AGREEMENT FOR HIRE OF THE KENYA CONSERVATOIRE OF MUSIC BALLET STUDIO - TERMS AND CONDITIONS

(In alphabetical order for ease of reference) ACCESS 1. It is the responsibility of the Hirer to ensure that all external doors to the Studio and the foyer are kept unlocked during rehearsals and performances. 2. All fire exits must remain clear at all times. AREAS OF HIRE 3. The Hirer should note that the areas of hire are limited to the Ballet Studio, Toilet Facilities and Balcony Areas 4. The Hirer has no right of access to any other part of the buildings or grounds except ancillary facilities such as the car park and toilets. Please note that the Car Park is managed by KAPS and parking fees will be charged. AUDIO EQUIPMENT 5. The Hirer may use his own audio source devices. These must be correctly wired, in safe condition. BOOKINGS AND CONFIRMATIONS 6. Acceptance of bookings is at the sole discretion of The Kenya Conservatoire of Music. 7. Bookings will not be confirmed until 100% of the total fee has been paid. 8. CAPACITY 9. The Conservatoire Ballet Studio can host up to 150 people at a time. CAR PARKING FACILITIES 10. Car parking facilities are available within the National Theatre Annex at the owners risk. 11. The Car park is managed by KAPS and a Parking Fee WILL be charged. 12. All visitors are required to comply with the car park rules. COMPLIANCE WITH THE LAW 13. The Hirer shall ensure that the content of any stage play, musical, recital or any other style performance conforms to the requirements of the appropriate Kenyan Authorities. 14. The management of The Kenya Conservatoire of Music can accept no responsibility for the failure of the Hirer to comply with the legal and civic requirements. DAMAGE AND FIRE RISK 15. The Hirer shall, at all times, avoid situations likely to cause damage to the fabric, furnishings fittings of the Studio. 16. There are to be no naked flames on stage or anywhere else in the Ballet Studio. 17. If any damage is caused by audience, cast, front of house or backstage crews brought in by the Hirer to any of the areas of hire for any reason whatsoever, the Hirer shall be liable for repair or replacement costs, to be deducted from the refundable deposit paid by the Hirer upon booking confirmation. 18. By signing this agreement the Hirer undertakes to indemnify The Kenya Conservatoire of Music for any such loss and / or damage. DISORDERLY CONDUCT 19. The Hirer shall not permit disorderly behavior by the audience, cast, front of house or backstage crews.

20. The Hirer is expected to keep noise and disturbance down to a reasonable level or as may be requested by The Kenya Conservatoire of Music Management.

EXCLUSION OF LIABILITY 21. The Kenya Conservatoire of Music accepts no liability for accidents to cast, stage crew or visitors . 22. The Kenya Conservatoire of Music accepts no liability for consequences of power cuts. 23. The Kenya Conservatoire of Music accepts no liability for interruptions of telephone service. 24. The Kenya Conservatoire of Music accepts no liability for any loss of, theft of, or damage to any property belonging to the Hirer, his representatives or users of the Ballet Studio while on the premises of The Kenya Conservatoire of Music. 25. If the Management of The Kenya Conservatoire of Music is forced to withdraw from this agreement due to circumstances beyond their control, The Kenya Conservatoire of Music shall not be held liable for any damages 26. The Management of The Kenya Conservatoire of Music reserves the right to withdraw from this agreement without penalty and to deny the Hirer the use of the Studio should any of the conditions in this agreement be unfulfilled. 27. The Management of The Kenya Conservatoire of Music further reserves the right to curtail, without penalty, the run of any performance or event should that performance or event be of inadequate standard or offensive in content. HIRE PERIODS 28. The Kenya Conservatoire of Music requires that the hire periods stipulated in this contract are adhered to so as to prevent inconvenience to other hirers/users of the premises. PAYMENTS 29. Payments must be made by cash to cheques written out to THE KENYA CONSERVATOIRE OF MUSIC. 30. The Hirer agrees to pay the hire fees BEFORE the use of the studio begins. 31. REMOVAL OF PROPERTY AFTER PERFORMANCES 32. All property of the Hirer must be removed from the premises immediately after the final performance. 33. All property found on the premises 24 hours after the end of any hire period may be disposed of by The Kenya Conservatoire of Music officials as they deem fit. RESPONSIBILITIES OF THE KENYA CONSERVATOIRE OF MUSIC 34. The Management of The Kenya Conservatoire of Music shall ensure that the areas of hire and ancillary facilities are available for the use of the Hirer during the agreed period of the hire. SMOKING 35. The Hirer shall ensure that there is no smoking in any of the areas of hire.

TERMS AND CONDITIONS OF THE ATTACHED BALLET STUDIO HIRE AGREEMENT IN BRIEF

WHAT WE PROVIDE We provide the Ballet Studio, Toilet Facilities and Balcony areas only for hire.

WHAT IS NOT ALLOWED Playing or moving the Conservatoire piano or any instrument found within the premises is not allowed unless the agreement is for a concert and permission has been given. Any repairs or necessary retuning will be charged to the Hirer. If you need any equipment moved, please let the office know so that they can call the caretaker to do it. Please do not move any equipment yourself. We do not allow food or drinks to be taken into the Studio. Disorderly behaviour and excessive noise from the participants is not allowed. Naked flames and pyrotechnics in the studio and its environs are not allowed. No more than 150 people will be allowed in the Ballet Studio at a time. It is absolutely forbidden to put nails, screws, staples, pins or other fixing devices in the studio, its surrounds, walls, floor or any other surface within the ancillary areas specified in this agreement. Smoking is prohibited in any of the areas of hire.

This agreement is accompanied by 100% fees for all the booked sessions above, being Ksh. __________/- (at Ksh.2,000/- per hour) and Ksh.10,000/- being the refundable deposit (less the cost of any damages caused by us to the property of The Kenya Conservatoire of Music). We undertake to pay the entire amount BEFORE beginning to use the premises. If any damage arises during the tenure of this contract, directly in consequence of misuse by the cast/crew, in excess of the paid deposit, we hereby commit to pay the excess amount for any such damage. We commit to leaving the Ballet Studio in the same condition that we found it.
