TO DEFENDANTS AND THEIR COUNSEL OF RECORD: NOTICE IS HEREBY GIVEN that on November 30, 2012 at 10:00 a.m. or as soon thereafter as this matter may be heard, in Courtroom 3, on the 15th Floor of the above-entitled court located at 501 I Street, Sacramento, California 95814, Plaintiffs will and hereby do move for an Order granting A Preliminary Injunction pursuant to Fed. R. Civ. P. 7 and 65 and E.D. Cal. L.R. 231. This Motion is based upon this Notice of Motion and Motion, the Memorandum of Points and Authorities, the Declarations filed concurrently herewith, the pleadings on file in this action, all matters of which judicial notice may be taken, the Court's files, and such other oral and written evidence and argument as may be presented at or before the hearing or otherwise properly come before the Court. Based upon the facts contained in the attached Declarations and the Memorandum of Points and Authorities filed simultaneously herewith, Plaintiffs respectfully request that the Court enter a preliminary injunction enjoining Defendants, their agents, servants and employees and those acting in active concert and with actual notice thereof, from enforcing SB 1172, which prohibits Plaintiffs from engaging in sexual orientation change efforts (SOCE) counseling, from receiving information and counseling willfully consented to by all parties, and from exercising their constitutionally protected rights to direct the upbringing and education of their children.\ Plaintiffs also request this Court issue a preliminary injunction enjoining Defendants from acting in such a manner as to violate the Plaintiffs rights to Freedom of Speech and Free Exercise of Religion, guaranteed under the First and Fourteenth Amendments to the United States Constitution, and for such other and further relief to which they may be entitled.
