On 07/07/2012, I, Officer J. Moore, was dispatched to BCH Balsam (1100 Balsam) reference a male who was causing a disturbance. I was further informed that this male was located in the ICU. Upon arrival, I was pointed to room 113 in the ICU, where I saw the suspect (Eric Cech) secured by his wrists and chest to the bed. I spoke with the victim (Kevin Butler), who told me the following: The patient had been repeatedly demanding a cigarette and he repeated informed the patient that he could not smoke per hospital policy. The patient had been manipulative and demanding but not aggressive to this point. The patient voided in the urinal and when I entered the room the take the urinal to empty, the patient threw the urinal (with approximately 500 ml of urinal) at my head. The patient then attempted to punch at me at least twice, missing both times. The patient was physically subdued and restrained by me, fellow ICU staff and hospital security. I did receive a small amount of urine in my mouth and right eye and a large amount of urine on my (right) face and down my shirt. I asked Kevin if Eric said anything before, during, or after the assaults. Kevin said that he continued to demand to smoke. Kevin also said that when he entered the room, he observed Eric pop the top to the urinal, which gave him (Kevin) an idea of what was about to happen. Kevin was able to turn sideways in time to avoid the urine hitting the front of his face. He does not know where the urinal itself hit, but it did not hit him. Kevin stated that when Eric tried to punch him, he was secured via a chest strap to the bed. This strap prevented Eric from sitting up and getting close enough to strike Kevin. Once Eric "calmed down," Kevin stepped closer and was able to place wrist restraints on him. All the urine had dried prior to my arrival and the room had been cleaned. Kevin stated that the urine was thrown at him approximately 15 minutes prior to my arrival. Kevin also said that he was wearing two layers of shirts, the outer (scrub) layer was light blue with an orange under shirt. He was also wearing grey (scrub) pants. He used a towel to dry off most of the excess urine prior to my arrival. When asked, Eric denied throwing urine at Kevin. While there was hospital staff nearby, no one else saw the throwing of the urinal. It should be noted that, prior to the incident, Kevin was dressed in scrubs and had on his ID badge, identifying him as an RN, making it readily apparent that he was a medical personel. Kevin stated that he was Eric's RN since approximately 1900 hours. He added that he always introduces himself (name and title) when beginning his shift with a patient. I also spoke with Judy March, who also works in the ICU. She stated that while she did not see the urine thrown at Kevin, she did witness the aftermath. She verified that Kevin's shirt was wet with urine, but added that the urine did not turn the shirt a very dark color that normally indicates wetness. She also smelled the urine on Kevin as well as in the room. She saw urine all over the floor leading towards the doorway as well as on the cabnets. The cabnets are located to the right, when entering the room, and are between the headboard and the doorway. Upon the issuance of the summons, Eric was both restrained (wrists) and sedated. He was unable to sign the summons. This was noted on the summons, and a copy was placed with his personal belongings. Status: Cleared with a summons (CR92381)

On 07/09/12, I, Officer S. Rodgers was dispatched to BCH Balsam to arrest Eric Cech for an assault which Cech committed against a staff member. When I arrived at BCH I contacted security staff that I would be going to the Police Department and would return with the paperwork for this case. I found that Eric Cech was cited for Third Degree Assault with citation #CR-92381. The citation was issued on 07/08/12, and the Defendant was listed as "unable to sign".

I took the citation from records and returned to BCH to speak with Cech. When I arrived at BCH I spoke with Cech who said: I asked Cech if he received a citation when came to the hospital, and Cech said that he was unsure. I asked Cech to look through his belongings and Cech was able to find his copy of citation CR-92381. I obtained Cech's copy and crossed out the issuance date of 07/08/12 and changed it to todays date 07/09/12. I also changed the defendants status of "unable to sign" to having Cech sign for the ticket. I told Cech the charge and the court date for which he signed for and I gave him his copy of Citation CR-92381. For further information refer to the original report. This case will be cleared with the issuance of citation CR-92381 to Cech.
