Through this order an appeal under section 19 of RTI Act.-2005 dated 12.12.2006 filed by Dr. Miniti Binju against the order of SPIO, DTTE (H.Q) is being considered. Dr. Miniti Binju vide her application ID No.236 dated 08-11-2006 had asked for the following information:1. On careful examination of the application of Dr. Miniti Binju and the reply of the SPIO, (DTTE) (HQ) following observations are made:It is observed that the SPIO DTTE (HQ) has already provided the information in his reply dated 6-12-2006. It is also observed that the applicant vide her application dated 8.11.2006 to the SPIO DTTE (HQ) had enclosed a letter addressed to the Joint Directorcum-Joint Secretary (TTE) for taking action relating to her service matter and issuing direction on such issues. These do not fall under the definition of Information under section 2(f) of the RTI Act, 2005, since these relate to grievance redressal and claim simplicitor. There is no denial of information as alleged by the applicant. The applicant is requesting to take action in her disputing service matter in the way best suited to her in the appeal. The court of Appellate Authority is not a platform where the personal grievances are resolved. For this purpose, the applicant may contact the authority competent. The appeal is accordingly dismissed as non-maintainable. As per section 19 of Right to Information Act, 2005 Dr. Miniti Binju may file an appeal to the IInd Appellate Authority, if she wishes so.

Since the requested information relate to third parties, therefore, notices to the third party was issued on 22.6.2007 under Section 11 of the RTI Act,2005. The Diploma Ingeniur course was a regular full time course. 9. The Minimum qualification set by the Ministry of Education for the award of Scholarship to pursue degree course in Engineering in Printing Technology was Diploma Printing Technology. 10. The photocopy of the same can be obtained from the office of the DD(E-I) after depositing the fee of Rs.4.00 for two pages @ Rs.2 per page & by taking prior appointment.. 11. Sh.Mukul Kumar vide his application ID No.8 dated 01-11-2006 transferred to PIO H.Q. had asked for the personal information with regard to possession of qualification etc. in respect of Sh. B.D.Mendiratta, the then Principal Aryabhatt Polytechnic. Since the information related to IIIrd. Party as such before disclosing the information consent under section 11 of RTI Act, 2005 was sought and only after getting the consent, the information was provided to the appellant. Sh. Mukul Kumar has filed an appeal on the ground that :1. 2 Whether Section-11 have been observed while dealing Q.No.1. Moreover public interest out weights if people having no requisite qualification usurp the office. Public has every right to know the fact/truth & provide reply the PIO (HQ). In Q.No.3 height has been given to the personal information of Sh. B.D. Mendiratta and trying to justify the wrong done by putting B.E./B.Tech. on website and Board of G.B.Pant when Sh. B.D. Mendiratta does not have that qualification.

On careful examination of ground of appeal of Sh.Mukul Kumar and the reply of the PIO, (DTTE) (HQ) :It is observed that the PIO DTTE (HQ) has already provided the information as made available to him by the 3rd partly as well as custodian of record i.e. DD(E-I) in his reply dated 10.7,2007 after obtaining the consent of the person concerned under section-11 of RTI Act, 2005 and the reply furnished to the applicant. Therefore, the ground of the appeal are not -maintainable. and the appeal is dismissed accordingly. As per section 19 of Right to Information Act, 2005 Sh.
