CRIMINAL LIABILITY FOR THE ACTIONS TAKEN BY THE DOCTOR PATIENT ON DEMAND EUTHANASIA ABSTRACT Marretha Ihfallia 05100047

Euthanasia is an issue that dilemmatic both among doctors, lawyers, and religious societies. In Indonesia, this issue was also discussed, as is done by the Indonesian Doctors Association (IDI) in the seminars in 1985 involving medical experts, lawyers and jurists positive, but the results are still not there agreement rounded to the problem. Writing this thesis aims to determine whether euthanasia can be categorized as a crime and assess liability in criminal law measures Euthanasia Indonesia, and wanted to know and assess stelsel action at his own request euthanasia under criminal law of Indonesia. The research approach used is a normative juridical approach that is supported by some form of approach, namely the approach of juridicalcomparative, historical-documentary approach, and the juridical-theoretical approach. File of the study using secondary data. Normative analysis used is qualitative, but classified as an inventory reference frame analysis of positive law, a study of the principles of law. The results showed Euthanasia in the Book of the Criminal Justice Act (Penal Code) Indonesia is categorized as a crime against life. Provisions that can be applied relating to euthanasia is article about the murder, namely, that: Article 338 of the Penal Code, Article 340 of the Penal Code, Article 344 of the Criminal Code and Article 345 of the Criminal Code. Accountability in the act of euthanasia under criminal law of Indonesia, is from a legal perspective, errors / omissions will always be against the law in relation to the nature of an act committed by people who could be responsible, while stelsel Euthanasia action at his own request under Indonesian criminal law is the most likely Euthanasia for stelsel action at his own request under Indonesian criminal law is manslaughter as defined in Article 338 of the Penal Code, or premeditated murder as defined in Article 340 of the Penal Code.
