COMPLAINT
The Complainant, being duly sworn, makes complaint to the above-named Court and states that there is probable cause to believe that the Defendant committed the following offense(s). The complainant states that the following facts establish PROBABLE CAUSE:
COMPLAINANT, Mack Dominquez, is an Officer with the Minneapolis Police Department, and in that capacity has investigated the facts and circumstances of this case by reviewing the reports of other officers, and believes the following establishes probable cause: That on January 12, 2011, Minneapolis police officers were working plainclothes in an unmarked squad stopped at the red light going eastbound on East Lake Street and 1st Avenue located in Minneapolis, Hennepin County, Minnesota, when they observed a driver, EDMUND LONG, Defendant herein, the driver and single occupant of a vehicle with Minnesota license plate 825BRK. traveling eastbound on Lake Street from 1st Ave. South, playing amplified music with foul language in violation of the city ordinance. Defendant looked at the female plainclothes officer who shook her head No to the music. Defendant was then observed by the female officer to reach downward and bring a very small suspected marijuana cigarette up to his lips, taking a drag off of it, holding the smoke and then exhaling. The female officer, who was about four feet away and whose window was next to Defendant while they were stopped in traffic, believed Defendant was smoking marijuana because the joint/cigarette appeared all white, wrinkled (Zig Zag type paper) and it was only about a half inch long (so short the index finger and thumb almost covered the whole joint). Officer J. Bartholomew and Officer C. Kelly, working in full uniform, assisted in stopping the vehicle eastbound on 28th Street. While approaching, Officer C. Kelly saw Defendant making furtive movements by moving around as if he was trying to conceal something. Officer C. Kelly opened the door and could smell a strong odor of suspected marijuana. Officer C. Kelly had Defendant exit the vehicle and was cuffed. Defendant advised that he was smoking a blunt and that was the reason for the strong smell of marijuana coming from the vehicle. Defendant was asked if he had any more narcotics on his person and Defendant responded that he thought he had some in his right pocket. Two

baggies with remnants of suspected marijuana and another baggie with 2 pills that Defendant identified as Percocet were recovered from Defendants pocket. These pills were not in a prescription bottle and Defendant could not say which doctor gave him a prescription or what clinic he acquired the drugs from. Defendant was in possession of $698.11 in cash, mostly in denominations consistent with drug trafficking. Defendant had two outstanding warrants from Hennepin County and did not have a valid D.L., nor was the vehicle registered to Defendant. Officer C. Kelley was able to identify the pills as Hydrocodone. Defendant is currently in custody. OFFENSE COUNT 1: CONTROLLED SUBSTANCE CRIME FIFTH DEGREE-POSSESSION (FELONY) MINN. STAT. 152.025, SUBD.2(a)(1); 609.101, SUBD. 3; 152.01, SUBD. 16a PENALTY: 0-5 YEARS AND/OR $3,000-$10,000
That on or about January 12, 2011, in Hennepin County, Minnesota, EDMUND LONG unlawfully possessed one or more mixtures containing a Schedule I, II, III, or IV controlled substance, to-wit: Hydrocodone.
NOTICE: You must appear for every court hearing on this charge. A failure to appear for court on this charge is a criminal offense and may be punished as provided in Minn. Stat. 609.49. THEREFORE, Complainant requests that said Defendant, subject to bail or conditions of release be: (1) arrested or that other lawful steps be taken to obtain defendants appearance in court; or (2) detained, if already in custody, pending further proceedings; and that said Defendant otherwise be dealt with according to law.
