MALAYSIA: NEW TOYS SAFETY REGULATION UPDATE


On July 29th 2010, the Malaysian Government Ministry of Domestic Trade, Co-operatives and Consumerism (MDTCC) has published two Consumer Protection Regulations as below: 1. Consumer Protection (Safety Standards for Toys) (Amendment) Regulations 2010 2. Consumer Protection (Certificate of Conformance and Conformity Mark of Safety Standards) Regulations 2010.
Toys Safety Compliance must be demonstrated for: New Toys: Step 2: Declaration of New Product and Existing Product The product owner (manufacturer, importer and/or distributor/supplier who is involved in re-packaging) shall declare that the goods comply with the safety standards by issuing a Certificate of Conformance (COC) as determined by the Controller, MDTCC. The product owner and shall mark or affix the goods with the Conformity Mark.

Must be affixed with MC Mark (as declaration that they have been tested & certified as safe). This requirement is in force since August, 1st 2010.

Existing Toys (already placed on the market):

The manufacturers are required to make sure that all their existing toys comply with both of the above regulations starting from 1st of February 2011 (A six-month extension period has been granted for toys already placed on the market).

Before January 1st 2012, MC Mark is not compulsory for existing toys. But it is allowed to affix the conformity mark on existing toys which comes with test report from any laboratory.Starting from January 1st 2012, MC Mark issued by the MDTCC will become compulsory for existing toys.

HOW TO DECLARE? Step 1: Registration of business activity prior to declaration The product owner (manufacturer, importer and/or distributor/supplier who is involved in re-packaging) shall declare their business activities by filling up Annex D (Form of Registration of business activities Safety Standard for Toy). A registration number shall be assigned to the product owner upon registration. This number shall be printed on the toy or its packaging together with of the MC mark.

CERTIFICATE OF CONFORMANCE (COC) PROCESS FLOW 1 The products must be tested by an accredited laboratory or approved laboratory by the Controller, MDTCC. 2 Once the product complies with the Safety Standard; the product owner must issue a COC (Annex C) according to format prescribed by the MDTCC 3 2 copies of duly filled and signed COC declarations must be submitted to MDTCC for approval; MDTCC shall assign a reference number for each COC application. 4 The product owner must keep a copy of the COC (including records or documents related to the specification of the goods and its compliance with the standards.) Another copy will be kept by the Controller, MDTCC. 5 Upon request, provide the Controller with the said COC, records or documents.

MARKING OR AFFIXING OF CONFORMITY MARK OR PARTICULARS ON GOODS, ETC. 1 The toy or its packaging must be marked with the Conformity Mark ( 2 3 4 ), together with the registration number (business activities

registration number) issued by MDTCC. The toy or its packaging must be marked with the name and address of the manufacturer, importer or distributor. The minimum size of the Conformity Mark should be 5 mm x 5 mm. The toy or its packaging must be marked with applicable warnings and cautionary information when necessary in Bahasa Malaysia or/and English language. Other languages may also be used as appropriate.
