The object of the complaint is to quiet title and extinguish the Defendants oil and gas rights in the following described real estate: Situated in the Township of Jackson, County of Monroe, and State of Ohio, and being a part of the southeast quarter of Section 35, Township 1N, Range 4W, of the Old Seven Ranges Survey and being more particularly described as follows; Commencing at an iron pin found capped McFarland 6221 at the northwest corner of the northeast quarter of the southeast quarter of Section 35, this being the TRUE POINT OF BEGINNING; thence N 00 53 00 W with the land of Glen and Kathy Schwaben as recorded in Official Records Book 12, Page 553, a distance of 604.75 feet to a point in the center of SR 800 (passing on line an iron pin found uncapped at a distance of 564.06 feet); thence with the center of said road the following two courses: 1. (as Lessee) (the Lease), and memorialized by a memorandum of lease dated Sept. 15, 2011, and filed for record in Vol. 211, Page 244 of the Monroe County, Ohio, Recorders Office (the Memorandum), will be forfeited. Ullom, dated Sept. 11, 1900, filed Feb. 16, 1901, and recorded in Vol. 58, Page 492 of the Deed Records of Monroe County, Ohio. There have been no further transfers or recorded transactions of this severed oil and gas interest. With respect to Tract I, a severed oil and gas mineral interest was reserved in the Quit Claim Deed (1/4 interest) from O. Rosa McCammon to W.R. Ullom dated Aug. 15, 1900, filed Feb. 16, 1901, and recorded in Vol. 58, Page 493 of the Deed of Monroe Records County, Ohio. O. Rosa McCammon died March 29, 1915, leaving Ada L. McCammon, C. Harold McCammon, and David R. McCammon as her sole heirs and next of kin. There was no mention of this severed oil and gas interest in her estate and there have been no further transfers or recorded transactions of this several oil and gas interest by anyone. With respect to Tract I, a severed oil and gas mineral interest was reserved in the Quit Claim Deed from Stephen Brown, Jacob Brown, William Brown, Geuler Edgar, Samuel Edgar, Mollie Stephens and Robert Stephens to W.R. There have been no further transfers or recorded transactions of this severed oil and gas interest. With respect to Tract II, a severed oil and gas mineral interest was reserved in the Warranty Deed from John M. Dent and Oleta O. Dent to N.A. Vanwy and S.E. Vanwy dated Sept. 1, 1920, filed Sept. 1, 1920, and recorded in Vol. 89, Page 487 of the Deed Records of Monroe County, Ohio. There have been no further transfers or recorded transactions of this severed oil and gas interest. The present owner of this property is Mildred C. Fliehman, Trustee of the Glenn E. and Mildred C. Fliehman Living Trust dated Dec. 30, 1996, having acquired title by virtue of the deed dated Dec. 30, 1996, filed Jan. 8, 1997, and recorded in Vol. 28, Page 620 of the Records of Official Monroe County, Ohio, and the Affidavit dated Aug. 22, 2000, filed Aug. 29, 2000, and recorded in Vol. 66, Page 68 of the Official Records of Monroe County, Ohio. Mollie K. Conley is the Successor Trustee of this Trust. These interests are considered abandoned because (1) there has been no production or withdrawal of minerals by the holders of the above oil and gas interest for the preceding twenty years; (2) the said oil and gas interest has not been the subject of title transactions filed or recorded in the Monroe County Recorders Office within the last twenty years; (3) there have been no underground gas storage operations on said property for the preceding twenty years; (4) there have been no drilling or mining permits issued to the holders of the oil and gas interest for the preceding twenty years; (5) no claims to preserve this interest have been filed within the preceding twenty (20) years; and (6) there is no separately listed tax parcel number created for the said severed mineral interest in the Monroe County Auditors tax list and the Monroe County Treasurers tax list.
