Georgia Legal Services has given my family hope for the future.

GLSPs legal assistance makes a diference
in the lives of the most vulnerable and
medically needy among us, such as baby
Jordyn. Jordyns case represents a major
victory for all low income Georgia families
whose childrens home nursing hours have
been arbitrarily reduced even though they
are absolutely necessary for their health.
Baby Jordyn is one of 760 medically needy who
benetted from GLSPs legal assistance in 2011.
The Georgia Legal Services Program (GLSP) is the largest non-prot law rm
in the state providing access to justice and opportunities out of poverty for Georgians with low incomes.

Baby Jordyn Barker was born with a chromosome 17 deletion syndrome, a rare and dangerous
condition that has caused several life threatening difculties in her short life. Among other
chronic problems, she has seizures and must be fed through a tube. She has had surgery on
her kidneys and her bladder is now attached to the wall of her abdomen. Another surgery
was planned not long before her second birthday to correct the curvature of her spine, after
which she was to be put in a full body cast to heal. She could be at home, but would require
skilled and nearly constant nursing care to keep her alive.
Jordyns mom has to work full time to support Jordyn and her two sisters and was relying on
nurses who came to her home to care for the baby 52 hours each week. Those hours were
paid for through Medicaid by the Georgia Pediatric Program (GAPP). But even as doctors
were recommending an increase in the nursing hours
following Jordyns surgery, GAPP suddenly decided to
reduce the nursing hours to 40 per week. Ms. Barker
sought legal help from GLSP.
Her GLSP lawyer led an appeal of the reduction
in nursing hours and also sought an increase in
the nursing hours, as Jordyns doctors wanted.
Federal Medicaid policies provide for nursing
hours for medically fragile children like Jordyn
if they are deemed medically necessary. Having
seen other cases where GAPP ofcials were reducing
medical services to children with serious disabilities or
illnesses, her GLSP lawyer contended that GAPP ofcials
were routinely reducing medical services based on administrative
concerns, rather than what the doctors said was necessary. In
resolving Ms. Barkers appeal, GAPP ofcials ultimately agreed
to cover 84 weekly hours of nursing, as well as intensive
nursing care immediately following Jordyns surgery.
Saving the lives of the medically needy
Taking a stand against family violence
Ms. Paulson put her body between her baby and the man kicking
both of them. He was the father of the little girl, but Ms. Paulson had
tried to leave him because he had been violent with her several times.
Nonetheless, he kept harassing her and she believed he was stalking
her. One day, he came to her home, became violent and began
trying to kick the baby. Ms. Paulson protected the baby, sustaining
injuries to herself, then ed to a shelter which referred her to GLSP.
Her GLSP lawyer was able to get a 12-month protective order against
the batterer, as well as an order that he pay child support. The
judges order also gave Ms. Paulson custody of the child.
GLSP is in the forefront of our states eforts to protect
survivors of family violence and abuse. In addition to
assisting survivors in obtaining protective orders, GLSPs
legal assistance ofers survivors a permanent way of escape
through economic stability. Survivors obtain housing, child
custody, child support, or access to public benets. Some
survivors have relocated, enrolled in college, or found
better employment. GLSPs lawyers are recognized across
the state by judges, law enforcement, shelters, domestic
violence taskforces, the State Bar of Georgia, and funders as
champions in the ght against family violence.
Recent studies on family violence have found that the provision
of legal services to family violence survivors signicantly lessens
the likelihood that an individual woman is battered.
Ms. Paulson is one of 1,006 family violence survivors who
benetted from GLSPs Statewide Family Violence Project in 2011.

Fighting for tenants rights
Ms. James went in to pay her rent for her apartment, but her landlord
refused to take the money, saying she had to vacate within 30 days,
despite the fact that she had just renewed the lease. The landlord
gave no reason why Ms. James was being kicked out. A few days
later, Ms. James came home to nd that the locks were changed and
all her personal property had been taken out of the apartment. A
dispossessory warrant was under the door. She protested to the
landlord, who told her the apartment appeared to be vacant and
said he didnt know anything about her possessions. She called
GLSP on the day her answer was due in court. Her GLSP lawyer
quickly sought an extension to le an answer then later appeared in
court for Ms. James. After a four-hour hearing, the judge dismissed
the landlords claims against Ms. James and awarded her $1,500 in
punitive damages for the loss of her property.
One of GLSPs priorities is to advocate on behalf of
families and individuals facing foreclosures or evictions.
Where no other services can help, GLSPs legal
assistance provides a safety net of protection for many
low income families on the verge of homelessness.
Ms. James is one of 330 tenants who benetted
from GLSPs legal assistance in 2011.
Serving clients in need
2011 was a challenging year, as we struggled to deal with reductions in funding, just as
many other non-prot organizations, businesses, and individuals were doing as a result of
the ongoing problems with the economy. We carefully organized our work to respond to
the most critical needs of our clients and to achieve important long-lasting results to help
people overcome the burdens of poverty. You will read here about some of those stories
and our victories for clients, despite more limited resources. And every so often, we had a
kind of miracle, such as the day in November that we learned we were to receive a cy pres
award of just under $500,000 from a class action lawsuit handled by Jimmy Hurt of Athens,
Georgia. Lawyers across the state responded with their generous contributions, so that
we ended the year with a successful And Justice for All State Bar Campaign for GLSP,
including two very successful fundraising events hosted by our State Bars Young Lawyers
Division members who raised $95,000 for GLSP. The commitment of these supporters to
the cause of justice was inspiring.
Our terric mission-driven staf rose to the challenges of advocating for justice and fairness
for our clients and with great determination helped clients secure unemployment benets,
food stamps, and health care coverage, saving them from falling through the expanding
gaps in our nations safety net. Were extraordinarily proud of the gains we achieved in
2011 for clients, both individually and by leveraging individual cases to nd solutions
to systemic barriers to our clients goals of family safety and stability, food on the table,
decent housing, access to health care, and good schools. In this Report, we tell just a few
of the stories of the obstacles Georgians face that deny them the American dream, and
how we helped them to get back on the right track.
Weve had ups and downs in years past, and what gets us all through it is the opportunity
to serve clients in need, and to open the door to justice and an opportunity for a better
life, as well as the support and condence of our dedicated volunteers and donors.

Preventing teen dating violence
Amy is a high school student who had been dating a fellow student, John,
for a few months. John mistreated and harassed Amy, sometimes even in
the school building, but she believed she was in love. One morning, John
physically harassed Amy in the back of the gymnasium during a presentation
by a GLSP lawyer on teen dating violence prevention to an assembly of 100
students and teachers. The GLSP lawyer immediately saw what was going
on between Amy and John and was able to get the attention of the schools
security guard. John was hauled out of the gym and was not allowed to
return to the assembly. After the assembly, the GLSP lawyer met with Amy
and her mother in the principals ofce. Amy opened up about Johns abuse.
She said that this was not the rst time John had harassed her, and that she
was afraid of him. The GLSP lawyer addressed the dangers facing Amy and
talked about the legal options available to her, including getting a
protective order against John. She was grateful for the information.
Since 2009, when GLSP started its Teen Dating Violence
Prevention Program, a total of 10,000 public school students,
teachers, parents, school administrators, and counselors have
benetted. GLSP is raising awareness in rural communities
and schools about the epidemic problem of teen dating
violence and the urgent need for more efective prevention
and deterrence and ofers information to students and parents
needing GLSPs legal assistance, advocacy, and support.
Communities are learning about safety and protection for teens,
and the legal protections available through the courts.
At least one in four students who have participated in GLSPs
Teen Dating Violence Prevention Program have shared that they
have been in abusive dating relationships.
A total of 8,000 public school students, teachers, parents, school
administrators, and counselors benetted from GLSPs Teen Dating
Violence Prevention Program in 2011.
Stopping Food Stamp fraud
During 2011, GLSPs advocacy resulted in the overhaul of the way Georgia pursues
Food Stamp recipients whom the State alleges committed fraud to receive benets
or used Food Stamps in an illegal way. The State had relied on computer records
of purchases based on a fraud prole rather than having any specic evidence
against individuals such as videotape or witnesses. The State deployed fraud
workers to persuade recipients to sign agreements to repay benets, often with
a threat of criminal prosecution if the recipient did not sign, even though there
was no direct evidence that the recipient had actually done anything wrong. In
addition to representing individual clients at their hearings, GLSP lawyers made
complaints to the national Food Stamp Administrator at the U.S. Department
of Agriculture about the Georgia Food Stamp program, including civil rights
violations. One complaint was that the State scheduled more than 170 hearings for
one day with one judge on Food Stamp Administrative Disqualications. A proper
hearing took at least one hour so that it was clear that the State did not anticipate
actually holding hearings. When a GLSP lawyer represented the recipients, they
won most cases. Another issue we raised related to violations of the rights of our
clients with disabilities under the Americans with Disabilities Act (ADA) during the
course of these alleged fraud prosecutions.
GLSPs advocacy has made a big diference in the States previously onerous pursuit
of people who had done nothing wrong. The U.S. Department of Agriculture
required Georgia to revise all of its forms, policies, and procedures dealing with
Food Stamp fraud and trafcking to make them comply with federal law and
regulations. These abusive alleged fraud prosecutions have essentially stopped.
GLSP provided legal assistance in 758 Food Stamp cases in 2011.
Putting food on the table is a real challenge for many low income Georgians, especially
those who were laid of during the economic downturn. GLSP lawyers work hard to
assure that those who are eligible receive the Food Stamps they need to feed their
families. GLSPs advocacy focuses especially on those who are the most vulnerable,
including seniors, people with disabilities and people who speak limited or no English.

Making afordable housing available
Like many of Georgias cities and towns, the city of Savannah has a
shortage of decent afordable housing. In fact, the city of Savannah
recently formally recognized that Savannahians pay a higher share
of their income for rent than anywhere else in Georgia, with
many paying 48% or more of their income for housing. To help
remedy that, Step Up Savannah, a unique partnership among
local businesses, government, local residents, and nonprot
organizations, took on the task of nding new ways to foster
development of more afordable housing options. GLSP lawyers
agreed to represent the group in its eforts to create a housing
trust fund for the city, and assist city ofcials by researching legal
options for establishing such a trust fund, and to draft language for
a viable fund. The Savannah City Council, recognizing that such a
fund had been recommended by local city plans and other groups
for at least ten years, voted unanimously to approve those eforts,
establishing the Savannah Afordable Housing Fund, providing
it with initial funding, and appointing an Advisory Committee to
begin implementation of the Fund. A local Savannah pro bono
attorney from Hunter McLean, Ted Henneman, has experience in
afordable housing development and has agreed to serve on the
Advisory Committee as the GLSP appointee. This is the rst housing
trust fund in Georgia outside Atlanta.
Claiming a street named King
GLSP lawyers and grassroots community leaders from the Georgia Clients
Council (GCC), a 35-year old statewide membership organization founded
in 1976 as an initiative of GLSP, are collaborating to develop Claiming A Street
Named King, a statewide community economic development project to
improve streets and throughways named in honor of civil rights leader Dr.
Martin Luther King, Jr. GCCs goal is to transform Martin Luther King streets
throughout Georgia into communities where people can be proud to live.
Claiming A Street Named King was the vision of past GCC President Terence
Dicks. The project began with research led by the University of Georgia
School of Environmental Design in collaboration with GLSP, Georgia State
Trade Association of Non-prot Developers (G-STAND), and Neighborhood
Works America, Inc. Low income communities will create viable jobs, locally-
based businesses, workforce housing, job readiness, and nancial literacy and
training programs.
Since 1994, GLSPs Community Economic Development Project
has worked to bring resources and vitality to rural grassroots
organizations, starting with the local residents who work together
to establish a common vision for their communities. GLSP ofers a
broad range of transactional legal services to qualied grassroots
organizations for which legal services are out of reach. GLSPs
involvement is critical in building up these organizations to develop
their legal structures, including their governance, operations, and
programs for the betterment of their communities. GLSP has served
more than 100 rural grassroots organizations in its history.

Paving the way for immigrant integration
More than 1,000 low income Latino families and individuals who are legal residents have benetted from
GLSPs Latino Outreach and Education Initiative (LOEI) since 2009. LOEI addresses the socio-cultural and
language barriers that prevent full access to justice and opportunities out of poverty for an estimated
743,000 low income Latino citizens and documented residents in 60 counties served by GLSPs ofces in
Albany, Dalton, Gainesville, and Savannah.
These regions are now home to the fastest growing population of Latinos in the South, many of whom are
lured by manufacturing and construction jobs, and to escape crushing poverty in their home countries. For
many, language is one of the greatest barriers they face. When they enter schools, hospitals, or courts, they
often nd theres no interpreter. Among other strategies, GLSP has developed standard motions and briefs
that support formal requests for appointment of court-certied interpreters for hearings and continues to
educate judges and court clerks on this issue.
This innovative work ofers legal assistance, education, and outreach by bi-lingual lawyers, and a statewide
Spanish Intake Program stafed by bi-lingual paralegals. GLSPs goal is to assist low income Latinos to
integrate in their communities successfully and to establish collaborations and partnerships with community
organizations that serve Latino families and individuals. Latino clients are improving their quality of life and
are increasing their access to the legal system in cases where they have been denied their basic rights to
benets and services.
Making self-sufciency pay of
As a reservist in the Air National Guard, Ms. Bennett had been given
leave from her job to attend training for her National Guard duties
several times. One day, she received orders to appear for training,
but when she submitted a request for leave, her employer denied it.
She quit her job to keep from being AWOL from the Guard and facing
jail time. When she returned from her military service, she applied
for unemployment benets but was denied because her employer
had reported that she quit for personal reasons. Ms. Bennett came
to GLSP for help and was advised that federal regulations require
employers to grant leave for militar y ser vice and prohibit any
discrimination against service members because of their obligation
to do their military duty. A GLSP lawyer represented Ms. Bennett at
her appeal hearing arguing that her employer had wrongfully forced
her to choose between her job and her duty to the National Guard.
Ms. Bennett was awarded more than $3,000 in back benefits and
$277 a week until she could nd another job.
GLSPs clients want nothing more than other working families:
the opportunity to achieve economic security. But despite their
determination and efort, many are trapped in low-wage jobs
that provide inadequate benets and ofer few opportunities for
advancement. One of GLSPs priorities is to help stabilize low
income families experiencing job loss or other nancial hardships
where loss of income is inevitable.
Ms. Bennett is one of 450 low-wage earners who
benetted from GLSPs legal assistance in 2011.

Beating the odds to succeed in school
Marcus is 10 years old and has emotional disabilities. He recently relocated to
Georgia with his mother, Ms. Peterson. Ms. Peterson enrolled Marcus in public
school, thinking he would be placed in a regular classroom and continue the
Individualized Education Program (IEP) that his former school district developed
for his special needs. Instead, Marcus was placed in a psycho-educational school
for children with severe emotional behavior disorders after the school district
learned that he had emotional behavior disorders and was previously enrolled in
a specialized school out of state. Ms. Peterson consented to the placement until
Marcus sustained bruises and other injuries while being physically restrained at
the psycho-educational facility. Ms. Peterson contacted GLSP to obtain help for
her son.
A GLSP lawyer agreed to represent Marcus for his educational needs, and
requested an IEP meeting with the school district to discuss her sons needs.
At the IEP meetings ofcials identied several speech/language and sensory
decits that were impacting Marcuss ability to participate in the classroom
and self-regulate his behavior. The IEP team agreed to remove Marcus from
the psycho-educational facility and place him in a regular school classroom
to be co-taught by a special education teacher and a regular education
teacher. The IEP team arranged for Marcus to receive speech/language and
occupational therapy services for his disabilities. With GLSPs advocacy
and support, Marcus is much happier in school, and Ms. Peterson is very
satised with his placement.
GLSPs advocacy in education cases increases educational opportunities for
children with special needs who are at-risk and often require legal assistance to
get educational services guaranteed under federal law.
Marcus is one of 77 children with special needs who
benetted from GLSPs legal assistance in 2011.

GLSPs Champions of Justice 2011
GLSPs Champions of Justice are individuals who have been selected by the GLSP Board of Directors for their signicant work to
advance the mission of GLSP, and who are respected members of their communities as leaders in the cause of justice for Georgias
poor.
Mr. A. James Elliott is a co-founder of GLSP, who in the 1970s served on the committee of the former Younger Lawyers Section
(YLS) of the State Bar that studied the need for legal services in rural Georgia, which led to the founding of GLSP in 1971. He
practiced law in Atlanta with the rm of Alston & Bird for 28 years prior to joining the faculty of Emory Law School, where he is
now Associate Dean.

Mr. R. William Ide , III chaired the former State Bar Younger Lawyers Sections Legal Aid Committee that commissioned a study
of the need for legal services for the poor outside Atlanta, which culminated in a report authored by Mr. Ide that served as the
principal argument to the State Bar to support the founding of GLSP. He is a partner in the Atlanta ofce of McKenna Long &
Aldridge.

Ms. Elizabeth Betsey Neely is a co-founder of GLSP, who in the 1970s served on the committee of the former Younger
Lawyers Section of the State Bar that studied the need for legal services in rural Georgia, and she helped to establish Georgia
Indigent Legal Services, and later, GLSP.

Ms. Rosita M. Stanley began her involvement with legal services in 1977 when she was served by GLSP. Her experience led
her to volunteer with her local program ofce in Macon, Georgia. She currently serves as vice-chair of the National Legal Aid &
Defender Association and has served as state chair of the Georgia Clients Council, and vice-chair of the GLSP Board of Directors.

Ms. Lillie Winn was the rst local chair of the Georgia Clients Council (GCC) in Wayne County in 1976, and became the regional
chair of GCC in Brunswick until 1982. She formed a Clients Council in Liberty County in 1983. She became regional chair of GCC
in Savannah in 1989, until she moved up the ranks to state chair for GCC in 1996. She started her own non prot organization a
few years ago.
