same act states that [Commissioner],
etc., to observe appropriate forms and ceremonies.- [The Com-
missioner, an Additional Commissioner, a Joint Commis-
sioner], a Deputy commissioner or an Assitant Commissioner
and every other person exercising.

Powers of superintendence or control under this Act,
shall, so far as may be, observe forms and ceremonies appro-
priate to the religious institution in respect of which such
powers are exercised and in the case of a math, act in confor-
mity with the usages of the math in his dealingswith the head
of the math.
The commissioner, Additional/Joint/Deputy/Assistant
Commssioners and all other officers exercising supervison
or control under the various provisions of this Act should
observe such forms and ceremonies appropriate to the Hindu
Religious institutions over which such control is exercised
and in the case of a math, they should confrom to the usages
of the math in his dealings with the head of the math. This
section is incorporated so as to protect the rights conferred
in article 26 of the Constitution.
Act not to affect rights under Article 26 of the Consti-
tution.- Nothing contained in this Act shall, save as otherwise
provided in section 106 and in clause (2) of Article 25 of the
Constitution, be deemed to confer any power or impose any
duty in contraventionof the rights conferred on any religious
denomination or any section thereof by Article 26 of the Con-
stitution.
Interference in religious matters and adjudication on rituals
and religious matters:
1) The protection of Articles, 25 and 26 of the consti-
tution is not limited to matters of, doctrine or belief, they
extend also to acts done in pursuance of religion and there-
fore contain a guarantee for rituals and observances etc.
Which are the integral parts of religion. what constitutes an
esential part of a religion or religious practice has to be de-
cided by the courts with reference to the doctrine of a par-
ticular religion including practices which are regarded by the
community as a part of its religion. [8271]
1. The learned Single Judge Sri Jayachandran has
erred in remanding a matter (under Sec. 63 of the T.N. HR &
CE Act, 1959) pertaining to religious custom to be decided
by the Joint Commissioner, who is a Government Servant
and not a competent person to adjudicate on such religious
matters and temple traditions.
2. The learned Single Judge ought not to have
referred the matter to the Joint Commissioner under Sec. 63
for deciding a integral and important part of an existing and
continuing ritual, custom, belief and tradition of the temple
which has been ordained by Lord Ranganatha himself. When
such is the religious belief of a denomination of Vaishnavas
and/or a sub-sect thereof and of general worshippers of
Srirangam Temple there is no scope for even courts to go
into correctness of the religious belief or to modify the
religious belief as per established judgments of Honble
Supreme Court.
3. The decision of the Trustees to alter the Bramaratha
ritual is against the express rule 9 of the Tamil Nadu Temple
Entry Authorization Act, 1947 and the rules framed in the
yaer 1948 published [G.O. MS. No. 164, FIRKA
DEVELOPMENT, DATED THE 23RD MARCH 1948] that
clearly prohibits any Trustee or Executive to alter any mode
of worship, which would affect the rights worshippers generally
had on 13
th
May 1947. While so, the learned Single Judge
ought not to have referred the matter to the Joint
Commissioner under Sec. 63 when the very resolution passed
for alteration of the ritual by the trustees and supported and
upheld by the HR & CE Department is illegal and
unsustainable.
4. The learned Single Judge failed to see that the
department to which he has referred the matter under Sec.
63 is the very perpetrator of the violation of this religious

ritual and no good would come out from this chronic violator
of religious rituals and established traditions.
5. Sec. 63 is against the express rules of the Tamil
Nadu Temple Entry Authorization Act, 1947 and the larger
issue of the correctness of a religious function cannot be
decided by an executive who is no competent person like say
the Head of a religious denomination or a learned authority
on religious tenets.
6. Sec.63 of the HR & CE Act, 1959 is in conflict with
section 23 of the same Act, which gives powers to the
Commissioner, HR & CE powers to supervise and administer
matters pertaining to only secular aspects of the religious
institutions.
7. Sec. 63 of the HR & CE Act cannot take away the
rights conferred on a denomination or sections thereof as per
Sec. 107 of the T.N. HR & CE Act, 1959 which bars such
intervention by any official of the Department in such rights.
8. Sec. 63 of the T.N. HR & CE Act is ultra vires
Articles 25 and 26 of the Indian Constitution in as much as it
seeks to empower a Department official to decide on religious
customs and traditions and therefore the learned Single Judge
grossly erred in referring the matter under Sec. 63 to the
Joint Commissioner. ***

I. A Krishnamachari, S/o. late R. Ananthachari, Hindu,
aged about 73 years, residing at 214, East Uthra Street, Srirangam,
Trichy 620 006 now having temporarily come down to Madurai,
do hereby solemnly affirm and sincerely state as follows:
1. I am the petitioner herein and as such, I am well
acquainted with the facts of the case.
2. I respectfully state that I am a permanent resident of
Srirangam. I am a Sri Vaishnavite. I am a daily worshipper of
Lord Narasihma. The Narasimha known as kattazhagiya Singar
temple is located at a distance of hardly 1-1/2 km. from my house.
3. I respectfully state that Arulmighu Kattazhagiya Singar
temple was constructed in the seventh century A.D. One Vallabha
Pandian of Pandya dynasty who was an ardent disciple of
Periyalvar and Andal had constructed the said temple. The temple
is worshipped by all members of the public. It is a public temple
coming under the supervision and control of the H.R. & C.E.
Department. The Executive Officer of the Sri Ranganathaswamy
temple is also in-charge of the administration of Sri Arulmighu
Kattazaghiya Singar temple. There is also a rotation trustee for
the temple.
4. I respectfully state that the temple is spread over a
large area. The sanctum sanctorum is about 250 feet away from

the main entrance. The compound wall, though old, is in a good
condition. Unfortunately, the northern side of the main entrane
was recently breached and demolished so as to facilitate move-
ment of the lorries and bulldozers. This had happened on 2.12.2011.
When I enquired further, I was told that a Kalaiarangam is to be
constructed within the temple precincts itself. The proposal ap-
pears to be mooted by the then Honourable Minister for H.R. &
C.E. Department Thiru Paranjothi. This was reported in Dhina
Malar issue of 28.11.2011 in the Trichy Edition. There after cer-
tain preliminary works were carried out. I therefore sent a rep-
resentation to various authorities. The said representations have
since been received by the respondent authorities. I am enclos-
ing copies of the representations date 30.11.2011 sent to the Chief
Minister of Tamil Nadu and 5.12.2011 to the second and third
respondents. I am also enclosing the acknowledgement cards in
this regard. The contents of the representations may be read as
part and parcel of this affidavit. Even though the respondents
have received my complaint, they are yet to pass orders thereon
or respond. In these circumstances, I am left with no other op-
tion but to file the above Writ Petition.
5. I respectfully state that the subject temple is a very
ancient one. Though not formally notified, it has to be consid-
ered as an ancient monument of architectural significance and
important. Therefore, it would be improper to allow new con-
struction to be put up within its precincts. The authorities have
no right to carry out or carry on any activity that is inconsistent
with the settled customs, usages and practices of the temple. A
kalaiarangam in the very nature of things is meant to provide
entertainment. The activities of the temple and its daily routine
do not warrant putting up of any new construction. It would there-
fore serve only the purpose that would be totally alien to the
temple activities. It is intrinsically non-religious. Besides it would
mar the architectural appearance of the temple. The sanctity
and the sacredness of the temple will be spoiled by the construc-
tion of kalaiarangam. I am informed that a sum of Rs. 5 crores
is to be expended for the purpose. The source of funding is yet to
be disclosed. But is believed that the temple fund of Sri
Ranganathaswamy temple is to be utilized for this. This can only
be construed as a deliberate act of diversion of temple funds. The
statement of the then Honourable Minister is that it is for devel-
opment of arts. Therefore, it cannot be said to be connected to
Hindu religious worhip. Since the construction activities are likely
to gather momentum and the preparatory works are on, and since
the authorities have not responded to my complaint, I am con-
strained to file the above Writ Petition by invoking the extraor-
dinary jurisdiction of this Honourable Court under Article 226 of
the Constitution of India for the following among other.
Grounds
a) The proposed construction of a kalaiarangam within
the precincts of Arulmighu Kattazaghiya Singar temple is clearly
illegal and voiolative of the mandatory provisions of the Tamil
Nadu Hindu Religious Endownments Act and the rules framed
thereunder. The rule 37 of Management and Preservation of prop-
erties of religious Institutions states that it shall be the duty of
the trustee or the board of trustees to ensure that the utmost
care is taken of the architectural, sculptural and archaelogical
features of every structure in the temple or on its lands in his or
its charge. The proposed construction is clearly inconsistent with
the said statutory mandate. Rule 8 of Tamil Nadu Temple Entry
Authorization Act, 1947 is evident that the temple buildings and
premises shall not be used for purposes not connected with or
arising from the worship, usages and observations of such temple.
b) The temple funds will have to be utilized in a prudent
manner. The proposed construction which will cost not less than
Rs. 5 crores is clearly a wastefull expenditure. It will not even
serve the ostensible purpose of the proposed kalai arangam as
the kalaiarangam is in a remote corner of Srirangam. It has no
bus facility.

c) The petitioner's right as a worshipper is clearly in-
fringed in this case. As a daily worshipper of the Lord, the peti-
tioner is entitled to objecrt wrongful user of the temple land and
funds. The proposed construction has come up right inside the
premises of the temple. The Temple is known as 'Venduthal'
temple. Thousands of devotees congregate on the days of
Pradosham and Swathi Star. Therefore the construction of the
kalai arangam will reduce the congregation of the kalai arangam
will reduce the congregation space available for the devotees. It
will also render impossible the lighting of Lakshadeepam which
is done in the month of karthigai every year.
d) Even for carrying out renovation work, the sthapathis
will have to be consulted. The subject temple is an agama temple
governed by Pancharatra agama. Therefore, the construction of
the kalaiarangam will be contrary to the agamic principles.
I have not filed any other suit or writ before any Courts
of law claiming the relief now sought for in this writ petition.
It is, therefore, humbly prayed that this Honourable
Court may be pleased to pass an order of interim injunction re-
straining the respondents from putting up any new construction,
kalaiarangam in the temple premises of Arulmighu
Kattazaghiyasinger temple pending disposal of the above writ
petition and thus render justice.
It is, therefore, humbly prayed that this Honourable
Court may be pleased to issue a writ, order or direction in the
nature of a WRIT OF MANDAMUS forbearing the respondents
from putting up any new construction, kalaiarangam in the temple
premises of Arulmighu Kattazaghiyasingar temple and pass such
other and further orders as this Honourable Court may deem fit
and proper in the facts and circumstances of the case and thus
render justice.
