Publicada Providencia de la SUNDECOP sobre la Obligacin de notificar costos y precios de medicinas

En la Gaceta Oficial N 39.986 de fecha 15 de agosto de 2012, fue publicada la Providencia mediante la cual se establece la obligacin de notificar los costos y precios de los medicamentos. El objeto de la providencia es establecer la obligacin a los sujetos de aplicacin del Decreto con Rango, Valor y Fuerza de Ley de Costos y Precios Justos que produzcan, importen, distribuyan y/o comercialicen los medicamentos sealados en su artculo 3, de notificar a la Superintendencia Nacional de Costos y Precios, a travs de 2 procesos de carga, la informacin contable referida a los costos de produccin , importacin , distribucin y/o comercializacin, correspondientes al cierre del ltimo perodo fiscal del ao 2011 y del primer semestre del perodo fiscal del ao 2012, as como los precios de venta para sus diferentes canales de distribucin o comercializacin , vigentes a la fecha de la publicacin de la presente Providencia Administrativa. Esta Providencia establece que se entiende como precio de venta, el precio lista unitario por producto existente en el mercado al momento de la entrada en vigencia de este acto administrativo. A los efectos de esta Providencia y de conformidad con la Ley de Medicamentos , se considera medicamento a toda sustancia y sus asociaciones o combinaciones, destinadas a prevenir, diagnosticar, aliviar o curar enfermedades en humanos, a los fines de controlar o modificar sus estados fisiolgicos o fisiopatolgicos. Los medicamentos sujetos al registro y notificaciones a los que se refiere el artculo 1 de esta Providencia Administrativa, sern aquellos que hayan sido registrados y/o autorizados ante el Ministerio del Poder Popular para la Salud como Especialidad Farmacutica (EF), Especialidad Farmacutica Genrica (EFG) y Producto Biolgico (PB), de conformidad con la Ley de Medicamentos; y estn siendo efectivamente comercializados al momento de la publicacin se la Providencia. La notificacin de los precios de venta y los costos de produccin, importacin, distribucin y/o comercializacin de los medicamentos sealados en esta Providencia, deber realizarse a partir de la entrada en vigencia de esta Providencia Administrativa hasta el da Viernes 31 de Agosto de 2012. La Providencia entrar en vigencia a partir de su publicacin en Gaceta Oficial.

Publication of Administrative Order issued by SUNDECOP ordering the notification of drugs cost and prices
Order providing the obligation to notify the drugs costs and prices was published in Official Gazette No.39,986 of August 15, 2012. The purpose of such Order is to impose the obligation on the individuals and entities subject to the application of Decree with Rank, Value and Force of Law of Fair Cost and Prices, who manufacture, import, distribute and /or sell the drugs listed in Article 3, of notifying the Office of the National Superintendent of Costs and Prices, through 2 data loading processes, on the accounting information relating to the costs of production, import, distribution and / or sale corresponding to the last fiscal period of the year of 2011 and the first half of the fiscal period of the year 2012, as well as the sales prices for the different distribution and sale channels, in effect at the date of publication of the Administrative Order. This Order sets forth that sales price will be understood as the unit list price per product in place in the market upon entry into effect of this administrative action. For the purposes of this Order, and in pursuance with the Drugs Law, any substance and its associations or combinations, aimed at preventing, diagnosing, alleviating or curing any human illnesses, so to control or modify their physiological or patho-physiological conditions, shall be deemed as drugs. The drugs subject to the registration and notifications referred to in Article 1 of this Administrative Order will be those registered and/or authorized by the Ministry of Popular Power for Health as a Pharmaceutical Specialty, Generic Pharmaceutical Specialty, and Biological Product, in conformity with the Drugs Law, and effectively traded at the date of publication of the Order. Notification of sales prices and costs of production, import, distribution and / or sale of drugs indicated in this Order shall be made from the effective date of this Administrative Order up to Friday, August 31, 2012 The Order came into effect from its publication in Official Gazette.
