Marsh: I just recently received your communication dated August 20th on behalf of the Brotherhood of Christ (BOC). I must say I am a bit confused. While my disserta tion is abstracted by Proquest, I specifically placed the following request when it was registered with them: At the request of the author, this graduate work is not available for purchase. The copy that is held by Northcentral University (NCU) i s one that even I cannot access as it is made available ONLY to current , faculty and staff. The abstract says Nothing identifiable about BOC: The purpose of this descriptive ca se study was to provide an initial examination of the issues experienced by former members of the authoritarian sect, Community, who were children when active in t he group. Secondary to this, but still of vital impact to the first purpose, was to obtain an overview of parenting practices utilized by members of Community. Specifically, the areas of the lived experience of children and parents in Community, the philosop hies and belief systems of the followers of James Franklin, particularly as they impa ct children and child-rearing practices, and the impact these issues have on the la tter lives of the concerned individuals were examined for common themes. In-depth interview s with thirteen former members of Community addressed each of the factors examined , and provided a thick, rich description of the lived experience in Community. Add itional information in the form of archival data and informal interviews were used to triangulate the data. The findings of this study are encouraging in that they su ggest that effects predicted through speculative insight are fairly accurate, at least for this particular high-demand group. Findings related to impaired bonding attachments, difficulties with memory and concentration, and ongoing social and relational problems are identified. To date, as far as I know, it has never been either req uested or cited. No one has inquired about it directly with me. Far from making any profits from my dissertation, it cost me considerable funds. It is not, nor has it ever been, for sale. I do not have a web page, and never have had on e, much less posting this to one. The electronic copies held by NCU and Proquest are digital copies only as far as I know and have never been offered to any third party. So, to their demands: 1. You immediately remove its copyrighted photos and text from your web pag es: a. That s no problem at all since I have never had any photos or text of ANY kind on my

web pages as I have never had a web page in my life. 2. Cease and desist from offering copies of the dissertation . . . on any w eb sites to third parties: a. See 1a above b. Proquest specifically state that no copy is available for sale (see atta ched screen shot), and NCU s is not available to the general public, and not even I can access it thr ough them. 3. Demands payment of $10,000 in fees: a. Any use I made of text or photos fell within fair use The four factors of fair use that are considered are: 1. the purpose and character of your use a. Purposes such as scholarship, research or education may also qualify as transformative uses because the work is the subject of review or commentary. 2. the nature of the copyrighted work a. There is a stronger case for fair use if the work that is quoted from is factual and not fictional in character, also a stronger case is made for fair use if the work is published. 3. the amount and substantiality of the portion taken, and a. The less that is taken, the more likely is the case of fair use . I used 994 words out of 228, 500 words, or 0.00435% of the original (that s 435 one-hunded thousandths of a percent). I do not believe that anyone could consider that a substantial proportion of the original work. In fact, it may be considered de minimus thus excluding the need for any further fair use analysis. 4. the effect of the use upon the potential market. a. As my dissertation is neither available or sold to the general public, a nd all names of people, places, and institutions were changed to protect the members of The Group (both current and former), I cannot conceive of any way that there would be any effect at all upon The Groups s potential market. b. I have no money to accede to their demands even IF I wanted to. (There s an old saying: You can t get blood from a turnip. ) 1. I have been on disability since Nov. 19, 2009. 2. I have been hospitalized three times during that time-frame, because of the disability, I had no insurance coverage for the entire period and now have about $50,000 in medical bills alone that I cannot pay. During the last of these hospitalizations I almost died and spent close to a week in intensive care . 3. Because of my difficulties, we no longer own a home. Separate from all of these issues, I have a hard time believing that money is wh at is truly at issue. From what I remember, and from what is stated in Vol I, the Law of Man is not a good thing (one of the Fallen Watchers), and money is evil and has to do with Self-Glory. In addition, their history found online on their sit e (http://www.sealedportion.com/church_history.htm) states From the earliest beginnings the Lord led us by giving us principles to live by. The first princi ple was that we were not to direct any of our energy towards that which we were against. The Lord wanted us to only and always express that which we were for; and we were fo r

Him. So, my belief is that there is some other underlying issue. If this can be addr essed directly, I would be very happy to do so. While I m guessing they currently see me as an enemy, I am not. I still remember them with fondness in my heart. I m guessing that they feel that my dissertation painted them as evil. That was not my intent. I n reality, the only truly negative thing I identified was that by replacing the parental bo nd with children with a bond with god instead, the attachment bond is damaged resulting in attachment issues later in life, at least for those who chose not to remain with The Group. It is very possible that for those who chose to accept this displacement of the parental bond as primary, would be no damage to later attachment bonds. It s an interesting question and the one that I initially wanted to address. Anyway, if they would lay out what the real issue is, instead of foregoing their spiritual values in order to punish (?) me, I am sure we could work something out. On the chance that they choose to continue to direct their current energies against me, I will try to see if I can find someone through Legal Aid or someone willing to do pro bono work to continue this unpleasant path.
