Between 9:30pm and 9:45pm, the promotion of violence toward men who have sex with men (MSM) contained in the lyrics "boom bye bye inna (edit) bwoy head", despite the American lobby groups chiding the Jamaican Dancehall artists for their intolerance to the homosexuality subject matter and the imminent austerity measures Jamaicans suffered i.e., being barred from performing in the U.S.; (2). Between 9:45pm and 10:00pm, the graphic and obscene elements therein and promotion of violence toward men who have sex with men (MSM) contained in the lyrics "from dem a par inna chi-chi man cyar blaze di fire mek wi bun dem"; (3). At 10:03pm, the graphic and obscene term "pussy tight" from the song "Romping Shop" performed by Vybz Kartel & Spice was transmitted in an obviously uncensored format DESPITE [it] being banned from broadcast television and radio by virtue of the prohibition enumerated in the Commission's 2009 Directives. Let me make it absolutely clear that this program was intended to EDUCATE however, the fact that material which promoted violence against a minority group (Gays) were embedded then the message was skewed and offends against good taste and morals and goes against community standards. (3). ''I lick 'em and freak 'em (if they married I see) ya.'' Live editing employed here (...). (4). ''You can feel on it if you really want to, get a taste of the (salami)...'' Live editing employed here (...). (5). ''Bust in you like atomi-ee'' and ''...gettin' HEAD in the jag.'' NB. The intro to the record "Lighters Up" performed by Lil Kim was used as the live editing mechanism by the DJ. Now, in the version I supplied, the lyrics state: (1). ''...we can just cuddle up, and if you don't wanna cuddle up then baby we can make love.'' (2). ''They take me and MAKE ME and make me they victim.'' (3). ''I list 'em and teach 'em if they married I see ya.'' (4). ''You can jump on me if you really want to, dressed in my money (5). ''Let me meet your mommy'' and ''...having a blast.'' Not only was this version of the record that ZIP FM aired NOT suitable for (airplay) transmission at any time due to its obscene content, but it also breached the Childrens' Programming Code and the Television & Sound Broadcasting Regulations, which stipulate that explicit and obscene material should not be broadcast, time of day scheduling requirements and that "live-editing'' to obscure objectionable material causes an infringement of said directives. DJ Liquid is on suspension indefinitely and deserves to remain off the public airwaves PERMANENTLY for the airing the record "Quickie'' performed by Miguel. As much as that record in its original format contains sexual discussions and material not suitable for children, which was further fueled by his untoward and predictable remarks promoting sex, about ladies not wanting ''quickie'' all the time, it was not entirely appealing to the prurient interest such as the graphic material outlined in this record by DJ Chrome. Like the operators of FLOW who sponsored the program, I most certainly can't wait to see what the Broadcasting Commission's ruling will be in light of this particular incident. Regards, Delano

Promotion of violence, glorifying the gun and offense against the person:"Weh dem a do weh dem a try, marrow wi fly into di sky, GUN mi nuh barrow mi money buy, a bwoie wi cry" from the song "Weh Dem A Do" performed by Mavado, (10:02pm) N.B. One way for someone's [brain] marrow to "fly" is by the use of a gun to the head as is obviously depicted here; Graphic lyrics and sexual references:"None a my friend dem nuh bow fi nuh money" - by an unidentified artist (Possibly Sizzla or Capleton) (10:04pm) Reference to oral sex is made here. This material was also transmitted on Thursday 3/8/12 between 1:05pm & 1:10pm, in the middle of the day when there's a reasonable chance that children are home from school and make up the audience impressions. We are all aware that the 2009 Directives, the Television and Sound Broadcasting Regulations and the Children's Code prohibit the promotion of violence and glorification of the gun and graphic language from broadcast at any time. As it regards any other lyric site research, I would like you to consider the fact that some websites edit the lyrics for 13 year olds. I wouldn't expect that someone would be using edited lyrics to confirm profanity in a record. That is why I referred you to Metrolyrics. You are very much urged however to pick choose and refuse any one of the following non-biased sites to confirm that the F-word is indeed present and my complaint remains incontestable. The presence of ther F-word can be heard at the 10th second mark from the recording as I previously indicated and remain so. I used Metrolyrics as reference as that is the website that the record pools "Promo Only", "DJ City" and "Radio Express" utilizes when they are performing in-house editing and tweaks before records are sent to radio programmers in the United States. Let me assure you that there was no bias whatsoever to this website since it is the most accurate and trusted when compared to other sites. Up until this event, I have not heard any television or radio stations in Jamaica air this version because obviously there is a version already formatted for television and radio where the term "gum" which references the vagina texture is replaced by instrumentals and which they're making use of. In spite of this formatted version, DJ Liquid felt that he can overlook the provisions of the Time of Day Scheduling and Children's Programming Code with his slackness over the publicly-owned airways. Note also how the DJ used SFX immediately after the fact. These lyrics were taken from the record "Freek A Leek" performed by Petey Pablo released by CMG Music Group in 11/2003 for American Urban and Club radios. Before the end of the day, I will be sending the sub-standard transmitted content by ZIP FM and the original edited version from the record label (I have in my library) so that the clear distinction of the absence of the graphic term can be made. Broadcasting Commission, The following obscene content was transmitted over the publicly-owned airways by the licensee ZIP FM via DJ Bambino: "A my fault a my fault cause me know me good, beat me chest because me take weh you WOOD... ...a yah suh nice, soft and jelly and warm and right" By virtue of the term "take weh you wood", it is explicitly stating that the penis of another woman's man was acquired by her (Tifa) and that of course her good (vagina) is soft, jelly and warm".! I am dumb-founded to understand that the writers and producers of this song would've thought that the term "wood", which references the penis, would be more euphemistic than "hood", which is the Jamaican vernacular, again, for penis. I urge that the Commission take the appropriate actions against the operators of ZIP 103 FM, in respect of the provisions of the Children's Programming Code and the Television & Sound Broadcasting Regulations and [other] public decency standards and in support of all the advertising entities blindcopied to this communication. Broadcasting Commission: At 9:25pm on 6/5/12, the operators of ZIP FM caused the following lyrics promoting violence and glorifying the gun, over the publicly-owned airways: The term "CLAP" (bullet) - "what happened to that boy? He was talking (edit) we put a clap into that boy". The artist was referring to shooting someone because of something unfavorable that was said. Since the digital* channel MTV Hits is not available on satellite systems but only to some cable operators in America - Comcast Cable Communications and most recently Time Warner Cable, then I had no choice but to subscribe to a local cable company that makes these channels available to me in Jamaica. The obvious choice was Flow. My issue is not with Flow offering these digital channels, because I have spoken with MTV and they informed me that they have given the cable operator limited rights to re-transmit by way of contracts, in other words it's a legal transmission. The issue is that I have noted on several occasions, where Flow advertises local content on these American channels which violates the copyright agreement with MTV. In 2009, I contacted Flow about this nuisance, where they found it appropriate to air their local crap, i.e., community notice board events and local advertisements. The representative of the company at that time indicated to me that the Broadcasting Commission gave them permission to carry out that act. Whenever there is a music video being aired on BET, MTV or a program on Nickelodeon, Flow abruptly inserts one of their annoying ADs which are often at high and disturbing volumes. This is unprecedented, as I have never in my days seen a cable operator advertise their crap (and they can't) while a program is running or during a scheduled commercial break on a network channel. It was bad enough that they air their local content during the scheduled commercial breaks by these channels; it is another nuisance for them to air same while programs are actually running. Obviously, Flow has a community channel, therefore, any information that they feel is important to convey to viewers, then it should be placed on their notice board. What they did and what the Broadcasting Commission authorized was despicable.
First of all, the Broadcasting Commission is NOT the rights holder for Viacom channels or any American works for that matter, nor is it otherwise jurisdictional for the Commission to offer such an unlawful directive. Secondly, no competent regulator, let alone no one in their right mind would dare to offer nontransferable and extraterritorial rights to a cable operator, giving them permission to cause a nuisance to viewers by way of advertising on American content. I contacted Deborah Robinson about these incidents in June, 2011 and she has conducted an investigation. I never followed up with her as to what she had directed Flow to do, but I now get to understand - was just advised, that the cable operator has started being a nuisance to their subscribers again, by erroneously and ILLEGALLY transmitting local content over US cable channels and programming. I will be speaking with Deborah this afternoon and will ascertain what came out of the investigations and inform her that Flow continues to cause infringement on content protection. In the meantime, I urge that this foolishness and whatever extraterritorial rights that the Broadcasting Commission thought they had in giving Flow the permission to carry out such an act, to desist and simultaneously direct Flow to immediately desist from causing a nuisance to subscribers of the MTV Networks and ALL other US cable channels that this may be carried out on. Regards, Delano * All American networks have upgraded their facilities to and transmits digital signals, which means that superior audio and video and virtually no interference can be experienced. Digital in the context of this statement refers to the computer automation of programing of MTV HITS, MTV JAMS and VH1 SOUL. These channels are operated by the computer where the programer(s) load music video clips, advertisements etc., as part of scheduling, that refreshes its playlist three times per day, every eight hours commencing at 6:00am every day. The material contained ongoing sexual discussions and themes that were ONLY appropriate for mature audiences over 18 years old and included sexual positions, role-playing and [other] bedroom innuendos; Overtones, adult content and depictions of sex which lacked literary value and appealed to the prurient interest of any healthy male or female viewer were also the subject of the material. Since there are provisions already in place for the broadcast of mature content by licensees that utilize the publicly-owned airwaves - between 9:00pm and 5:00am, then this is a direct violation of the Time of Day Scheduling Requirements of the Children's Programing Code and community broadcast standards. Please also note that the operators of CVM TV slapping a "PG" rating on screen made them no less liable for the offense. In fact, the material contained therein was so mature that it warranted a rating of NO LESS than a "TV-MA" (for mature audiences only) or the Jamaican equivalent of "PG-16." Impressionable viewers, particularly children, were most likely a part of the audience impressions during that period, based on the time, and were obviously exposed to the inappropriate content.Kindly investigate with a view to remedial actions.
