On October 29, 2012, certain non-parties (Edwin Blesch, Timothy Smulian, Frances Herbert, Takako Ueda, Santiago Ortiz, Pablo Garcia, Kelli Ryan, Lucy Truman, Heather Morgan, and Maria del Mar Verdugo) filed a motion for notice pursuant to Rule 23(D)(1)(B) of the Federal Rules of Civil Procedure. Dkt. Nos. 69, 70. Defendants take no position with respect to that motion. Defendants note, however, that although the non-parties seek notice of a potential future hearing on the issue of class certification, the only hearing on class certification of which Defendants are aware is the hearing currently scheduled for November 20, 2012.1
