Vanakkam. The horrors of the genocidal war waged by the Sri Lankan State on its own people, the hapless Tamil populace are bound to haunt humanity for long. Tamils have been treated as second class citizens in their own country Sri Lanka, with due rights and opportunities denied to them. On June 14, 1956 Mr. S. W. R. D. Bandaranayake, leader of the Srilanka Freedom Party and Prime Minister, who won the Parliamentary Elections held dominated by the majority Sinhalese to enact Sinhala Only as the official language of Ceylon. This was a negation of the hitherto accepted language policy of treating both Sinhala and Tamil as the official languages in place of English. The imposition of Sinhala only represented the subjugation of Tamils by Sinhalese imperialism. In protest the Federal Party which opposed the Sinhala only act staged Satyagraha in Colombo under the leadership of S.J.V. Chelvanayagam. Since then, Tamils have made various attempts to protect their dignity and cultural identity which included agreements evolved from negotiations, parliamentary debates, peaceful agitations, third-party interventions and armed struggle. But their hope has been shattered, belied and betrayed repeatedly by the Sri Lankan State. A well planned Sri Lankan state sponsored colonization with Sinhalese people in the traditional Tamil homelands in Sri Lanka continues unabated for the past 65 years. In the Northern and Eastern regions, where there was a sparse Sinhala population previously, Sinhalese are now being actively state-aided and encouraged to migrate to planned settlements in areas traditionally populated by Tamils, thereby drastically changing the demography enabling Sinhalisation of the Tamil homelands. ..2 ..

On July 26, 1975 the Bandaranayake-Chelvanayagam pact was signed. The B-C pact envisaged decentralization of powers to the North and East through the establishment of Regional Councils. But Bandaranayake abrogated the pact under pressure from Sinhalese chauvinists. When the 1983 incidents of attacking and butchering the Tamils took place all over the island of Sri Lanka, and after the inhuman massacre of the Tamil inmates of the Welikade prison, the then Prime Minister of India, Mrs. Indira Gandhi categorically called the attack, a state sponsored genocide, on the floor of the Indian Parliament. All these culminated in the armed clashes between the resisting Tamil militants and the aggressive Sri Lankan forces in which

thousands of hapless civilian Tamils were maimed or killed, both physically and psychologically. In order to maintain a hormonial diplomatic relationship between the two countries, the then Prime Minister of India, of Thiru. Rajiv Gandhi and Prime Minister of Sri Lanka, Thiru. Jayavardhane had signed an agreement in the year 1987 known as Indo-Srilanka Peace Accord. But it did not come into force. These efforts of Indian Government did not bear fruit and the war between the Tamil rebellions and Sinhalese armed forces continued. In the meantime a new Government under the leadership of Mahinda Rajabaksa took office and the war between the Tamil Militant Groups and the Sri Lankan Forces intensified. The Government of Sri Lanka, under the guise of fighting terrorists and terrorism, unleashed a genocidal attack against innocent Tamil

civilians in broad day light and in full view of the world community in the year 2009 at Mullivaikkal. This shook the world community. People from all over the World were shocked to see the brutal killings of Tens of Thousands of innocent men, women and children by the Sri Lankan Army without regard to any of the war time principles as contemplated in United Nations conventions. This has led the United Nations to make Suo Motu action

against Sri Lanka, and hence a committee was appointed by the Secretary General of United Nations Organisation. The report of the committee appointed by the Secretary General of the United Nations and the fact finding reports of many Human Rights Organizations confirmed that the State of Sri Lanka through its Army had committed severe war crimes. The Media and the Voluntary Service Organizations were driven out of the Island so as not to bear witness to the state sponsored atrocities unleashed against the Tamils. Even after the war was over, the Tamils were kept in detention camps without even the basic amenities of life. The camps and even the localities where Tamils live today are more like military controlled areas with the presence of army personnel all over the Tamil traditional homeland. Lacking in civic facilities, Sri Lankan Tamils have no democratic space to air their grievances, speak out and protest peacefully. The situation is such that they live in constant fear of apprehension and anguish. The Sri Lankan State is going ahead with its plan of systematically delaying the process of rehabilitating the IDPs back in their homes and returning their agricultural lands to them under the guise of demining the lands. Many Tamil youths have vanished without any trace. Many are said to be in torture camps, subjected to untold pain and misery. Tamil women are facing all kinds of abuses at the hands of the Sinhalese armed forces. Tamil children live in full glare of the guns and the violence unleashed by the armed forces.

In the aftermath of war and even after UNHRC passed a resolution demanding the implementation of the recommendations of the internal enquiry commission (LLRC), the conditions of Sri Lankan Tamils remain as follows:1) fact Government claims that Its a f act - as Sri Lankan Gover nment c laims - that there are only about Far ther e ar e onl y a bout 6000 Tamils left in Menik Far m. hav mov Most of the Tamil people ha ve been mov ed to their villages which have no basic facilities. After a few months, the families grapple with basic needs. It is the duty of the civilised world community to find out ways and means to save an ethnic, cultural and linguistic race which has been put to all kinds of inhuman and unequal treatment by a Government which has failed in its moral responsibility to protect their own citizens.

Considering the various events and happenings mentioned above, TESO conducted a Conclave and Conference on Protection of Right to Life and Liveihood of Eelam Tamils on 12.8.2012 at Chennai, India. Many Human Rights activists across the globe including representative from Amnesty International, representatives from Sri

Lankan political parties and Sri Lankan Tamils living in exile were invited to the Conference along with leaders of Indian political parties. After a long deliberation during the Conclave, many resolutions were passed unanimously taking into consideration the short term, medium term and long term needs of the Sri Lankan Tamils living in the Eelam area. When we recall these interventions made by the Indian Government in the past, considering the prevailing political and other situations in Sri Lanka, TESO sincerely believes that the issue now has become the South Asian Issue, to be resolved with International perspectives through U.N.O. Therefore, We appeal to the Government of India,

1) to bring a resolution in the United Nations General Assembly and The UNHRC, for bestowing the rights to the Tamils in Sri Lanka, to decide a political solution by themselves, which they have been demanding, as was decided by the Conference; 2) and consequently initiate all possible diplomatic strategies to bring the other Member Countries of the U.N. in support of the resolution to be moved by the Government of India; 3) to grant Indian Citizenship or Permanent Resident Status to all the Sri Lankan Refugees living in India, and U.N.Protocol on Refugees should be followed in India; 4) to send a team and monitor that Rs. 500 crore granted by the Indian Government as rehabilitation assistance

a n d o t h e r m a t e r i a l a s s i s ta n c e s f o r t h e Ta m i l s i s properly made use of for these works. 5) to play its primary role in implementing the solutions including release of imprisoned Tamils, free and safe home coming for the overseas Sri Lankan Tamils, restoring Tamil tradition and culture, establishment of Schools and Universities, extension of Medical facilities and undertaking rehabilitation works as requested in Resolution No.10; 6) t o ta k e a p p r o p r i a t e m e a s u r e s t o p r o t e c t I n d i a n Fisherman from the attacks by Sri Lankan Navy by bringing back Kachattheevu under the control of Government of India and establish an Indian Naval Unit at Danushkodi or Mandapam. (Resolution No.11) and 7) to avoid training Sri Lankan Defence personnel as requested by this Conference. (Resolution No.12).
