Darlings, I am so sorry for skipping out on you last month, but I was on a little excursion through Yellowstone. Cornflowers, I was so awestruck by the park that I was rendered speechless. Fortunately, I recovered, and Im rather embarrassed to tell you that this was my first visit to Old Faithful. (Spank me for not taking advantage of more of Americas treasures, our National Parks.) We had a day in Jackson, Wyoming, trying to view the Grand Tetons through a smoky forest-fire haze, then it was on to our base camp, a friends cabin on the Gallatin River in Big Sky, Montana. Each day, instead of lolling around on the cabins sunny deck, we drove, walked, and hiked through as many of the 2,219,789 acres of Yellowstone as possible. (Only extreme athletes could have done better.) We spent a day in Bozeman and thought about enrolling in some classes at Montana State because the students looked so outdoorsy, but instead opted for lunch at Teds Montana Grill, one of those restaurants started by the great activist and environmentalist Ted Turner. My food was delicious, even though I forgot to have a bison burger. One thing is certain: a week is not enough time in Yellowstone. Another thing is uncertain and disconcerting. Yellowstone is actually a massive caldera of a super volcano. Cataclysmic eruptions have historically occurred every 600,000 to 800,000 years. The last one was 640,000 years ago, with an eruption 1,000 times larger than the 1980 eruption of Mt. Saint Helens. The thermal energy released from St. Helens was equal to 1,600 times the size of the atomic bomb dropped on Hiroshima. Without getting too dramatic about this, Butterbeans, I ask you to do the math. Seriously, I dont want to sound like Chicken Little, but the sky could be falling any day now (after all, its already been 6,400 centuries), and I dont know of a hiding place. So I got as far away as I could, and I came to Florida. Just to be on the safe side. (Even though chances are I may not be able to stay
here long enough for the next eruption). I rented a house in The Villages, a place that has intrigued me ever since one of the residents (with a great tan) told me that 365 evenings a year they have live music and dancing at the town squares. Thats what they call them down here: squares, not plazas. I had to experience this for myself much to the dismay of many of my friends who think (rightly so, of course) that Santa Fe is paradise and theres really no need to go someplace where its so humid that it causes a person to perspire. (Just the other night, Lovebugs, I sweatingly slipped right through this guys arms as he tried twirling me around the dance floor.) But here I am, anyway, despite the long drive to get here and the high humidity after arriving. Within 48 hours, I made a Santa Fe connection, which once again proves how small the world really is. Al Cotoia (from Rhode Island and a resident here for the last 6+ years), when he saw my NM license plate, said, New Mexico! I have a nephew who lives in Santa Fe. He went out there from Rhode Island 45 years ago to go to college, the College of Santa Fe, or something like that, and he never came back. Loves it. Thats John Cotoia, CSF graduate and previous owner of Chateau Construction (now owned by Arthur Seligman). John retired from the building business in 2000. Pumpkins, was he smart or was he psychic? Either way, he was too young for assisted living (after all, he was only 50). After a year of getting a little bored playing golf, he took up driving a taxi for Capital City Cab. So, if you get John the next time you call for a cab to take you to the Santa Fe Airport, you might also be able to get some good advice on remodeling the crumbling adobe you bought for an exorbitant price because of its location, location, location. While Im down here dancing and drinking, going to classes in water aerobics, yoga, qigong, pilates, NIA, low-impact strength and toning, BS zumba (Cupcakes, if I do all that, Ill be unrecognizable next time you see me), Ill be missing some of my favorite events in Santa Fe. Ive already missed the

Santa Fe Concorso Rare Car Event (Sept. 28-30), held this year at Las Campanas. I especially wanted to be there on Sunday when the classic cars and motorcycles were displayed on the 9th fairway. Rey Post (associate broker at Sothebys) hosted a special two-hour remote broadcast of his All Things Real Estate radio show from The Club at Las Campanas, and since I forgot to stream it via SantaFe.com, Rey emailed the video to me, so I got to see his interview with race car legends Denise McCluggage and Sir Stirling Moss. Rey is an excellent interviewer, so if youve never before listened to his show, put that on your to-do list. Next, Ill be missing the Church of the Holy Faiths 130th annual St. Nicholas Christmas Bazaar coming up on Dec. 1. It started out in 1879 when the senior warden needed help raising $250 to build an entire addition to the church! Now the money goes to support nonprofits in Northern New Mexico. Kittens, the bazaar is where I always buy my Christmas presents and all the homemade sweets that Im too lazy to bake myself. Heres a hot tip for you (straight from a tireless volunteer of this event, my sister, Judy): for $10 you can get into a sneak preview to purchase things in the Twice Blessed (gently used items) section from 4:30-7:30 on 11/29. Do it. For Kitchen Angels, Santa Fe Girls Club, Homeless Shelter, and more. Lastly (whew!), dont forget to do two things. One, watch the funny/serious documentary Electoral Dysfunction hosted by Mo Rocca and aired by PBS on 11/5. Two, vote on 11/6. So long, Sweetpeas. modest increase in price, $464,000 up from $448,000 last year. New listings here increased 1.3 percent to 12 months of supply. The area of Old Las Vegas Highway had a 3.4 percent increase in price to $385,250 with 22 homes selling. Highway 285 saw a 10 percent increase in sales price to $430,000 with an 8 percent increase in sales over 2011. Inventory here hovers at 18 months. Lets look at the areas with the largest declines in sales price. Sales increased in the Tesuque and northeast county year-to-date, but the price fell 17 percent to $575,000. The southwest county along Highway 14 had a 21 percent decline in sales price to $220,000 and inventory here still runs almost 14 months. Pecos had a 28 percent decline over last year with the median sales price at $172,000. Inventory here exceeds 26 months. Northwest county had a 12 percent drop in price from $637,500 in 2011 to $559,500 but inventory has decreased from 185 homes for sale to 113.
Eldorado had a 6 percent decrease in sales price over last year, from $319,000 to $299,000, with inventory levels running just over seven months. The city limits northeast median sales price dropped from $556,200 in 2011 to $525,000. Inventory here is just over a year with approximately 203 properties for sale. The Rancho Viejo area experienced a drop in selling price from $295,000 for 2011 to $275,000. Inventory levels here are at fiveyear lows with roughly 54 homes for sale. The Airport/Agua Fria neighborhoods also fell 6 percent with the median selling price $173,500. Inventory here is just a 7 months supply. A few areas stayed about the same: the city limits southeast had a 1 percent decline in selling price to $390,000 with over 11 months of inventory. The southwest city limits median selling price of $205,000 is down from $208,000 in 2011 with over nine months of supply. And lastly, the Las Campanas area had relatively no change in the median sales price at $857,500 but the inventory of homes

shrank to just over 14 months. While prices are still sliding in certain neighborhoods, the continued decline in inventory is the best indicator we have that the housing market is on the rebound. Recycled memories
One of the nicest things about being a gardener is that we can make something grow when it seems everything around us is struggling to survive. Being immersed in a season of less sunshine and an economy whose fate hinges upon an upcoming election, we know our passion for playing in the dirt is what sustains us through lifes uncertainties. If you are like most gardeners, you started out with an opulent vision for your flower beds but ended up with a slightly different version, one that consists of volunteers and adopted varieties. While not part of the plan, you know your oath to care and make it grow was larger than your possible disdain for the plant. Perhaps gardeners are like animal rescuers: we see a stray and just cant turn our backs. Richard Balthazar knows this better than anyone. His former recycled plant business, Babylon Gardens, was a fixture at the Santa Fe Farmers Market for years. But after a downturn in the economy, Balthazar had to close his greenhouse doors this past June, leaving the business of plant rescue up to nature and man, which often leads to the dump, or even worse, the hands of neglectful plant owners. Balthazar started his botanical rescue mission 15 years ago when he became known as the go-to guy for unwanted plants, usually due to someone moving. He saw an opportunity to recycle the plants; after all, says Balthazar, We rescue unwanted animals and children, why not plants too? Enjoying his status as the ASPCA guy for plants, Balthazar also enjoyed several successful seasons at the Farmers Market at the Santa Fe Railyard. He received nicknames like Iris Guy and Plant Man, monikers he says he misses hearing to this day. The idea to call his business Babylon Gardens came from his love of the Hanging Gardens of Babylon, one of the seven wonders of the ancient world, even though it may have been a legend. Legend or not, Balthazar wanted to recreate that famous image where plants of all kinds drape from structures and buildings. He came close with his own version after designing his greenhouse and garden out of recycled materials like street concrete and local wood. It seems he has a knack for giving things another chance, but after his business ended, he is curious if the concept of plant recycling will ever come back. He believes the Farmers Markets change of venue coupled with an unstable economy led to the demise of his business. Regardless of why, Balthazars memories of his adopt-a-used-plant days will always be with him, and he deeply misses interacting with his customers and vendors. On his last day, he made a Going Out of Business sign and brought all of his plants to the market, giving them away for free. In a small donation box next to the sign, he said people gave him over $320.

market conditions such as rising prices, the presence of multi-bidding, and low inventory. Appraised values are very inconsistent and fluctuate widely. Out-of-town appraisers, who are not familiar with the area or local market conditions, are being used. Turnaround time by both appraisers and banks is slow, which delays closings. A large concern is that some appraisers working for an appraisal management company (AMC) are operating under strict and limited parameters due to bank lending criteria, which appear to be related to banking regulations or risk aversion on the part of the lender. Furthermore, unreasonable put back risks imposed by Fannie Mae and Freddie Mac could also cause banks to set unrealistic requirements for appraisers. NAR has long advocated an independent appraisal process and enhanced education requirements that allow appraisers to produce the most accurate reports possible. However, appraisers have faced
undue pressure whether from a lender or an AMC to complete appraisals using distressed sales as comps, to complete them in unacceptably short timeframes, and to complete scopes of work that are not justified by the fee being offered. These are major problems. In addition, some appraisers are required to provide as many as 10 comparable sales, which almost guarantees the use of distressed properties as comps in many cases. The appraisal industry has made strides in adapting to market conditions, expanding education and making appropriate adjustments for distressed homes that are used as comps. It appears that many of the remaining problems are tied to appraisals made through AMCs. Fortunately, the level of distressed sales is trending down: they accounted for about one-third of all sales in 2011, but have averaged roughly a quarter of sales in recent months. By 2013, NAR expects the distressed market share to decline to about 10 to 15 percent. As distressed inventory is cleared from the market over

the next two years, it should help to correct ongoing problems. In the meantime, buyers, sellers and real-estate agents need to be aware that there are problems with some appraisals, but also be aware of their rights to communicate with appraisers and lenders about errors or concerns with individual valuations. n a hill just outside the village of Los Cerrillos, Michael Lancaster and Barbara Harnack built a solar home that doesnt look like a solar home. In the wintertime, the thick flagstone floors and double-adobe walls serve as thermal mass, absorbing the suns heat during the day and slowly radiating it at night. Roof overhangs prevent direct solar gain in the summer. The north side is super-insulated with sprayed foam up to 30 inches thick and a trombe wall warms the adjacent kitchen in the wintertime. The main house boasts an entrance faade that recalls the mission church at Laguna Pueblo. Nearby are a guest house, a studio, a gatehouse, and an iglesia-theme tool shed. I designed and engineered everything, Lancaster said during a recent tour of the property. I wanted the effect of a little village on top of the mesa. This is the type of property that could only have been designed by an artist, although the level of the finishes is more that of a skilled craftsman. Witness the copper patina on the metal roof, the beautifully plastered interior walls, and the tall, narrow slit windows on one living-room wall. Opening into a sun room (which is equipped with a fountain and built-in adobe benches), the light and heat from these slits are controlled by frosted-glass panels that swivel open or closed. Begun in 1994, the main house on Vista Del Mar, off of Gold Mine Road, was completed in 2000. Three-quarters of the materials used in the house project came from within 75 miles. Twenty thousand adobe bricks were used for the main house, and another 7,000 for the outbuildings. The studio with sliding barn doors features straw-bale construction. The front doors, made from local wood, are accessed by steps on stacked stone. The hall-like living room with a 19-foot ceiling and sealed-flagstone floors is brightened by clerestories: a few as slots in the churchlike facade and a few more from dormer elements on one side. At one end of the living room is an adobe stairway and a gorgeous, blacksmith-crafted railing to a loft library, media room, and the master suite. Each downstairs bedroom has its own entry and portal. A powder room sports a faucet of an extraordinarily simple design a length of copper pipe and a pot sink thrown by Lancaster. In fact, the house is peppered with the couples ceramics: Harnacks statues and faces and his sculptures and industrial objects. Both are also painters. Lancaster, the great-grandson of American circus innovator Charles Ringling, is the author of a fictionalized biography, Ringling: The Last Laugh, published this year. He and Harnack are at work on The Boys from Baraboo, a childrens book telling the story of the Ringling Bros. and illustrated with photographs of Harnacks ceramic figures in settings. There are built-in artistic touches throughout the house, for example the rust-patinad inserts in the pantry doors, and the sherds of old Indian pottery, collected on the property, set into a partial wall in a bathroom. Lancaster is a cook and paid special attention to the design of the kitchen, with tile countertops and practical access to pots and pans, food, and dishes. The kitchen ceiling is tongue-and-groove decking on vigas. An attached greenhouse gives the couple winter tomatoes and greens, all irrigated with stored rainwater. Three subterranean water tanks outside have fountains on top; one of those bubbles over a face from a broken Harnack sculpture. Household water is from a shared well. The house is warmed in the winter by means of an in-floor radiant-heat system on five zones. A cozy patio with bancos and a fireplace offers the relaxing homeowner terrific views you can see six mountain ranges from the 13-acre property. Its a short drive to the historic mining town of Madrid (now full of folk-art shops, cafs, coffee shops, galleries, and the renowned Mine Shaft Tavern), less than a mile from state park and BLM land for hiking and horseback riding, and 25 minutes to Santa Fe. concerned that these wells are extracting water, without monitoring or adherence to whatever City of Santa Fe watering restrictions are in effect, from the same Tesuque Formation aquifer the city uses for its supply wells? The drilling of new or replacement wells in the city is highly regulated and the permit-evaluation process involves consideration of proximity to city water lines. Permits, if granted, mandate metering and reporting. When we conducted our well-publicized regional water-testing program in 2009, very few city well owners signed up for the free (and confidential) comprehensive water analysis due to suspicion that, because the city, county, and NM Environment Department were also involved in the testing program, disclosing the existence of a private well would somehow enable the city to find a way to prohibit them from using it. How many private domestic wells are there within city limits? When I first posed that question to city officials about
five years ago, I was told probably three thousand plus. The 2011 Annual Water Report lists 600 wells. Considering the age of many of the wells and the lack of required reporting, it seems improbable that either the City of Santa Fe or the Office of the State Engineer knows exactly how many active private wells there are within the city. It is reasonable to assume that some wells would be abandoned because of mechanical failures, but I would expect the count to remain relatively stable due to annexation. Many well owners also use their aquifer water to irrigate vegetable gardens. Some private wells within Santa Fe city limits have laboratory-confirmed high levels of uranium and the uptake of uranium (from both water and soil) in garden vegetables has been confirmed locally through a rigorous field study and laboratory testing program. An independent, specialized laboratory analysis recently revealed high levels of uranium in the homegrown potatoes, cucumbers and

beets of a local couple whose well water has elevated uranium levels (twice the drinking water standard). Watering vegetables with well water may pose a potential health risk. The instruction or authorization to the settlement agent to disburse funds for recording fees, title-insurance policy, real-estate commissions, and any other closing costs incurred through escrow. Instruction as to the proration of taxes, rents or association dues, as applicable. Instructions on the payment of prior liens and charges against the property and distribution of the net sale proceeds. Since the settlement agent can only follow the instructions as stated, and may not exceed them, it is extremely important that the instructions be stated clearly and be complete in all details. The Seller deposits the executed deed to the buyer with the settlement agent; deposits evidence of pest inspection and any required repair work, if applicable; and deposits other required documents such as tax receipts, addresses of mortgage holders, any state or federal required documentation. The Buyer deposits with the settlement agent the funds required, in addition to any borrowed funds, to pay the purchase price; deposits funds sufficient for home and title insurance; and arranges for any borrowed funds to be delivered to the settlement agent. The lender on behalf of the buyer deposits any mortgage necessary to secure loans; approves any inspection reports, the Preliminary
Report for title insurance, called for by the purchase agreement; and fulfills any other conditions specified in the instructions. The Lender prepares the loan document package for buyer/borrower; deposits proceeds of the loan with the settlement agent; and directs the settlement agent on the conditions under which the loan funds may be used. The Settlement Agent opens the order for title insurance; obtains approvals from the buyer on the Title Commitment, pest and other inspections; receives funds from the buyer and/or any lender; prorates taxes, rents, etc.; disburses funds for title insurance, recording fees, real-estate commissions, lien clearance, etc.; prepares an estimated statement or HUD settlement statement, as required, for each party, indicating amounts to be disbursed for services and any further amounts necessary to close; records deed and loan documents, delivers the deed to the buyer, loan documents to the lender and funds to the seller, closing the escrow; issues the final closing statement/ HUD settlement statement and forwards to buyer, seller, and lender. Once all terms and conditions of the instructions of all parties have been fulfilled, and all closing conditions satisfied, the escrow is closed and the safe and accurate transfer of property and money has been accom-

Doesnt Santa Fe have a reputation of being difficult for new business? I tell people all the time that that is no longer the case, Johnson responded. And a lot of that I think has to do with the mayor. The bad news is that its just a very slow go. There are a few new businesses, however, at Plaza Santa Fe (home of Target, PetsMart, and other firms). The former Borders space will soon be taken by Ulta Cosmetics. Already at the shopping center are Select Comfort and Wow Dogs. Were also working on a restaurant for one of the pads in front of T.J. Maxx, but, really, the bulk of my activity is at DeVargas Center, where there will be, with any luck at all, a whole lot of change. A lot of real cool stuff is happening there; it will be a very changed property by the time we have this conversation next year. The old Mervyns building at Santa Fe Place has a sign advertising, Sports Authority Coming Soon, but one new retailer there now is Toys R Us Express. An employee said she read that Toys R Us opened 2,500 of these around the country for the holiday season. The company announced it would operate about 600 during the 2010 Christmas season, so it must be well-patronized model. A Doubletree by Hilton opened earlier this year in a remodeled, former Holiday Inn at 4048 Cerrillos Road. A different scenario a corporate acquisition/merger resulted in Santa Fes two Sunflower Farmers Market stores being rebranded as Sprouts this summer. Thats a good thing; Sprouts is a stronger company, said Mark Ruhlman of Columbus Capital Corporation. An expectation that Ashley Furniture would come in next to the Sunflower market at San Isidro Plaza never materialized, but the firm did manage to bring in a Papa Murphys in mid-September and a UPS Store and a San Q Japanese restaurant in October. Restaurants in general in this part of town are down 8-10 percent, but it seems like its starting to get better, Ruhlman said. In general, were getting more calls, and from national franchises, so were showing more space than we were. Branch Design & Development, which is affiliated with Columbus Capital, is building San Isidro Apartments just north of San Isidro Plaza, behind Lowes Home Improvement. Ruhlman expects the first buildings to be ready in the early fall of 2013. The gated development will be 176 market-rate apartments, plus a pool and fitness center, with rents in the $700-$1,300 range. New affordable-market apartments are being developed by The Housing Trust at the site of the vintage Stage Coach Motor Inn. [See story on Page 19.] Looking at the office scene, although there is a good supply of quality properties available, the office-for-lease market is still very soft, according to Leon Mellow at Grubb & Ellis. But he is busier than ever. A lot of my practice is situations that are either distressed or the owners are needing to get something going on them and the problem in both cases is that were missing is a lot of prospective tenants and a lot of prospective owners. We do have a lot of properties that are priced properly because most owners have gotten realistic at this point. Real-estate activity, in general, slows down in election years, but its difficult to know how much it will bounce back after Nov. 6. Elections always create the unknown situation and the real-estate market stops when things are

unknown, Mellow said. Real estate understands yes and no, but it doesnt understand possibly and maybe. The other thing is you dont turn on the market with a switch, so were going to be well into 2013 before we see the results of the election, if there are any. Grubb & Ellis Santa Fe listings include 6.5 acres on Governor Miles Road on sale for $3.9 million; the century-
old Fiske House on Don Gaspar Avenue [for office use], $2.35 million; 5 acres next to the new Beaver Toyota site off Beckner Road, $2.1 million; and 4.6 acres on Airport Road for $1.8 million. REA Advisors, Albuquerque, is leasing the former BLM/Forest Service building (now owned by Stoneforge Advisors, Austin) at 1474 Rodeo Road for $15.50 per square foot.
Late last month, Robin McKinney Martin announced plans to sell the Santa Fe New Mexican Building at 202 E. Marcy Street. In the mid-2000s, Martin, owner of the newspaper, built a new printing/distribution building at the south end of town, purchased a KBA Comet printing press, and did a substantial remodel of the Marcy Street building just before the world financial crash. The newspapers 150-some employees will be consolidated in the new building at One New Mexican Plaza, just west of the Cerrillos Road/I-25 intersection. The 29,500-square-foot downtown building, the papers headquarters for 70 years, is listed for $6.2 million by John Hancock, Barker Realty. Included are two parking lots that accommodate 100 vehicles. A few years ago, Santa Fe brokers David Oberstein, Oberstein Properties, and Marc Bertram, SF Brown Real Estate, were among the developers of Hotel Parq Central in Albuquerque. Bertram said that was a very successful venture and noted its number one at TripAdvisor.com. The two have recently converted a large office space at 215 Lincoln Avenue (vacated when Thornburg Companies move into its own building on Ridgetop Road) into single offices. These are executive suites, Oberstein said. Theyre single offices with shared reception areas, shared kitchens, shared waiting and conference rooms. We have about a dozen individual tenants in there now. So we are finding that there is demand for single-office users, small independent businesses, and we also have parking, lots of parking: between Marcy Plaza and 215 Lincoln, we have probably 300 parking spaces downtown. Im encouraged to see that leasing activity is picking up. Ive shown space three times this week. There are people out there looking. The state apparently is also out there looking for new office space at the huge, potential Las Soleras development just north of I-25 and east of Cerrillos Road. A mass relocation of state employees from existing offices around Santa Fe would do nothing but put this market into a deeper recession for a much longer time, Bertram said. Thornburg vacated two of my buildings Marcy Plaza and 215 Lincoln and were stll feeling the effect five years later. I think thats also true at the First Interstate Building, which is owned by Trammel Crow. Thornburg vacated about 60,000 feet, but the state is talking about 230,000 square feet in the first phase of Las Soleras. Can you imagine the impact? At the corner of Cerrillos Road and Christos, The Ranch House was opened by Josh Baum and Ann Gordon, who before this had Joshs BBQ at San Isidro Plaza on Zafarano Street. In February, Bill Healy opened the Green Owl Caf in a remodeled gas station at 1698 St. Michaels Drive. A soup-specialty restaurant named Sup opened last spring at 559 W. Cordova Road. The Nile Caf,
featuring extraordinary Egyptian cuisine, landed at 620 Old Santa Fe Trail. Real Burger, last seen at 2239 Old Pecos Trail (previously home to Peppers, Fresh Peppers, El Milagro, and other restaurants), is opearting at the corner of Maez and Cerrillos roads since last January. And at 2239 Old Pecos Trail since February is the Pecos Trail Caf. In the old Real Food Nation location on the Old Las Vegas Highway near Eldorado, restaurant veterans Annamaria and Murphy OBrien opened Cafe Fina. Their suppliers include Niman Ranch and Talis Wind Ranch (meats) and Taos Cow Ice Cream, so you can depend on the food being local and yummy.
