On 11-09-01 at approx. 0900 hours I responded 10495 Main Sireet (superior court) for the report of a petty thefU destruction of court documents. Upon arrival I contacted Smith who was the reporting party. He stated that he wanted to make a petty theft report against a Bailiff at the courthouse for throwing away some court documents that he had faxed to the court on 11-02-01 requesting an appeal of a case. He also said that he was threatened by a deputy in October of 2000 while at the courthouse. According to Smith a Bailiff took him out of a courtroom and told him that if he had a problem that he would take care of it. Apparently this statement was made while the Bailiff had his hand on his holstered weapon. Smith stated that Davenport was aware of the situation. I contacted Davenport in her office. She stated that the court did receive faxes form Smith but they were not official court documents. She added that court documents can not be filed via fax. Davenport said that the papers that were sent to the court were somewhat threatening statements from Smith. The faxes were given to a Bailiff and he threw them away. Based on the statements that I received I told Smith that no crime had occurred because when he faxed the paperwork to the cour.~the message became the property of the court. Furthermore I told Smith thaUf he has a problem with the way that the employees at the courthouse do business he needs to contact their supervisor. CASE STATUS: CLOSED, INFORMATION ONLY
