BANKRUPTCY JUDGE, THE OFFICE OF THE UNITED STATES TRUSTEE, EFMF EQUITY COMMITTEE, EFI CREDITORS COMMITTEE, AND PARTIES REQUESTING SPECIAL NOTICE IN THE EFI AND EFMF CASES: Thomas P. Jeremiassen (EFI Trustee) and Bradley D. Sharp (EFMF Trustee), the chapter 11 trustees (the Trustees) for the above-captioned bankruptcy estates of Estate Financial, Inc. (EFI) and Estate Financial Mortgage Fund, LLC (EFMF), respectively, with due authorization of the EFMF Trustee and his counsel, hereby file their Trustees Joint Chapter 11 Status Report (the Report).

I. BACKGROUND

On June 25, 2008 (the EFI Petition Date), creditors filed an involuntary chapter 11

petition against EFI. On July 1, 2008 (the EFMF Petition Date), EFMF filed its voluntary chapter 11 petition. At all times prior to the appointment of the EFMF Trustee, EFI was, pursuant to EFMFs operating agreement (the EFMF Agreement), the sole manager of EFMF. On July 11, 2008, EFI consented to the entry of an order for relief under chapter 11. On July 16, 2008, an order for relief was entered in the EFI case. On July 23, 2008, the Court, in both EFIs and EFMFs chapter 11 cases (the Cases), entered that certain Order Directing the Appointment of Chapter 11 Trustee Pursuant to 11 U.S.C. 1104(a)(2). On July 25, 2008, the Trustees were appointed by the Office of the United States Trustee (OUST) and they accepted their appointments on July 28 and 30, 2008. Thereafter, the Trustees have served as the duly qualified and acting chapter 11 trustees of their respective estates. 2. On September 4, 2008, the OUST appointed an official committee of investors/equity

holders in the EFMF Case (the EFMF Committee). On October 20, 2008, the OUST appointed an official committee of unsecured creditors in the EFI Case (the EFI Committee). No other official committees have been appointed in either case. B. Property of the Estates At the beginning of these cases there were approximately 544 outstanding loans (the Loans), all of which were supposed to be secured by real estate (the Properties). The Loans were funded by over 1,000 individual, direct investors and by EFMF, which has approximately 1,700 member/investors. The 544 Loans had outstanding principal balances totaling approximately $318 million, of which approximately $151 million was funded by EFMF and the remainder (of roughly $167 million) was funded by other direct investors. As of the EFI Petition Date, the Trustees believe that EFMF held unrecorded fractionalized ownership and TIC interests in all or most of the 544 Loans or Properties, with EFI and other direct investors holding the balance of the

fractionalized interests. Those interests of the non-EFMF investors are either properly recorded, recorded within the relevant preference period, improperly recorded or unrecorded. II. CASE STATUS A. The Current Status of the Estates Assets 1. As of the beginning of the Cases, for approximately 42 of the 544 Loans the

Properties securing such Loans had been foreclosed upon or deeded to EFI or the investors in such Loans in lieu of foreclosure. As of the date of this Report, all of the remaining Loans remain in default and the Trustees are working together to service those Loans and, as necessary, foreclose upon the Properties to obtain control thereof for the benefit of the two bankruptcy estates, their constituencies, and other investors in such Loans. Due to the Trustees efforts to date (i) 18 properties have been sold generating gross proceeds of approximately $10.1 million (See Exhibit A attached hereto), (ii) 12 properties are currently in escrow for gross sales prices aggregating approximately $5.9 million (See Exhibit B attached hereto) , (iii) 19 properties are currently listed for sale for an aggregate price of approximately $22.6 million (See Exhibit C attached hereto), and (iv) approximately 254 loans with aggregate balances exceeding $128.1 million are in various stages of foreclosure, and a Notice of Default is about to be served in connection with an additional 23 loans with an aggregate balance of $20.5 million (See Exhibit D attached hereto). 2. As detailed in Exhibit E hereto, the estates had $5,360,650.38 in cash as of July 7,

2009, of which $3,729,641.90 had been reserved for various purposes (e.g., sales proceeds not yet distributed to investors, funds segregated for disputed liens). The estates thus had available funds as of July 7, 2009 of $1,631,008.48. 3. As detailed in Exhibit F hereto, as of July 7, 2009, the EFI Trustee had disbursed

approximately $2.37 million to investors on account of the sales described above. B. The Procedural Status of the Cases 1. In accordance with the Courts Procedures Order Re: (1) Real Property Sales And

Related Distributions And Payments, Including Brokerage Commissions; (2) Loan Payoffs And Reconveyances; (3) Related Compromises; (4) The Making Of Secured Advances; And (5) Loan

Collection, Administration And Enforcement, Including Foreclosures, Forbearances And Deeds In Lieu, entered October 27, 2008 in the EFI case and October 28, 2008 in the EFMF case (the Procedures Order), the Trustees have continued to file and serve notices of proposed dispositions of various estate properties, along with ex parte applications for approval of such dispositions. Since the last Joint Status Report was filed on June 4, 2009, the Trustees have sent three notices regarding proposed sales, and two notices regarding proposed short pays. The Court has recently entered orders authorizing and approving the sale of properties in Olympic Valley and San Marcos. 2. In addition, pursuant to the Procedures Order, the EFI Trustee has sent out notices

regarding stipulations with Alvand Construction, Inc. and Mitch Brown Construction, Inc. and a settlement with T.M. Cobb Company. 3. Pursuant to the Procedures Order, the EFI Trustee also sent a notice regarding a

stipulation with Foley-Gannon, Inc. providing for relief from stay for the EFI Trustee to foreclose on the real property located at 150 Hinds Avenue, Pismo Beach, CA. Despite having negotiated and entering into the stipulation, Foley-Gannon objected to an order thereon. The matter is set for hearing on July 17, 2009. 4. The EFI Trustee has investigated and responded to a motion filed by James Kimball

seeking relief from the automatic stay to terminate loan servicing agreements for loans in which he or his trusts were the sole investors. The matter is set for hearing on July 17, 2009. The Committees continue to be actively involved in these cases, and the Trustees continue to consult with the Committees, both on a regular, periodic basis and when issues of substance arise.
