Equity and Equity Rules

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

The philosopher Aristotle is credited for first writing about the concept of Equity.

Aristotle said that an equitable exception based upon need must be made when there is an

injustice at law. There is another reason for Equity. Philosopher Bernard Lonergan

argues that the world is to complex to be completely captured by rules. This applies in

the legal arena such that the world of common sense meaning is too complex for any law

maker, legislator or judge, to make a set of rules which will universally apply in every

situation. Rather than trying to come up with a regulatory regime with regulations all the

way down to how to brush your teeth in the morning, instead we have equitable

exceptions to general rules which deal with individual context. Now, in the past there

have been complaints that Equity is too subjective and therefore irrational and not good.

This is not true.

Now, all law is ideally suited to legislating for an ideal population of rational and

autonomous persons. However, it is apparent some persons do not readily fall into this

category. Thus, Equity favor certain classes of persons who have special needs: the

poor, the eldery, minors, the physically handicapped, ethnic and racial minorities, and

the physically and mentally ill.

The following are some Equity Rules:

1. Equity favors the one in need.

2. Equity favors the one with the greatest need.

3. Ordinarily, Equity will not intervene on behalf of the State.

4. Equity makes an Equitable Exception from Rules at Law based upon need.

5. Equity abhors an injustice at law.

6. Equity intervenes to prevent an injustice at law.

7. Equity intervenes when there is not adequate remedy at law.

8. Ordinarily, Equity follows the Law.

9. There is no adequate remedy at law when there is an injustice at law.

Chapter 2

Equity and Social Democracy

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

In Liberal theory, Law comes before Equity. However, in Social Democratic

Theory, Equity comes before Law. Equity favors the one in need, while law protects

individual right based upon rational self interests. Now, for many of us we have Needs

which are Liberal nature, but modified by Equity, so that my primary Needs are

1. My Autonomy 2. My Enlightened Rational Self Interest

2. My Self-Actualization 4. My Self Transcendence

Now, we all also have Basic Needs for Food, Clothing, a Home, Medical and Dental

Treatment, Transporation, Recreation, and Education. All of the above needs in

Society must be met before we allow excess accumulation of wealth and a wealthy

life style. Finally, while we have a need for the Good Order based upon Law, this

Law must always be interpreted Equitably favoring those in need first, such as the

working poor, the poor, the mentally and physically disabled, the elderly, and

children. The Modern Common Law is Law interpreted in light of Equity, while the

Traditional Common Law only follows rational self interest. The Legislature, the

Executive Branch, and the Court must follow the Modern Common Law when

necessary.

Gilson and Substance

In his book, “The Spirit of Mediaeval Philosophy,” Etienne Gilson discusses

the Metaphysical Quiddity of Substance. Citing Aristotle’s work from the Physics and

Metaphysics, Gilson states, “It clear then... that there is a substance which is eternal and

immovable, and separate from sensible things. It has been shown that this substance

cannot have any magnitude, but is without parts and indivisible….” This is the

Substance of the Greek philosopher Anaximander which is mentioned in the work of

John Locke. In my Critical Thomistic theology and philosophy, Substance is the

Metaphysical Quiddity underlying the Holy Spirit. Recall that the Nicean Creek states

that God the Father and God the Son are one and same Substance (Holy Spirit).

Jesus, the Pharisee and Hypocrisy

An Allegory

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

Jesus of Nazareth was addressing the crowd, telling them that the purpose of

society is to promote the Individual Good, following Plato. After his address one of the

Pharisees who had listened to Jesus’ talk, asked Jesus, “Teacher, can you please tell me

which is the worst sin adultery or murder?” Jesus replied, ‘Neither is the worst sin, the

worst sin is hypocrisy.” Jesus then told a story, “There was once a Pharisee who prayed

in public for 3 hours every morning and fasted all day, letting everyone know. In the

evening the Pharisee went and abused his children and beat his servant. The Pharisee

died expecting to go to Heaven. Upon dying the Pharisee was escorted to Oblivion

which is metaphysical reality which is structured by the Natural Law Metaphysical

Quiddities of Reciprocity, Proportionality, the Imagination, Equity, and the Individual

Good.

In Oblivion, Natural Law acted upon the Pharisee’s Imagination using

Reciprocity, such that the Pharisee was beaten and abused everyday by others in

Oblivion. On the the other hand a young man who often had premarital sex with a

girlfriend and who spend his time helping the poor found himself in Heaven in Oblivion.
The moral of the story is that as you are towards others so you shall be yourself. As you

judge so you shall be judged.

Reason

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

Previously, I have written that Jesus Christ is the Logos of God or Reason.

Reason is not simply logic, but instead, is a composite of a number of different

metaphysical cognitive capabilities or attributes. These attributes which are available

not only to God and his Archangels and Angles, but also to Human Beings, are as

follows:

1. Creative Form

2. Substantial Form

3. Substance

4. Matter

5. Analytic Logic

6. Analogical Logic

7. Being

8. Substance

9. Unconditional Parental Love

Additionally, it should be noted that St.Thomas Aquainas in his

Commentary on the Gospel of John, Chapter One, specifically states that the term

“Word” in the Prologue to John’s Gospel really means Logos, which means both Word

and Reason.

Taoism vs. Daoism

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

Some think, mistakenly, that Taoism and Daoism are the same spirituality. I

disagree. Daoism is dyadic while Taoism is triadic. The symbol for the Dao is the

Ying/Yang symbol involving curved apposites placed within a circle. The symbol for the

Tao is a triangle.

Because the Dao and the Tao precede God, Daoists and Taoists are spiritual

atheists. They believe in spirituality and metaphysics, not God. Although not much

can be said about the Dao and the Tao, a simple metaphysical formulation can be

described. The Dao is an apposite dialectic unity of Substance and Being, while the

Tao is an apposite trialectical unity of Substance, Being, and Logos.

Catholic Tradition has it that Jesus of Nazareth’s parents, Mary and Joseph were

perfect parents who loved Jesus and parented him appropriately. Some in the Marianist

movement in the Church say that the Virgin Mary is God. I say that this is heresy.

Instead, I argue that there more sound view is that Mary and Joseph each had a dual

nature of being both human and archangel. I argue that they were archangels in human

form. God is not a woman. God is male. God the Father is male and God the Son is

male and God the Holy Spirit is male. Only the Holy Spirit of Divine Wisdom is the

goddess Minerva, the Roman goddess of Wisdom and feminine.

Chapter 10

The Ethical Matrix Again

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2008 by Anthony J. Fejfar

The Ethical Matrix is an Ethical Decision-making Tool that I, Anthony Fejfar have
developed. It took me 5 years of research and experimentation to develop this Tool.

Principle I
Reciprocity

Judgment/Reflection
Intuition Understanding
Thinking

Principle IV Principle III

Equity Proportionality

Love
Feeling Experience
Will Sensation

Principle II
Utility

Now, there are 4 Ethical Principles in the Ethical Matrix, Reciprocity,

Utility, Proportionality, and Equity. Reciprocity is defined as, “Treat another as you
would wish to be treated in similar cirumstance.” Utility is defined as Maximization of

Value. Morality based upon a self chosen scale of values is used in relation to Utility.

The Liberal Scale of Values of Autonomy, Enlightened Rational Self Interest, Self-

actualization, and Self-transcendence meet the ethical requirements of Kant’s

Categorical Imperative. Proportionality involves a perfectly proportional “one to one”

ratio ( 1:1) and is the basis for the Rule of Law and Equality before the Law. Finally,

Equity “makes an Equitable Exception from a Legal Rule based upon Need. Equity

intervenes when there is no adequate remedy at Law. Equity abhors an injustice at Law.

There is no adequate remedy at Law when there is an Injustice at Law.

To use the Ethical Matrix personally you start with your hypothetical situation and

first apply reciprocity using the Liberal Scale of Values. You then generate a proportional

rule. If works then you stop. If it does not then you go to Equity and fashion an

equitable result based upon need.

Finally, in order to use the Ethical Matrix you must know what is going on and

must be moved to act. To do this one begins with one’s experience, including sense

experience and spiritual experience. Then one tries understand this and then judge and

reflect that one’s understanding is probably correct if appropriate. Finally, one allows

oneself to moved to act based upon love or will.

The Logic of Logical Positivism

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

The accepted definition of Logical Positivism is: “the only information that is

valid is that which comes from rigorous logical inferences from sense experience.”

Previously, I have argued that sense experience is an unreliable indicator of reality

because of existence of sensory illusions and because the central nervous system filters

out much of our sense experience.

Now, I would like to make the argument that there is no universally accepted

canon of Logic. For example, I have come up with a new logical rule that:”a a concept

which cannot allow for its own existence is fallacious and invalid.” So, for example, I

have argued that refication, as described by academic Peter Gabel is invalid because:

“reification is itself a reifed concept and therefore invalid.” Now, the question is

whether everyone will accept my new rule as valid. Many may not, and therefore, once

again we cannot say that Logical Positivism is a valid philosophy.

Further, one might note that Logical Positivism itself, as defined above, is not itself

based upon rigorous inferences from sense experience. In fact the whole idea of Logical

Positivism is really Metaphysical and not itself based upon sense experience.

Chapter 12

The Unitary Aunitary God

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

Psychologist of Consciousness, Robert Ornstein asserts that once survival needs

have been met, the evolution of human consciousness is an individual project, not

necessarily a group project. Also, Deepak Choprah, M.D., argues that God manifests

analogously to different levels of human consciousness. Finally, Quantum Physics

argues that the nature of reality at its most unitary is still slightly aunitary.

Given the foregoing, I argue that God, at his most Unitary is still slightly Aunitary.

Therefore, it possible that instead of choosing a Group God of organized religion, instead

one could devope one’s own personal God. This situation accounts for the fact that

different religions use the word “God” but have radically different theologies, religious

doctrines, politics, and metaphysics.

My God is the Objective God of Being at Level 4 of Human Consciousness.

Thus, my God, although personal, can be accessed by others with a similar belief in God.

If one is not careful, one’s God might be a God of Levels 1 and 2 in Deepak Choprah’s
system and closely resemble Satan himself, not a God of Compassion, Metaphysics, and

Social Justice.

Chapter 13

Why Darwinian Evolution Does Not Work

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

The work of Philosopher of Science, Henri Bergson, is instructive in critiquing

Charles Darwin’s theory of evolution. As I was taught Darwin in my Public School

biology class, evolution ala Darwin is based on the idea that random genetic mutations

produce physical changes in animals and human beings and such changes are then tested

in the laboratory of biological survival competition. The idea is that survival of the

fittest will retain and promote biological qualities which are benefiting the organism from

a biological point view.

Bergson points out that Darwin is dead wrong. Evolution is a much complicated

process because all sorts of biological adaptations come in stages which hinder the

organism rather than promote its survival. So, for example let consider the human eye.

The eye is connected neurally to the central nervous system and and also involves,

minimally both a retina and a cornea. Let assume that a “random mutation” produces a

retina. This retina is simply wasteful baggage for the human body and evolution should
delete as unnecessary for survival. When the cornea shows up ten thousand years later

through random mutation there is not reason to think that the retina will still be around. It

should have been elimated a long time ago as superfluous.

Finally, Rupert Sheldrake, a evolutionary biologist argues, like myself, that

forms or fields exist metaphysically which guide evolution and “arandom mutations.”

Similiarly, applying principles of Quantum Evolution it is clear that large Quantum

Leaps can take place in human or animal evolution causing complex changes to occur

suddenly as Bergson state, not gradually as Darwin states.

Reconciling Bergson and Classical Philosophy

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

Traditionally, Classical Philosophy has taught that the Nature of Reality, namely

Being and the Immutable Platonic Forms are static. The Philosopher Bergson, on the

other hand argued that Change is the Nature of Reality. I argue, that Being vibrates in a

classically recurring static pattern which includes illiteration which manifeststs the God

of Being or God the Father. I also argue that the Immutable Platonic Forms can be

“Added to but not Subtracted From, Rearranged but not Changed. I think that it is better

to say, following Bergson, that Change takes place outside of Space-Time which is not

material change. This is consistent with the Catholic Bible where the Holy Spirit of

Divine Wisdom is decribed as “mobile mobility.”

Chapter 16

Social Responsibility of Business and Profit Maximization

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J.Fejfar

Some people think, wrongly, that you make more money with a company if you

attempt to profit maximize in the short term. In fact this is stupid management.

Stragetic management teaches that one must attempt profit maximize in the long run at

the expense of short term profits. In the short term management must invest in plant and

equipment, employee education and marketing. If you cut any of these vital areas in an

attempt to maximize short term profits then you cut your company’s throat.

Now, it is also appropriate to diversify company operations such that a market

down turn in a particular sector of the economy will no seriously damage the company. It

is also bad management to lay off or fire skilled employees because it is very expensive

the retrain and re-educate new employees when management retools. Laying off and

firing employees also hurt productivity of the remaining employees because an

atmosphere of fear in the company is created. Fear paralyzes creativity and attention to

business.
Chapter 17

A Fallacious Proof for God’s Non-existence

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

The following is Fallacious (FALSE) Proof for God’s Non-existence:

1. Assume the Existence of God

2. Assume Nothing is Impossible for God

3. Since nothing is impossible for God, God must be able to make himself go
out of existence.

4. Either God cannot accomplish Step 3 above and is therefore not God,
or God has taken Himself out of existence.

5. Therefore God does not exist.

Now, the foregoing proof is false for two reasons. First, God is Good so therefore
God cannot do evil. Therefore it is better to say that nothing Good is impossible for
God. Since is better for God to exist than not to exist, for God to go out of existence
would be evil and not inconsistent with our definition of God.

Next, given that the Logical Rule of the Excluded Contradiction is logically
necessary and exists, it is clear that you cannot have a proof which states “God” and
“not God” in the same proof.
Chapter 18

A Logical Proof for the Cognitive Capability of Judgment

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

The Philosopher Comte argued for Logical Positivism where Logical Positivism

is defined as the use of deductive logic and sense experience. Comte was trashed by

Hume who said that you can only know sense experience through the use of inductive

reasoning and the empirical method. Kant trashed Hume arguing that meaning

categories at Level 2 or the Noumenal World are all that you can really know not sense

experience at all. Deveopmental Psychologists following Lonergan agree that at the age

of One children no longer really gave sense experience but only experience the world of

meaning or noumenal world. The Gadamer developed Hermenuetic arguing once again

that the World of Meaning at the Hermeutic Level of Level 2 is all we really know. The

Habermas argued that Hermeutics doesn’t because there is no transcendent vantage point

to critique any hermeneutic meaning which is not already a hermeutic stance, thus

leading to the notion of analytic spin or the hermeneutic circle which logically invalid.

Lonergan argued that we avoid the hermeutic circle because we use Level 3 Intuitive
Judgment to break out of the hermeutic circle and form reasonable probable judgments of

fact. Therefore:

1. We assume that we have reasonable knowledge of the world around us.

2. reason is not sense experience

3. reason is no mere analytic understanding which involves the hermeneutic

circle

4. therefore reason involves a transcendent function known as Intuitive Judgment

5. I experience experience, understanding, and judgment above

6. I understand experience, understanding, and judgment above

7. I judge that I know reality, reasonably, through experience, understanding, and

judgment.

8. Therefore, Judgment Exists.

A Proof for the Existence of Being

Bernard Lonergan defines Being as an Unrestricted Act of Understanding. Now,

if we wish to prove this we can do so using an inductive proof:

1. We can understand things and ideas.

2. There must must a source or end of our understanding.

3. The source or end of our understanding is the Unrestricted Act of

Understanding or Being.

Absolute Evil and Absolute Good do not Exist

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

The Nature of Reality is Moderate Relativism, there is no Absolute Good and

there is no Absolute Evil. The only God is a probable God ordered toward a probable

Good. Put another way, God is ordered toward the Individual Good which is based

upon Autonomy, Enlightened Rational Self-Interest, Self-Actualization, and Self-

Transcendence. On the other hand, there is no Absolute Evil only relative evil. Satan

does not exists and Satanists are schizophrenic and delusional. Satanists are also

remarkably stupid. Everyone knows that Satan never keeps his promises and destroys his

followers. Anyone who thinks Satan will help them out is hallucinating.
Chapter 21

Aristotle and Faculty Psychology

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

In Aristotle’s Psychology, Aristotle describes levels of consciousness or cognitive

capabilities, what he describes as “faculties.” In Aristotle the levels of consciousness can

be described as follows:

1. Sense Experience

2. Understanding (passive mind)

3. Judgment (active mind)

4. Imagination

As you may note, the foregoing parallel the Cognitional Structure in Lonergan as

well as Piaget and Kohlberg. In this essay I would like focus on imagination. It is clear

that formal operations thinking at Level 4 (Piaget), and formal operations moral

reasoning or ethics at Level 4 (Kohlberg), are only made possible with the use of the

Imagination. Both formal operations functions require that the person imagine logical or

moral alternatives in the Imagination.

Finally, it should be noted that the imagination is a real cognitive function and that

not all persons have it. This why some rather dense psychiatrists who are not in formal

operations do consider the imagination to exist. Such psychiatrists deluded in thinking

that a person can have a hallucination in the imagination when we all know that all the

content of the imagination is imaginary and is supposed to be.

Avoiding the Effects of Neuro-linguistic Programming

BY

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

A Master of Neuro-linguistic Programming can put a person in a hypnotic trance

state and give them hypnotic commands or programs to think or act in a particular way.

If you doubt this, see the Woody Allen Movie, “The Jade Scorpion” and be careful that

you are not hypnotized by the movie itself.

As in Harry Potter, you must take a course in the Defense Against the Dark Arts of

Neuro-linguistic Programming. The following are some suggestions that have helped

me:

1. Self-appropriate your Consciousness using the following as self-hypnosis:

Meditate or repeat to yourself the following:

a. I experience, experience, understanding, and judgment.

b. I understand, experience, understanding and judgment.

c. I judge that I know reality, through experience, understanding, and

judgment.
(See generally, Insight, by Bernard Lonergan)

2. Appropriate the Ethical Matrix

a. For all my decisions I start with the follow moral scale of values

1. My autonomy is my highest value.

2. My enlightened rational self-interest is my second highest value.

3. My self-actualization is my third highest value.

4. My self-transcendence is my fourth highest value.

b. Think reciprocally such that you “treat another as you would want to be

treated in similar circumstances.

c. Think proportionally.

d. Use Equity and make an Equitable Exception based upon need.

3. Think probabilistically such that every statement you hear or read is assigned a

probability value of not greater than 99.99999%. For example instead of

treating every statement as true or false, give a doubtful statement a probability

of say, 30 instead of false or true. Treat a probability of 55% or greater as

being real or provisionally true.

If you engage in the foregoing mental techniques or programs then it is much

less likely that you will be subject to being hypnotized by someone. The foregoing is

insurance against the commonly used hypnotic technique of a person setting him or

herself up as an authority that you are commanded to obey.

Being Intuition

By

Intuition is defined as a arational cognitive capability that uses internal remote

viewing, Insight of ideas from Intuition, and Intuition as as Feeling Tone. To have

accurate Intuition you must Intuit Being. Being is defined as an Unrestricted Pure Act of

Understanding. Being is proved with the following Logical Proof:

4. We can understand things and ideas.

5. There must must a source or end of our understanding.

6. The source or end of our understanding is the Unrestricted Pure Act of

Understanding or Being.

Now, Being is analogous to the Quantum Field. It is apparent that if one could use

Intuition to access the Quantum Field one could develop a source of information that

transcends mere mundane knowing. Quantum non-locality proves that it is possible to

link a person’s mind non-locally, outside the mind without outside sources of
information. Thus, by analogy it is possible and even probable to use the mind non-

locally with Intuition to get outside information by intuiting Being.

Catholic Deacons and Catholic Communion Services

By

Catholic Deacons can do a Communion Service which is virtually identical to the

Catholic Mass by simply using the following Eucharistic Prayer in the Communion

Service:

“This Bread has been consecrated as the Body of Christ.”

“This Wine has been consecrated as the Blood of Christ.”

Obviously, a Catholic Priest or a Catholic Bishop must say the Mass and do the

consecration of the Bread and Wine at a time prior to the communion service.

Also, it is clear that under GAAT Deacons should only have to have course in

Sacramental Theology to be ordained as a Catholic Deacon. Catholic Deacons who are

married are only required to take a Celibacy vow which is prospective, meaning if the

Deacon’s wife would happen to die, the Deacon cannot remarry without a Dispensation.
Chapter 25

Choosing Your Binding Spell

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

In the “Lord of the Rings” the Magic Novel by J.R.R. Tokien, the Binding Spell

for Middle Earth was the Dark Lord Sauron’s One Ring of Power. When the One Ring of

Power was destroyed in Mount Doom at the end of the Novel the Magic left Middle Earth

and the world as they knew it came to an end.

Similarly, each person must choose their own Binding Spell because Reality is

characterized by Moderate Relativism and your existence is dicated in large measure by

your Binding Spell which is your primary purpose as a person. There are a variety of

Binding Spells which you can choose, most of which lead you to tragedy. The following

are some commonly chosen Binding Spells:

1. Good

2. Evil

3. God

4. Satan
5. The Common Good

6. Adventure

7. Sex

8. Obedience to Authority

9. Poverty

10. Conventional Reality

11. Conventional Morality

12. Psychiatry

13. Extreme Relativism

14. Power

15. The Individual Good

With respect to the foregoing, only your own Individual Good will lead to a Meaningfully

Happy existence. You cannot choose The Good, because those who choose Evil try to

destroy you. You cannot choose Evil because those who choose The Good try to destroy

you. You cannot choose God because God will use you and make you a martyr. God

hates sycophants. You cannot choose Satan because Satan hates sycophants and will

destroy you. You cannot choose the Common Good because everyone will try to enslave

you on the basis of the Common Good. Adventure is not a bad choice, but your life will

be filled with adventures and you may get tired of this. Adventure follows the Path of the

Hero and you must leave a mundane life, overcome adversity, and then triumph. You

cannot choose sex because you will end up being a prostitute and will be raped all the

time. You cannot choose obedience to authority because there are many authorities, and

sooner or later an authority will choose to destroy you. You cannot choose Poverty
because you will starve to death and have poor medical treatment and poor health. You

cannot choose Conventional Reality because Conventional Reality will eventually

destroy you. You cannot choose Conventional Morality because will eventually destroy

you. You cannot choose Psychiatry because Psychiatry will eventually destroy you. You

cannot choose Extreme Relativism because you will eventually go out of existence. You

cannot choose Power because Power will eventually destroy you.

The only rational choice for your Binding Spell is your own Individual Good,

which involves as your highest values:

1. Your own Autonomy

2. Your own Rational Self-Interest

3. Your own Self-Actualization

4. Your own freely chosen Self-Transcendence

Thus, my Binding Spell is the Individual Good of Tony Fejfar, where I, Tony Fejfar,

and only I, as Tony Fejfar, exist in Substantial Form as Tony Fejfar.

Perhaps Jesuit shortage is not as severe as we think. For example, it is widely

known that in the Wisconsin Province Jesuit Novitiate the Rector had the Novices read

the Gospel on Wednesday weekly masses which only Priests and Deacons are allowed to

do under Canon Law. Additionally, the Novices were required in daily Mass in the

Novitiate to raise their right hands at the Consecration of the Eucharist, con-cclebrating

Mass with the Jesuit Priest. The foregoing is how Byzantine Catholic Priests become

Priests without ordination. Congratulations, Wisconsin Province for a job well done.

Continuing Legal Education is a GAAT Violation

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

Continuing Legal Education (CLE) is not only a violation of the General

Agreement of Tariffs and Trade it is also absurd. There are a number of problems with

CLE. First, many lawyers admit in private that the purpose of CLE is to keep out part-

time and solo practitioners. This both an unreasonable restraint on a service industry

under GATT as well as an anti-trust violation.

Now, the above criticisms are valid in an assumed world of competent CLE, but

in fact this does not exist. I have done CLE presentations and I spend over 2 months

preparing for my presentation with little or no pay. CLE will not pay for competent law

professor who are best qualified to teach CLE to prepare and teach.

Next, in terms of subject matter, CLE really does not have anything to do with

legal practice. Most CLE’s are on obscure topics which are not really relevant to

everyday law practice. CLE will not run programs on jurisprudence or philosophy of

law which benefit practitioners but they do run some absurd postmodern CLEs. For

example, one CLE presenter does a presentation over and over again every year dealing
the Shakespeare’s play the Merchant of Venice. This has absolutely nothing to with law

or jurisprudence and it billed as an ethics presentation. I, personally, had a Shakespeare

course in college at Creighton University and read and discussed the Merchant of Venice.

Shylock is villain in the play who is a loan shark who want a pound flesh, that is

barrower’s left hand, under Moslem law for defaulting on a loan. The presenter absurdly

presents Shylock as a innocent victim of Christian persecution.

Furthermore, CLE presentation typically repeat the same presentation every year.

They are given by non-law professor attorney’s who are not academics. Additionally,

CLE allows its’ “lawyer students” to take the same CLE over again year after year.

CLE is an irrational restraint on trade under GAAT and must go.

Criminal Law and The Establishment Clause

By

In the Smith case, the United States Supreme Court overruled Yoder and held that

Religious Liberty under the First Amendment to the United States Constitution did not

extend its reach to protect a religious person from criminal prosecution for a crime based

on religious liberty. The Smith case was wrongly decided. For example, following

Smith it is now illegal for a Catholic Mass with eucharistic wine to held in a dry state or

county which prohibits the consumption of alcoholic beverages. Additionally, some

religious traditions use drugs such as LSD to help their members to develop spiritual

experience and mystical abilities which deserve protection under religious liberty. I

assert that the only exceptions to religious liberty should involve serious crimes such as

criminal assault, murder, rape, and child abuse. Additionally, religious liberty

protections should not extend to Satanic Cults which foster the base emotions such as

hate, greed, envy, and selfishness. Religious Liberty under the Constitution should

protect Wisdom Theology which is ordered toward the Individual Good as well as Reason
based Theology which is ordered toward the Good. Religious Liberty should only protect

religion which is ordered toward Higher Values not lower values.

Criminal Manslaughter Statutes are Unconstitutional

BY

Criminal Manslaughter Statutes and all criminal statutes based upon,

recklessness, negligence, or strict liability are unconstitutional as violative of Substantive

Due Process under the United State Supreme Court case, Lochner v. New York (1905).

The legal analysis goes like this. All American Citizens are Freeman for purposes of the

British Constitution Magna Charta. Magna Charta provides in the Freeman Clause that

a person cannot be deprived of their liberty or property without a jury trial under the Law

of the Land. The Law of the Land includes Natural Law, Equity, and the English

Common Law at the time of Magna Charta in around 1250 A.D. The Due Process

clauses of the 5th Amendment and 14 Amendment of the United States Constitution are

based upon the Law of the Land of Magna Charta as found in the United States Supreme

Court cases dealing with due process. Magna Charta requires that for a crime to be

charged there must be Mens Rea (specific intent) and Actus Reus (overt action). In the

case of manslaughter based upon criminal negligence and securities fraud based upon
reckless intent, or strict liability crimes such as speeding, it is clear there is no Mens Rea

or specific intent present and therefore such a statute violates Magna Charta and

Substantive Due Process under the United States Constitution and is therefore facially

void and unconstitutional.

Ethical Matrix. This is an objective approach to law.

If you stop and think about it, Cultural Relativism is Bullshit. There are a

number of ways of proving this, but the easiest is this way. Let us deconstruct the word

“Culture.” In fact there really aren’t any cultures they are all just reified concepts which

are totally indeterminate. Let us consider “African Culture.” Africa is a reified concept

which has little if no meaning. Black Americans are trying to discover African Culture

and are failing because there isn’t any. Let us take two African tribes the Bantu and the

Waziri. In fact, these tribes are enemies and have nothing to do with each other.

Additionally, the only persons who really understand what is going on with a tribe are the

Shaman of the tribe and they don’t ever really tell you much because they would lose

some of their power. From what we can tell, African tribes are animist, they believe that

there are Spirits for every animal, plant, and person. The problem with teaching this is a

public school is that this is a form of theology which is banned by the First Amendment.

Additionally, in Roman Catholic Schools animism is typically considered to be heresy

and thus cannot be taught. Finally, one suspects that no one really knows what African

tribes have for their Spirituality, instead “African Culture” is fabricated by some white

academic who doesn’t like logic or metaphysics. What is true of African Culture, is true

of most cultures. Unless culture is based upon reason, logic, and metaphysics, then

culture is just bullshit.

Some think, wrongly, that Procedural and Substantive Due Process Clauses of the

United States Constitution, were the invention of jurisprudentialists following the

American Civil War. In fact, Due Process finds its root in the Freeman’s Clause of the

British Constitution Magna Charta, signed by English King John and Pope Innocent the

III in the year 1215. The Freeman’s clause of Magna Charta states that no one can be

deprived of his or her liberty or property without a jury trial of one’s peers under the Law

of the Land. The Law of the Land is obviously those Natural Rights Based upon Natural

Law that were later found in the Declaration of Independence and the Bill of Rights and

Fourteenth Amendment of the United States Constitution.

Additionally, it should be noted that Colonial America also had a Due Process

Clause in the Province of Pennsylvania. In the Pennsylvania Charter of 1681 granted

by King Charles II of Great Britain to William Penn, William Penn was authorized to

establish a criminal and civil court system subject to the limitation that all law of
Pennsylvania must be in accord with reason. Obviously, the reason clause of this

Charter means that everyone is entitled to a reasonable procedure and reasonable

substantive laws. .

violating the General Agreement on Tariff’s and Trade (GAAT). GAAT provides that

an employer cannot have an unreasonable barrier to a service industry, namely

employment. It is irrational not to hire or fire someone who is smart. Smart people get

the job done, that is why they are smart. Overqualified people get the job done too.

Overqualified people do a better job not a worse job. GAAT makes illegal such Satanic

In the Catholic tradition many kudos are given to Mystics but in fact being

High Level Mystic can be a dangerous profession. Psychiatrists don’t like Mysticism, it

religion is conventional bullshit and that spiritual experience is schizophrenic.

Additionally, in the Church Mystics are spiritual and political leaders and this upsets

the hierarchical organized church of the Bishops and Popes. So the smart move is to put

Being on your Chakra Stem at Level 1 and to only believe in God on Illeration at Level 3

If you put God on your Chakra Stem at Levels 1 or 2 then that God, according Depak

school because they throw up in gross anatomy class where they are required to cut up

unreasonable barriers in a service industry such as being a medical doctor. There is no

reason for any medical students but surgeons in an advanced class to dissect a corpse.

Gross Anatomy for non-surgeons could be taught with a text book or a computer

simulation if available. The current medical school requirement all medical students

take Gross Anatomy is clearly an unreasonable barrier to the service industry of being a

doctor and is legally required to be abolished.

Some people think, wrongly, that The General Agreement on Tariff’s and Trade

true. Let us, for example, consider the Employee at Will Doctrine. In most States in the

United States employees are Employees at Will who can be fired at any time for a non-

discriminatory reason, for any reason, or no reason at all. On the contrary, under GAAT

there can be no unreasonable restrains on trade in a service industry. It is clear that the

Employee at Will Doctrine is an unreasonable restrain on trade which is a barrier barring

qualified employees from working for particular employers. Additionally, GAAT bars

any discrimination in employment that is based upon an arbitrary or unreasonable

category or classification. With GAAT an employee can only be discharged for Just

Cause Shown in Federal Court.

Little Joshua came up to Jesus of Nazareth, and said, “Please Sir, could tell me

one of your wonderful stories?” “Certainly,” said Jesus, why don’t you sit down and

make yourself comfortable.” “O.K.” said Little Joshua. Jesus said, “Once upon a time

there were Three Little Pigs. Each Pig was told by God the Father to build a house for

that Pig to live in. The First Little Pig built his house out of straw and finished very

quickly. The First Little Pig then went and laughed at the Second Little Pig who was

building his house out of sticks and who took longer to build his house. When the

Second Little Pig was finished building his house made out of sticks, the First Little Pig

and the Second Little Pig went to watch the Third Little Pig build his house. The Third

Little Pig was building his house out of bricks. The First Little Pig and Second Little Pig

laughed at the Third Little Pig for taking so long to build his house. Finally, the Third

Little Pig finished his brick house and each Little Pigs went to his respective house and
went to sleep. During the Night a Big Bad Wolf came to the First Little Pig’s House.

“Little Pig,” said the Big Bad Wolf, “open the door so that I can devour you.” The First

Little Pig said, “Big Bad Wolf, I am safe in my Straw House and I will not come out.”

The Big Bad Wolf took a deep breath and blew the First Little Pig’s Straw House down

and devoured the First Little Pig. The Big Bad Wolf belched, and then went to the

Stick House of the Second Little Pig. “Little Pig,” said the Big Bad Wolf, “Open the

door so that I can devour you.” The Second Little Pig said, “Big Bad Wolf I am safe in

my Stick House and I will not come out.” The Big Bad Wolf used his claws to tear at the

sticks until the Stick House fell down. The Big Bad Wolf then devoured the Second

Little Pig. After belching, the Big Bad Wolf went to the Brick House of the Third Little

Pig. “Little Pig,” said the Big Bad Wolf, “Open the door so that I can devour you.”The

Third Little Pig said, “Big Bad Wolf I am safe in my Brick House and I will not come

out.” The Big Bad Wolf then huffed and puffed and tried to blow down the Brick House

of the Third Little Pig, and failed. The Big Bad Wolf then clawed at the Brick House of

the Third Little Pig to try to tear it down, and failed. Finally, the Big Bad Wolf got a

Ladder and climbed up onto the roof of the Brick House a went down the chimney. The

Big Bad Wolf fell into a Pot Boiling Water and was cooked to death. The Third Little

Pig then devoured the Big Bad Wolf for dinner and then had his friends over for leftovers

the next day.

“Sir,” said Little Joshua,”This is a wonderful story, what does it mean?” Jesus

replied, “Well, Little Joshua, the First Little Pig chose selfishness as his Binding Spell

and chose poorly, and thus was devoured by Satan. The Second Little Pig chose the Evil

as his Binding Spell, and chose poorly, and was devoured by Satan. Finally, the Third
Little Pig chose The Individual Good of the Third Little Pig as his Binding Spell and

devoured Satan. Only, the Third Little Pig chose wisely.”

“Jesus,” said Little Joshua, “I am choosing the Individual Good of Little Joshua for

my Binding Spell.” “Excellent choice,” said Jesus, “you now have a wonderful existence

ahead of you.”

Liberation Theology North American Style

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

Liberation Theology North American Style builds upon the work of liberation

theologians such as Boff, Guitierrez, Segundo, and Arrupe. However, Liberation

Theology North American Style (LTNAS) differs in that it incorporates material from

spirituality, cognitive psychology, and liberal political theory.

LTNAS starts with individual cognnitive liberation. Cognitive liberation starts

with the idea that you must know reality before you critique it or act in relation to it. One

starts with the self appropriation of consciousness (Lonergan), where one experiences,

experience, understanding, and judgment; where one understands, experiences,

understanding and judgment; and where one judges that one knows reality best through

the interrelated acts of experience, understanding, and judgment.

LTNAS then moves to Metaphysical Liberation. In Metaphysical relation one

understands and knows that the four primary Metaphysical Quiddities are Being, Logos,
Substance, and Form. Additionally, one must begin to be an Intuitive Mystic and learn

to Intuit Being. (Fejfar)

Next, one must appropriate Ethical Consciousness by integrating the Ethical

Matrix, and the Ethical Principles of Reciprocity, Utility, Proportionality, and Equity.

With respect to Utility, in particular one must self appropriate the existential Liberal

Scale of Moral Values of individual autonomy, individual enlightened rational self-

interest, individual self-actualization, and individual self-transcendence.

The remaining steps of LTNAS parallel those building upon earlier liberation

theology are found in my essay, “Law and Liberation Theology.” Those steps are,

respectively,

a. Social Critique of Unjust Social Structures

b. Liberative Social Political Action

c. Liberative Social Norming

d. Liberative Law

e. Liberative Law Enforement

Logical Phenomenology not Logical Positivism

By

Some people think, wrongly, that Logical Positivism should be based upon sense

experience. In fact, real Logical Positivism is Logical Phenomenology which involves

not only sense experience, but also spiritual experience, psychological experience, and

metaphysical experience. Logical Positivism must include logical proofs for God’s

Existence that are based upon irrefutable metaphysical assumptions. Similarly,

developmental psychology discusses levels of consciousness that are found within the

mind and thus do not involve sense experience. Also, Transpersonal Psychology studies

higher levels of consciousness and spirituality. For example, there are empirical studies

which register the brain waves of zen meditators and find them to be different than those

of ordinary waking consciousness. There are also empirical studies proving the

existence and operation of Intuition. Finally, philosophy of science based upon

phenomenology is open to phenomenological experience, as such, without the limitations

of artificial labels such as “sense experience.” We should redefine Logical Positivism as

“rigorous logical inferences from phenomenal experience,” that is Logical

Phenomenology.

Chapter 48

Logical Positivism is Trashed

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

Logical Positivism since the Philosopher Comte has argued that reality is best

known through “rigorous logical inferences from sense experience.” In order for Logical

Positivism to be valid, human sense experience must be a reliable indicator of reality. In

fact, sense experience is not a reliable indicator of reality. Recall that the Five Senses

are:

1. Taste

2. Smell

3. Touch

4. Sight

5. Hearing

With respect to taste, it is clear that taste functions inconsistently based upon

provisional circumstances. For example, if you place sugar in your mouth and then eat a

piece fruit, the fruit will no longer taste sweet, when in ordinary circumstances it would
taste sweet. Taste is also affected if you eat something very sour before eating a piece of

fruit.

With respect to smell it is clear that your sense of smell can change if you have

smelled something just beforehand such as smoke or shit. For example, long term

cigarette smokers typically have a reduced sense of smell.

With respect to touch, it is clear that your sense of touch can be affected by prior

experience. For example, if you lift hand barbells for one half-hour your sense of weight

changes. At first objects seem lighter and as you tire your muscles they seem heavier.

Also, we must consider touch in relation to temperature. If the wind is blowing the air

seems much colder to the skin than when it is calm. Also, if you place a warm rag on

your hand for 5 minutes your sense of temperature will be affected. The same is true if

you place ice cubes on your hand.

With respect to sight, sight is not reliable. Many people are near sighted or far

sighted and see a blurry world all the time. Additionally, if you are near sighted or

farsighted and wear glasses the world you see is smaller than the one that really is there.

This is just like the mirrors that are on cars which say that the object is nearer than what it

appears in the mirror. Finally, if you place a straight wooden rod or dowel in a glass tank

of water and look at it from a side angle the dowel appears to be crooked.

With respect to hearing, it is clear that the human ear does not hear everything that

a dog, for example, can hear. A dog using dog sense experience can hear a high

frequency pitched dog whistle while a human being cannot hear it.

Finally, Philosopher Emmanuel Kant and Bernard Lonergan wrote that the world

of meaning at Level 2, known as the noumenal world is all that we know after we have
reached the age of 2 years old. The phenomenal world of sense experience is mediated

by meaning and therefore we cannot know it without Intuition at Level 3.

Bernard Lonergan trashed St. Anselm’s Proof for God’s Existence. St. Anselm

argued that God that which nothing greater than which can be imagined. Anselm argued

that since he had this idea, God then really existed. Lonergan, on the other had argued

that St. Anselm’s proof was faulty because the proof only applied on the level of ideal

logic not the real. Using Thomas Aquainas, I have a new proof for God’s Existence

which meets the requirements of Lonergan’s critique. The Proof is as follows:

1. I experience the Universe as Caused by the First Cause.

2. I understand the Universe as Caused by the First Cause.

3. I Judge that the Universe is Caused by the First Cause.

4. The foregoing operations use human reason.

5. Human reason must have an Origin and an End.

6. Reason or Logos is the Origin and End of human reason.

7. I experience the Universe as reasonable.

8. Reason is both the Origin and End of the Universe as well as the Origin and

end of human reason.

9. God is defined as that Reason of which there is no greater Reason.

10. I experience God as Reason.

11. I understand God as Reason.

12. I judge that God Exists as Reason.

Lonergan’s Mistake

Bernard Lonergan asserted that we can know reality at 100 accuracy with a

Virtually Unconditioned Judgment fact at Level 3. In fact, at Level 3 only a probable

judgment of fact is possible. 100 percent realty is impossible at Level 3, instead the

highest reality possible is reality at 99.999999999% real probability in the real world.

What happens is that the mind takes the aunitary probable world at 99.999999% and

using autoconsciousness constructs a world of 100% reality.

Now, it is also apparent that Lonergan did not adequately distinguish Level 2

Understanding from Level 3 Judgment and Reflection. In fact, Level 2 Understanding

is primarily rational analytic understanding and Level 3 Judgment and Reflection is not a

rational logical function but instead involves Level 3 Wisdom which is arational and

intuitive. This is what distinguishes level 2 from Level 3.

Chapter 51

Obedience to Authority

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

In Saint Paul’s Epistle to the Romans, Saint Paul says that Christians should be

obedient to civil authorities. What Saint Paul really means here is that we are to be

obedient to reasonable civil authorities. Saint Paul says we are only to respect those

authorities who deserve respect. The only civil authorities that deserve respect are those

which are reasonable. When the policies and orders of civil authorities violate Natural

Law based upon reason, we have a moral duty to disobey them. Reason requires that we

follow the Ethical Matrix with the Natural Law Principles of Reciprocity, Utility,

Proportionality, and Equity. Morality requires that our moral values be based upon

autonomy, enlightened rational self-interest, self-actualization, and self-transcendence.

The State cannot require us to violate Natural and be unethical and immoral. Instead, as

Thomas Aquainas human law is only to be obeyed when it is in accordance with Natural

Law.

Old Testament Saints

Catholic Tradition states that there are certain Old Testament Saints, some of

whom were Pagan Catholics such as Plato, Aristotle, Socrates, and Heraclitus. Plato,

Aristotle, Socrates and Heraclitus all presaged Christ the Logos by teaching about

Reason and The Good prior to Christ teaching this on Earth. Heraclitus taught that the

nature of Reality is Daoist and also taught Reason or Logos. Aristotle taught us about

Logic, Being, and Science. Plato taught us about the Immutable Platonic World of the

Forms and about the The Good, that is, The Individual Good.

In Palestine we have the Old Testament Saint of Jacob, Joshua, Moses, Joseph,

Seth, and Isaiah. Jacob taught us to wrestle with God when we think he is wrong.

Joshua taught us about the power of gray magic in bringing down the walls of Jericho.

Moses taught us about the Power of God in parting the Read Sea, and giving us the Ten

Commandments. Joseph taught us about gray magic and being a Seer and about political

power. Seth taught us to choose the Individual Good and Wisdom to avoid being
murdered by Cain who chose Evil. Isaiah taught us about social justice and justice and

prophesized the coming of Jesus Christ the Logos.

Papal Infallibility and Papal Indefectibility

The real Papal Infallibility is Papal Indefectibility (Kung). Papal Infallibility at

Vatican I stated that the Pope, speaking Ex Cathedra, on behalf of Faith and Morals,

speaking on behalf of the Consensus of the Whole Church, has that infallibility that

Christ desires for His Church. The Infallibility that Christ desires is that of Papal

Indefectibility where Papal Indefectibility is defined as that certainty which at its’ highest

level is reasonable scientific certainty, or 99.9999% reasonable probability in the real

world. The Pope cannot teach anything on the basis of absolute certainty.

Profit Maximization and Dividends

Some people think, wrongly, that the measure of a company is determined by the

dividend the company pays to the shareholders. When management takes into account

that the company should profit maximize in the long term, then it is apparent that there is

no duty to maximize corporate dividends in the short term. Management should pay the

least amount in dividends consistent with maintaining its’ stock price. If your earning to

debt is good your stock price should be good and you should not have to pay a high

dividend. It is bad management to maximize corporate dividends for the shareholder.

Chapter 55

Rebellion Against Unjust Government

Natural Law requires that all law and governmental policies be reasonable. The

Substantive Due Process Clause of the American Constitution and the British

Constitution Magna Charta say the same thing based on Natural Law.

John Locke wrote that we all have Individual Natural Rights based on Natural Law

in the State of Nature preceding organized government. The Roman Catholic Church

holds the same position. We have a right to rebel against unreasonable government, and

even use force arms when non-violent strategies don’t work. The Sons of Liberty who

started the American Revolutionary War against the British Military Dictatorship of

Generals Howe and Cornwallis were denying Colonial Americans their Constitutional

Rights under Magna Charta and Natural Law.. This why the philosopher Camus said we

have the right of rebellion against tyranny.

Relativism and Evil

Some relativists think, wrongly, that good and evil do not exist. In fact, the

commonly accepted definition of relativism is that “everything is relative.” Now, given

the foregoing it clear that relative good and relative evil exist. Therefore it still makes

sense to talk about good and evil with students from grades school through graduate

school. Constitutional Democracy and the Adversarial System accommodate both

relative good and relative evil.

Roman Catholic Excommunication and International Law

Under Roman Catholic Canon Law the Pope and Bishops have the power of

Exommunication the effect of which is for the person on the receiving end to be denied

the Roman Catholic Sacraments, including Confession. As practical matter those who

are excommunicated are banned and often scapegoated and persecuted.

Now, the United Nations Universal Declaration on Human Rights provide that

everyone has a right of religious self-determination. Therefore, once a person leaves

that Catholic Church and chooses another church, such as the Episcopalian Catholic

Church, under International Law such person cannot be excommunicated.

Chapter 58

God, Scientific Objectivity and Quantum Objectivity

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

13. experience the Universe as Caused by the First Cause.

14. I understand the Universe as Caused by the First Cause.

15. I Judge that the Universe is Caused by the First Cause.

16. The foregoing operations use human reason.

17. Human reason must have an Origin and an End.

18. Reason or Logos is the Origin and End of human reason.

19. I experience the Universe as reasonable.

20. Reason is both the Origin and End of the Universe as well as the Origin and

end of human reason.

21. God is defined as that Reason of which there is no greater Reason.

22. I experience God as Reason.

23. I understand God as Reason.

24. I judge that God Exists as Reason.

Given the fact that we have proved that God exists, it also apparent that Reason and

reason exist and operate. Scientific objectivity is back. God uses Reason as the
Objective Observer of the Quantum Field and therefore Quantum Indeterminacy at Level

4 is gone and in its’ place is Quantum Objectivity.

Social Responsibility of Business and Profit Maximization

Some people think, wrongly, that you make more money with a company if you

attempt to profit maximize in the short term. In fact this is stupid management.

Strategic management teaches that one must attempt profit maximize in the long run at

the expense of short term profits.

Fear paralyzes creativity and attention to

business.

Solving the Catholic Priest Shortage

The cost of a Catholic Seminary Education is outrageous. Also, the cost of

Novitiate for Catholic religious life are also outrageous. Additionally, both involve

GAAT violations under International Law. Finally, most men who enter the seminary or

novitiate wash out and quit or are asked to leave. My solution to this problem is to have

a short Diaconate Course involving one semester with a class dealing with Practical

Sacramental Theology, that is, how to perform the sacraments. I would only require a

simple living vow and a clelibacy vow, the of which could be dispensed if the Deacon

really needs to get married. Deacons would not be allowed to remarry when over the age

of 40 without a dispensation. After 5 years in the Deaconate a Deacon could be given a

dispensation to say Mass, or alternatively, be ordained a Priest. Deacons are allowed to

perform all the regular sacraments except Mass, and must perform a communion service

instead. This is a good solution practically, and financially to solving the Priest shortage.

In the news we hear about gay men, and bisexual men, and heterosexual men,

but there are also Straight Men. Straight Men have a Greek Soul with the following

structure: 3. Masculine Spirit

2. Feminine Soul which is Lesbian

3. Male Physical Body

Now, Straight Men are the Artists, the Poets, the Warrior, the Espionage Agents,

that are not homosexual. They do not have sex with men, only with women. Straight

Men have the Basic Emotions while homosexual men have the Base Emotions.

Submissive Wives

Some women think, wrongly, that marriages should be matriarchal with the wife in

charge. This is wrong. Saint Paul, in his Letter to the Ephesians, states that wives

should be submissive to their husbands. Similarly, in First Timothy, Saint Paul states that

women cannot have authority over men. I argue, that the real principle is that women

must obey the reasonable authority of men, including wives accepting the reasonable

authority of their husbands.

Taoism vs. Daoism

Teaching the Logic to Preschool Students

Developmental Psychologist, Piaget, states that children are in concrete

operations in preschool and kindergarten. Therefore, you must use manipulatives to

teach Logic to them. Consider the following.

Give the child an apple and an orange. Get the child to describe the differences

between the apple and the orange. Then have the child agree with you that the apple is

not the orange. This is the Logical Rule that A is not B.

Now, the exercise involves the following.

Give the child an apple in his left hand. Have the child agree that there is an apple in his

hand. This symobolizes the idea the A is true. Then have the child put the apple

behind his back and hold out his empty hand. This symbolizes the idea of not A is true.

Then ask the child to agree that the left hand either has the Apple (A) or no Apple (not

A). This symbolizes the idea that you cannot have A and not A at the some time. This is

the concrete proof of the Rule of the Excluded Contradiction.

The Epoche’ is an Intuitive Function

Philosopher Emmanuel Kant asserted, correctly, that in the typical situation, one can

only know the Noumenal World, which is constituted by Meaning (Lonergan). Thus,

after Kant and Lonergan, Hume’s Empiricism and Comte’s Logical Positivism are dead

and buried. However, the Philosopher Husserl asserted that one could invoke the

Epoche’ and find the Phenomenal World. How do we reconcile these two apparently

contradictory positions of Kant and Husserl? We must follow the Philosopher Bergson

and assert that the Epoche’ is an Intuitive Function not really sensory. Thus, we find

support for Logical Phenomenology not Logical Positivism or Empiricism.

The American Bar Association (ABA) McCrate Report specifically states that

all substantive law classes in ABA accredited law schools should integrate section dealing

with Jurisprudence, Values, and Ethics. Unfortunately, some schools are violating the

McCrate Report and are teaching Logical Positivism which refuses to recognize the

validity of Jurisprudence, Values, Ethics, Critical Philosophy, and Theology.. Law

Teaching must reject Logical Positivism which is forbidden by the ABA and his trashed

by critical philosopher for over 400 years. Logical Positivism is merely window dressing

for atheistic materialism and Satanism. Instead of Logical Positivism, Law Teacher

should use Logical Phenomenology which is open to discussions of Jurisprudence,

Ethics, Values, Critical Philosophy and Theology. Additionally, I argue that Logical

Positivism promotes totalitarian political parties such as the Nazi and Communist parties,

and therefore violate the National Security Act.

The Apostle Anthony

I have waited over ten years to have the courage to report this, and here it is. I,

Anthony J. Fejfar was sitting in a chair in a hallway in the school at Saint Joan of Arc

Parish when my son Josh left with his C.C.D. class to go over to Saint Joan of Arc

Church. I was a little surprised that they were leaving the school so I decided to follow

them over to the church. Josh’s class sat down in the rear right of the church and I sat

down in the rear middle of the church. I had a premonition that something bad was going

to happen to Josh. There were over 40 Roman Catholic Priests in the church for some

reason and it seemed that they wanted Josh up on Alter for some reason. It seemed as

though they wanted to Crucify him for some reason. I reached out with my mind and

stopped this from happening. Then, Jesus Christ appeared as a Psychic Apparition on

the Altar and by elecutions stated, “Anthony J. Fejfar is the Apostle Anthony, The

Modern Apostle.” Then Jesus disappeared. I saw Jesus in my preconscious mind. I

have no idea if anyone else saw Him. My Intuition tells me that I am the reincarnation
of Saint Thomas the Apostle, also known as Thomas Judeas Didimous, Saint Jude the

Apostle, First Cousin of Jesus Christ. I felt I needed to record this for human history at

this point.

Chakra. The Basic Emotions are developed through education, mediation, prayer, and

practice.

On the other hand, the Base Emotions are based upon the Cardinal Vices such as

envy, sloth, gluttony, jealousy, selfish love and greed. Often the Base Emotions are

developed through participation in a Satanic Cult and in using such drugs such as

Cocaine, Opium, and Heroin..

The Catholic Church in America and GAAT

© Copyright 2009 by Anthony J. Fejfar

The message to Catholics for the last 30 years is that we should only have

Catholic Priests who say Mass and hear confessions and nothing. Therefore, the only

reasonable requirement for ordination to the Catholic Priesthood is taking a course in

Sacramental Theology. This could be done at any Catholic University with a Theology

department. Catholic seminaries are a GAAT violation. Additionally, it is clearly a

GAAT violation not to have women Priests. All you have to do to become a Catholic

Priest in America is take a course in Sacramental Theology and sue for a permanent

injunction in Federal Court, under GAAT with Federal Question Jurisdiction requiring the

bishop to ordain you. Also it is a GAAT violation to require Priests to take Poverty,

Chastity, and Obedience. Bishops who do not comply with a Federal Court Injunction

can be put in jail for contempt of court. The foregoing arguments also apply to

Protestant Seminaries.

The Catholic Eucharist

Some think, wrongly, that in a Catholic Eucharist, the bread and wine are

transformed into the material Body and Blood of Christ. In fact, this would cannibalism

and represents a misplaced atheistic materialist view of the Eucharist. The Council Trent

states that the true doctrine of the Eucharist is Transubstantiation.

Transubstantiation transforms the material bread and wine into the Sustantial

Body and Blood of Christ. Substance is the Metaphysical Quiddity which underlies the

Holy Spirit. Substance is what the philosopher Bergson denominates The Absolute, or

Absolute Relationality. Thus, the bread and wine as matter of material accident remain

the bread and wine on the surface, while the Essence or Substantial Form of the Eucharist

is the Body and Blood of Christ in Substance. Only atheist materialist Catholics and

theologians would be stupid enough to equate the material with the substantial reality.

The true position of Transubstantiation is consist with the Council of Nicea’s statement

that God the Father and God the Son are One and Same Substance, namely the Holy
Spirit. Keep mind that the Substanital, although metaphysical is still physical in some

sense.

The Cause of the Great Depression

Some people are worried that the current recession could turn into a Depression.

This need not happen at all if a little common sense is used. First, there is no real crisis in

Wall Street, corporate earnings are up. It is a great time to buy stock. In point of fact, if

you follow the news carefully the brokerage firms who are in economic difficulty are not

stock brokerage firms but are real estate brokerage firms. I suspect that these firm gave

their shareholders huge dividends in last couple of years instead of placing the money in

their corporate reserve accounts. All these real estate brokerage firms have to do is

forclose on the mortages securing the loans.

Next, the Great Depression of 1929 was caused because the United States mints did

not print enough dollars. The “economic cycle” of a recession or depression following a

boom economy is only caused because there is not enough cash in circulations and people

lose confidence in banks and this affects the stock market. If President Obama is smart

he will tell the Federal Rererve Board to have the U.S. print more money and also to use
Federal Reserve Economic Development money to fund a national, state by state,

Workfare volunteer program which includes working for private companies, and

churches.

When one deconstructs the account of the Garden of Eden found in the Book of

Dao. When you stop and think about, if everything was so good in the Garden of Eden

prior to the temptation and Fall of Adam and Eve, then why is it that Satan the Serpent

is in the Garden of Eden? Obviously, the Garden of Eden represents the Dao of Good

and Evil. Adam and Eve were forced to choose The Good in the Garden of Eden by

God and therefore easily became victims of Satan. Seth, on the other hand , chose

Wisdom which is in the Dao of Good and Evil and was able to have a good life. Recall,

that Adam and Eve, as a result of the Fall developed the Original Sin of Conventional

Morality and Conventional Reality which are Satanic in Nature. Most people flip flop

back and forth between being religious fundamentalists and Satanists without even

knowing it. It you choose Wisdom, you win in the long run.

The Mentally Ill are welcome in the Episcopalian Catholic Church. In fact, the

Episcopalian Catholic Church encourages those who are Mentally Ill to consider

persons who have backgrounds in Catholic Theology and Philosophy or who are self-

Priests.

The Episcopalian Catholic Church is Technically Protestant

By

© Copyright 2009 by Anthony J. Fejfar

The Episcopalian Catholic Church is technically Protestant because the

ordination of Priests and Bishops is by the Power of the Holy Spirit and thus makes the

Episcopalian Catholic Church a Protestant Evangelical Church. Episcopalian Catholic

Priests and Bishops are self-educated and do not to the seminary. To become an

Episcopalian Catholic you must, “Accept Jesus Christ as your Personal Liege Lord and

Saviour in Perpetuity, Amen.” To become an Episcopalian Catholic Priest you must

raise your arms to Heaven in an open gesture and say “I accept Ordination as an

Episcopalian Catholic Priest by the Power of the Holy Spirit in Perpetuity, Amen.” I

have done this, and thus I am an Episcopalian Catholic Priest. As an Episcopalian

Catholic Priest you can say a Home Mass with a Water Eucharist, by Blessing the Water

with your right hand, and saying “This Water is the Holy Spirit in Substance.”

The Episcopalian Catholic Church is designed to survive in the face of

persecution. In fact it is possible for Episcopalian Catholics to Channel or give and

receive Elecutions by the Power of the Holy Spirit from the Spirit World of Purgatory on

the other Side, or from other countries or planets. The Episcopalian Catholic

Church can be started or restarted in any age, or place, without the requirement of

physical missionaries to spread the word. In fact, Episcopalian Catholic Priests were

channeling to Eastern Europe to start Psychic Churches under the nose of communist,

atheist materialist repression. In fact, it is possible to say a Psychic Mass with psychic

participants who are at home apparently resting in bed. This is what brought the Wall

down in Eastern Europe.

Episcopalian Catholics are Protestant in a sense analogous to Anglicans and in

the same time in some way Catholic because they have the 7 sacraments with

evangelical ordination, including the sacraments of Confession and the Eucharist.

Episcopalian Catholics are Critical Thomists following Plato, Aristotle,

Socrates, Thomas the Apostle and and Thomas Aquainas. Episcopalian Catholic hold of

the Apostle Thomas not the Apostle Peter like Roman Catholics do. Episcopalian

Catholics cannot be charged with Penury or Theosphany for believing in, and following

Metaphysics, Spirituality, and Social Justice. Additionally, Episcopalian Catholics have

married Priests and Bishops. The Episcopalian Catholic Church also has women Priests.

Episcopalian Catholics are Freeman under Magna Charta. The Episcopalian Catholic

Church is not Anglican because Episcopalian Catholics do not recognize the authority of

the King of England, and in fact reject it. The Episcopalian Catholic Church believes in

Papal Indefectibility not Papal Infallibility. Finally, it is legal to start (or restart) the

Episcopalian Catholic Church because under Canon Law it is founded under the Name of

the Apostle Thomas, and, under Civil International Law, Individual and Group religious
freedom to start a new church is guaranteed by the United Nations Universal Declaration

on Human Rights which the United States and most other countries, including Italy, have

signed.

The Ethical Matrix Again

The Ethical Matrix is an Ethical Decision-making Tool that I, Anthony Fejfar have
developed. It took me 5 years of research and experimentation to develop this Tool.

Principle I
Reciprocity

Judgment/Reflection Understanding
Intuition Thinking

Principle IV Principle III

Equity Proportionality

Love Experience
Feeling Sensation
Will

The GRE for Law School not the LSAT

As I have written previously, the Law School Admissions Test (LSAT) is bullshit.

The LSAT does not test any skills that are really used in law school and law practice and

produces mediocre students and lawyers.

I have reviewed the Graduate Record Exam (GRE), and it tests skills that are

used by law students and lawyers. The GRE has reading comprehension, math, and

analogical reasoning on the exam. The GRE should replace the LSAT as the test that is

used for law school admissions.

In the Gospel of Thomas in the Nag Hammadi Library Jesus discusses the Water

Eucharist and the Holy Spirit. Jesus says:

I am not your teacher. For you have drunk and you have become

Intoxicated at the Bubbling Spring that I have measured out for you.

The Bubbling Spring that Jesus refers to is the Water Eucharist of the Holy Spirit where

the water is blessed as “This water is the Holy Spirit in Substance.”

The Inquisition of Satan by Jesus Christ

An Allegory

Jesus of Nazareth was driven into the desert by the Holy Spirit, while he was

there Satan appeared to him and tempted him with three questions. Jesus said, “Well,

Satan, if you answer my questions I will answer yours.” Satan agreed.

Jesus was hungry. Satan said to Jesus, “If you are the Son of God, command this

stone to turn to bread.” Jesus replied, “Scripture has it, not on bread alone shall man

live.” Then Satan transported Jesus high above the Earth and said, “If you worship me I

give you power over all the kingdoms of the Earth.” Jesus replied, “You do homage to

the Lord your God and Him alone you shall adore.” Finally, Satan took Jesus to the

paraphet of the Temple and said, “Throw yourself down from here, for scripture has it

that the Angels will protect you.” Jesus replied, “Scripture has it, You shall not test the

Lord your God.”

“Now Satan,” said Jesus it is my turn to ask you some questions.” “Would you

agree, that Evil exists?” “Yes,” said Satan “I guess I would have to agree.” “Next,” said

Jesus, “Would you agree that you, Satan, are Evil?” Satan thought about it, and said,

“Yes, I agree I am Evil.” Jesus said, “Would you agree that following the Pagan Greeks

that Evil is a lessening of The Good?” “Yes, I agree.” said Satan. “Then, logically,”

said Jesus, “would also agree that Evil involves subtractive magic?” “Yes,” said Satan,

“I am bound by logic and that logically follows.” “Excellent,” said Jesus, “then would

also agree, logically that you, Satan, are subject to subtractive magic?” “Yes” said Satan.

“Then,” said Jesus, you must conclude, logically, that you Satan will soon go out of

existence.” “Yes,” said Satan, and Satan then disappeared and went out of existence, only

to appear as Saint Anthony the Archangel, devoted to the Individual Good.

The General Agreement of Tariffs and Trade (GATT) provides that there can be no

unreasonable barriers to participation is a Service Industry such as being a Jesuit. I spent

one semester in the Jesuit Novitiate, Wisconsin Province, and I can testify as an expert in

Law and Theology that there is no reasonable relationship between the Jesuit Novititate

and life in a Jesuit Community with Jesuit Ministry. If you want to be a Jesuit you

should sue in Federal Court under GAAT and make them waive the Novitiate. If the

Jesuits wish to avoid this outcome they should reform the Novitiate.

Many Graduate Programs, including Phd and Mdiv programs have a foreign or

classical language requirement. This requirement is a violation of the General Agreement

once they are out of graduate school. The requirement is just a satanic requirement to

keep out people who do not have past life experience with a language reincarnationally or

who are not psychic. Almost everyone does their academic research in American

English in the United States and the language requirement is an unreasonable restraint on

trade under GAAT.

The Law Bar Exam is a GAAT Violation

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

I served on the Pennsylvania Board of Law Examiners as an Academic

Representative for several years and one of the other academics made the point that

empirical studies show that there is no statistical correlation between passing the bar

exam and the competent practice of law.

The General Agreement on Tariff’s and Trade, an international treaty that the

United States signed in 1995 states that you cannot have an unreasonable barrier to

participation in a service industry such as law practice. Similarly, the Substantive Due

Process Clause of the United States Constitution provides that all laws must rationally

related to a legitimate state interest. Also, 42 U.S.C. section 1983 states any action by

a person, under Color of State law, which violates civil rights such as Substantive Due

Process Clause and GAAT, is liable for damages

Therefore, anyone with a C+ grade point average, or better, in my opinion, who

does not have a passing score of the Bar Exam, has a cause of action against the Bar
Examiners. Given, the nice people on the Board of Law Examiners, the Supreme

Court would advised to abolish the Bar Exam accept in the anyone with a C+ grade point

average or better from law school.

The Logic of Logical Positivism

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

The accepted definition of Logical Positivism is: “the only information

that is valid is that which comes from rigorous logical inferences from sense

experience.” Previously, I have argued that sense experience is an unreliable

indicator of reality because of existence of sensory illusions and because the

central nervous system filters out much of our sense experience.

Now, I would like to make the argument that there is no universally

accepted canon of Logic. For example, I have come up with a new logical rule

that:”a a concept which cannot allow for its own existence is fallacious and

invalid.” So, for example, I have argued that refication, as described by

academic Peter Gabel is invalid because: “reification is itself a reifed concept

and therefore invalid.” Now, the question is whether everyone will accept my
new rule as valid. Many may not, and therefore, once again we cannot say that

Logical Positivism is a valid philosophy.

Further, one might note that Logical Positivism itself, as defined above, is

not itself based upon rigorous inferences from sense experience. In fact the

whole idea of Logical Positivism is really Metaphysical and not itself based upon

sense experience.

The Logical Fallacy of Hypocrisy

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

Jesus of Nazareth criticized the Jewish Pharisees for hypocrisy.

Hypocrisy is Logical Fallacy. It is a fallacious argument to present a position

which involves a contradiction between statement and performance. This fallacy

is analogous to violation the logical rule of the Excluded Contradiction. See the

following:

1. assume A or B

2. from A or B derive A

3. A

4. from A or B derive B and not A

5. derive not A
6. A and not A is a Void proof violating the rule Logical non-contadiction also

known as the rule of the Excluded Contradiction.

You cannot perform an operation which results in a logical contradiction with the

beginning premise.

Chapter 88

The Logical Rule of the Excluded Contradiction

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009

For example, please consider the following:

1. assume A or B

2. From A or B derive A

3, From A or B derive B

4. From steps 2 and 3 derive A and B

Thus, it appears, that from A or B you can derive A and B.

While the foregoing may seem to make sense, please consider the following:.

1. A or B

2. From A or B derive A and not B

3. From A or B derive B and not A

4. From A and not B derive not B

5. From B and not A derive not A

6. From steps 4 and 5 derive not A and not B

Now, it is apparent that we have deduced logical opposites above with two equally

valid proofs using symbolic logic. In the first proof above we have A and B and in the

second proof based upon the same logical premises we have not A and not B, that is

logical opposites. To solve this problem we need the new real logic rule of the Excluded

Contradiction. The logical rule provides that you cannot have contradictory logical

opposites in the same proof. Thus, once you have derived A you cannot derive Not A,

its logical opposites.

Let us start again:

1. A or B

2. derive A

3. from A or B derive B and not A

4. from B and not A derive not A

5. derive not A

6. from step 2 and step 5 derive A and not A

7. derive A and not A

8. Void A and not A, false logical step because of the Rule of the Excluded

Contradiction. You cannot have two logical opposites in a logical proof.

incarnate and in a sense become the original person. I, on the other hand, argue that in

Unitary Reality there is only one person who in substantial form is Jesus Christ, or

Buddah, Lao Tzu. Now, the reason that there seems to be more than one of these persons

is that they reincarnate with their souls such that many of the Catholic saints, for

example, may have the soul of Jesus Christ reincarnationally. Additionally, Elemental

Magic used in Catholic Baptism gives the recipient all the Archetypes (Jung) of the

Saints, Archangels, Apostles, and Jesus, Mary, and Joseph. This also especially true if

you happen to be named with the name of Joseph, for example.

Plato saw that all of reality was structured by an infinite number of Immutable Forms.

He saw that the Forms acted in the Human Imagination or Collective Unconscious (Jung)

Those without the Higher Immutable forms are only guided by the Substantial Forms at

When I was kid we read Homer’s Illiad about the battle of Troy and we all

wondered where Troy located geographically. Later in high school I remember seeing a

science program on educational television which speculated that Troy was someplace in

Asia Minor where they found certain ancient ruins.

Recently, I watched the movie Troy with my parents Jim and Therese and began

to wonder once again where Troy was located. My historical opinion is that Troy was

not to the east as many historians think, but instead was the early Roman Empire located

on the Italian peninsula.. Greece and Italy are so close together that they each would be

a military and economic threat to each other. All other historical explanations are less

plausible in my opinion.

The Right to a Legal Attorney by a Mental Health Patient

Some argue, wrongly, that Mental Health Patients on a Psychiatric Ward have no

right to see a Legal Aid Attorney. In fact the case law is clear that such patients do have a

right to meet with a Legal Attorney in private even if the purpose of the representation is

to sue the Hospital or the Psychiatrist.

In State v. Shack, 277 Atlantic Second 369 (1971), the defendant was a Legal

Aid Attorney who desired to meet with a client who was a migrant farm worker on a

privately owned farm. The owner prevented the Lawyer from meeting with his client

and had him prosecuted for criminal trespass. The Court held that the Legal Aid

Attorney had a right to meet with the client, in private, on the farmer’s property and thus

was found innocent regarding the trespass charge. The Court noted that migrant farm

workers are isolated and in a disadvantaged position. The Court also stated that private
property rights are not absolute and must be interpreted in light of the Common Good.

Thus, the Court held that private property rights do not include the right to exclude a

Legal Aid Attorney where the client is isolated and in a disadvantaged position.

The case of State v. Shack clearly requires that Psychiatric Wards allow Legal

Aid Attorneys to visit with their clients, on the ward, in private even if the reason is to sue

the Psychiatric Hospital or the Psychiatrist for Malpractice or False Imiprisonment.

book places you in an Altered State of Consciousness. When this happens you must be

In the story of the Battle of Troy the Greeks are depicted as winning the battle by

the use of a huge artificially constructed horse which had Greek soldiers hidden inside

walls of their city.

I would like to suggest that the Trojan horse symbolizes Achilles. I argue that

Achilles was fed with the Greek Royal leadership and defected to Troy after killing

Prince Hector in battle. In exchange for releasing Hector’s body for a proper burial,

Achilles was made a Prince of Troy and married Helen, at which point the Greeks left

Troy. Once Achlilles became King of Troy he invited his Greek allies back and

founded the Roman Empire.

There is solid evidence that the early Catholics in Rome knew that the Virgin

Mary was the God-dess Minerva, God-dess of Wisdom. In fact, the Church Santa Maria

in Rome, named for the Virgin Mary, is built upon the Temple of Minerva. Minerva is

more than a goddess, She is the Holy Spirit of Divine Wisdom and an Archangel. In the

Magic Lore, the Virgin Mary, that is, Minerva, is the Fairy Godmother. The Fairy

Godmother, not God, guides the Magic World and is Good. Thus, while Catholics call

much clout on Earth, and still does. Mary is the person in the Bible who is responsible

for putting Aristotle’s Equity in the Christian Tradition. At the Wedding Feast, in Cana

of Galilee the hosts ran out of wine. Mary asked Jesus to perform a miracle and produce

more wine. Jesus told Mary that it was not yet his time to perform miracles, a rule at

law. Mary petitioned Jesus in Equity asking him to make an Equitable Exception and

Jesus did, turning water into wine. In fact the wine was so good that the people

commented that they were surprised because usually at a party the host saves the poor

The Wild Bunch from Dakota Territory was getting tired of robbing banks and

General George Custer in disguise, who along with his men really survived the Battle of

Little Big Horn after having been set up to die by Confederate General Terry. The

Pinkerton Detective Agency in Philadelphia which was also the United State Secret

Service was getting out hand. They had to be taught a lesson not to screw around with

the West. These eastern wimps had to be put in their place. TheWild West show started

in Chicago and moved to Pittsburgh and then to Philadephia. The Show had over 500

men in the Wild West Show and they used the opportunity to execute cover 1,500

Pinkerton Agents in Philadelphia. The Pinkertons started throwing garbage at the Wild
West Show actors and the actors, who were real Old West Scouts, Cowboys, and Indians

who had live ammunition in pistols and rifles, shot the bastard Pinkertons dead and then

robbed the First National Bank of Philadephia of Ten Million Dollars. They also stole

In the Gospel of Thomas, found in the Nag Hammadi Library, the Gospel states:

Jesus took Thomas and withdrew and said to Thomas:

But when Thomas went back to Jesus’ companions, they said to

Thomas: “What did Jesus say to you?”

Thomas said to them, “If I tell you the words Jesus said to me

You will pick us stones and throw them at me,

And a fire will come out of the stones and you will be burned up.”

What the foregoing means is that, while Jesus was the Son of God, Thomas was

God the Father. The disciples of Jesus would have been upset and would have tried to

stone Thomas to death for an alleged blasphemy. God (Thomas) would not have let this

happen and would destroy the disciples instead.

I like Tom Shaffer’s scholarship, but I must confess that Tom’s scholarship has a

few problem. Tom’s major ethical and scholarly position is his Ethic of Community.

Tom also claims to be a Thomist and an Aristotelian.

The problem, sadly, is that Tom’s Ethic of Community really means Cultural

Relativism, and possibly even an even more problematic Extreme Relativism which is

logically incoherent. Tom’s Cultural Relativism, sadly, also means Convention Morality

which is really mob rule. As I have written before, Conventional Morality is evil. The

problem is that those who deal in Conventional Morality are perfectly capable of

following an evil authority who requires his or her followers to torture and abuse persons

like the Nazi’s did.

Next, Tom claims to be a Thomist and an Aristotelian but Tom totally ignores

Thomistic and Aristotelian Metaphysics which are the basis for both philosopher’s work.
It fairer say Tom is not a Thomist or Aristotelian but instead is merely a cultural

relativist. As I have argued the better is to choose Critical Thomist and existential

individual relativism. So, as Jung broke from Freud so I must break from Tom Shaffer.

Why God is not a Reified Concept

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

Some academics in Critical Legal Studies have the reputation of Trashing God in

class at top ten law schools using the concept of Reification, arguing that God is reified

concept. In fact the traditional Critical Legal Studies concept of Reification as found

in Peter Gabel’s article is gone. I have trashed Gabel’s concept of Reification with the

following proof.

1. For a concept to be valid it must allow for its’ own existence to avoid

the problem of contradiction between statement and performance which is

the fallacy of hypocrisy.

2. Reification, defined, as treating and abstract concept as if it is concrete,

is itself and abstract concept, and therefore, reified and invalid.

Therefore, given the foregoing definition of reification God cannot be a reified

concept since Reification is an invalid concept.

Now, the new concept of Reification that I have developed is defined as

treating an abstract concept as if it is real, when it is not appropriate to do so.

This realification or reificaction is based on the idea that some concepts have

Illogical or contradictory or irrational or ambiguous definitions. Given, this

definition God, defined as the First Cause or the Unmoved Mover is not

reified.

Why Idealism and Realism Don’t Work

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

Some philosophers are Idealists, and some are Realist, but in fact neither

philosophy works. Idealism is based on the Idea that all of reality is based upon ideas.

Ideas structure reality. The problem, however, is that one might decide whether or not

ideas are real. Idealist say not. Because Consciousness, not Ideas, is the ultimate basis

for reality soon Idealists go out of existence because there reality is based upon the false

premises that Ideas are when in fact they are really imaginary.

Realist make the opposite mistake of Idealists. Realists say that Reality precedes

ideas; that ideas only secondary epiphenomenona of the mind. Additionally, realists

reject ideals as being invalid so that they reject ideals such as love, justice, truth, and

beauty. Realism also never last because it leads to atheistic materialism and nihlism.

Bernard Lonergan came up with the solution to the above problem by developing

his Critical Realist or Critical Thomist philosophy which Idealist Realist. It is apparent
that Critical Thomism involves a Dialectic or Dao of Idealism and Realism. The

ultimate basis for Reality is Consciousness or Substance. Platonism, as such, fails as a

form of Idealism. Only Platonic Realism or Neoplatonism works where the Immmutable

Platonic Forms are made from Substance.

The Logical Rule of the Excluded Contradiction

By

Some think, wrongly, that Logical Positivism is a valid position. This is not true.

Logical Positivism is based upon the idea that reality is best known through rigorous

logic inferences from sense experience. In fact we can see that there is no universally

accepted group of logical syllogisms, and therefore, Logical Positivism is invalid.

For example, please consider the following. A widely available text dealing with

symbolic logic states the following:

1. assume A or B

2. A (see 1)

3, B (see 2)

4. A and B (see 2 and 3)

Thus, it appears, wrongly, that from A or B you can derive A and B.

While the foregoing may seem to make sense, in fact the foregoing is not true.
Consider the following:

1. A or B

7. A and not B

8. B and not A

9. (A and not B) and (B and not A)

10. Not B

11. Not A

12. Not B and Not A

Now, it is apparent that we have deduced logical opposites above with two equally

valid proofs using symbolic logic. In fact, common sense tells us the following is true:

1. A or B

2. A and not B

3. Not B

4. A

Or the contrary in a different “world”

1. A or B

2. B and not A

3. B

The foregoing is what Walter Ong describes as the difference between place logic and

process logic. While first two proofs are true in the abstract only the second two proofs

are real in two different real worlds which are mutually exclusive. Thus, like Walter Ong,
I argue that place logic in the abstract is incomplete and instead one must use real logic

or process logic for true results.

Why Lonergan’s Canon of Parsinomy Does not Work

By

In Bernard Lonergan’s book “Insight” Lonergan describes the Canon of

Parsinomy, and the empirical method of science, as follows:

1. observation of data

2. insight into data

3. [generation of theory]

4. verification of theory

Insight page 79. Lonergan also states that the “data” referred to above must be based

upon sense experience. Id.

What Lonergan has essentially done is to argue for Ockham’s Razor and Logical

Positivism as a basis for science and human inquiry. I argue that Lonergan’s positivist

move is inconsistent with his discussion of God, Being, and Metaphysics throughout

Insight. Additionally, I have previously trashed Logical Positivism and Ockham’s Razor

as being irrational and false positions. Finally, it should be noted that with Quantum

Physics, the empirical method does not work because of Heisenberg’s Indetermincy

Theory.

Why Nuclear Power is Threat to National Security

Nuclear Power Plants are a threat to National Security. After the 9/11 Terrorist

Attack it is clear that the United States is vulnerable to terrorists attacks upon Nuclear

Power Plants which would destroy America. It is commonly understood that the only

reason that we really have Nuclear Power Plants, which are very inefficient in producing

electricity, is to produce weapons grade plutonium for nuclear weapons. It is much more

efficient to produce electricity with propane or natural gas fired turbine electrical

generating plants which produce minimal air pollution. Also, we can have large amounts

of electricity produced with wind generators and paddle wheel water electrical
generators. The need for Nuclear Weapons is over. There are conventional explosives

that produce a greater throw weight in terms of explosive power than nuclear weapons.

It the United States wants to have a first strike capability and due away with the

possibility of Nuclear Winter we should switch to conventional explosives in our bombs

and warheads.

Why Political Psychiatry is Criminal

An Allegorical Essay

Most psychiatrists are political psychiatrists. They love imposing their political

beliefs, which are typically Nazi or Communist on their patients. Usually this is done

through psychic channeling so that there is no proof. Psychiatrists tell their patients that

to get off the ward they must be homosexual and join the Nazi and Communist Party in

Prague or Berlin and change from Republican to Democrat or vice versa. Obviously,

this violates 18 United States Code section 242 and merits 10 years in Federal Prison for

the psychiatrist..

Why Psychiatry is a Threat to National Security

It would appear that most psychiatrists are atheist materialists and logical

positivists. Atheist Materialism is described in Karl Marx book, “The Communist

Manifesto.” Marx argued that God is an infantile illusion and the religion is false

consciousness. Sigmund Freud, the apparent founder of modern psychiatry was also an

atheist materialist who considered God an infantile illusion. Thus, it is apparent that

Freud and most psychiatrists are Communists and a threat to National Security in a free

democratic society.

Some think, wrongly, that Satan exists. In fact there really is no Satan that is the

source of Absolute Evil, there only relative evil with a certain contest by some demonic

entities to pretend to be Satan. Lucifer the Archanagel shifted by back in time to the

Foundation of Existence and became a Wisdom Archangel, Saint Anthony the

Archangel, Highest of all the Archangels. There is no Satan anymore, only lesser

Demons playing the part.

Why the Jesuit Social Justice Program Does Not Work

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

© Copyright 2009 by Anthony J. Fejfar

The Jesuit 31st and 32nd General Congregations speak to the responsibility of the

Jesuits to promote Social Justice. In fact, the Jesuit Social Justice Program is an

absolute failure. First, the Jesuit Constitutions state that a Jesuit cannot be a lawyer. If

the Jesuits ever expect to do anything with Social Justice they must have their own

lawyers. No Jesuit lawyers, no Social Justice. Next, Jesuits take poverty vows which

are supposed to mean simple living and a right to personal property as an equitable use.

In fact most Jesuit Superiors force the Jesuits under obedience to them to live in dire

poverty, often not even able to afford a personal computer or medical treatment. If you
are trying to eliminate poverty through Social Justice, how can you do this when the

Jesuits are poor themselves. It doesn’t work. Finally, Ignatius of Loyola, the founder of

the Jesuits stated that all Jesuit ministries must produce a profit. This does not work..

How can you expect a ministry to produce profit when you have a not-for-profit

corporation. Most ministries do not produce income but rely on donations. Think about

it.

Chapter 119

Why the Jesuits are Damned

By

Anthony J. Fejfar, B.A., J.D., Esq., Coif

I have a Jesuit higher education and I was taught to be an independent critical

thinker by the Jesuits. Then I went into the Jesuit Novitiate and I found out that the

Jesuits, internally are fascists and do the opposite of what they teach. The Jesuits are

hypocrites and Jesus said that hypocrisy is the worst mortal sin there is. The Jesuits take

vows of Poverty, Chastity, and Obedience. All three vows are absurd and irrational

With respect to Poverty, when each Jesuit takes a Poverty vow they do not follow

Canon Law and retain an Equitable Possessory Use, instead they can own nothing at all.

The are incompetent to own property, have credit cards, and lack the power to contract.
Under the law in most States each Jesuit could be given a Guardian for incompetency

after taking a Poverty Vow. The situation is so bad that Jesuit rooms in the Jesuit

Residences are required to be left unlocked and other Jesuits come in and steal personal

property from their fellow Jesuits all the time, even family gifts. Jesuits should take a

Simple Living Vow not a Poverty Vow.

With respect to Chastity, the situation is again absurd. Many Jesuit think,

wrongly, that a Chastity vow only applies to heterosexual sex, not homosexual sex and

then have Gay relationships in the community. Additionally, heterosexual men, if they

are not going out with women, often read Playboy Magazine and mastrubate to deal with

their sex drive. Homosexual Jesuits tell novices, wrongly, that mastrubation is a mortal

sin and that homosexual sex is not. Jesuit should take a celibacy vow prohibiting a

Roman Catholic marriage and not a chastity vow.

Finally, Jesuits are forced to take an Obedience Vow. This vow is absurd and once

again leads to the conclusion that Jesuits are incompetent and subject to a Guardianship.

There is no reasonableness requirement for Obedience, nor is there a requirement that

Jesuit commands under obedience must conform to Canon Law, Natural Law or Civil

Law. There is nothing which prevents a Jesuit Superior from ordering a subordinate

Jesuit who is a political enemy to commit suicide or murder some one. Thomas Aquainas

said that we are only required to follow reasonable authority not absolute authority and

this applies even in the Church and Jesuits. Instead of an Obedience Vow to a Superior

the following Vow Formula should be used:

Vow Obedience to the Transcendental Precepts:

1. Be Attentive
2. Be Intelligent

3. Be Reasonable

4. Be Responsible

5. Be Loving

6. Be Compassionate

Why the Law School Admissions Test (LSAT) is Bullshit

By

© Copyright 2009 by Anthony J. Fejfar

The Law School Admission Test (LSAT) has never been fair, and now it is

absurd. It has absolutely nothing to with legal reasoning and law practice. Lawyers

spend most of their time doing legal research and writing which best tested by reading

comprehension question which have eliminated from the LSAT. Also, an important part

of legal reasoning is reasoning by analogy. This should tested by question in LSAT like

those found in the Miller’s Analogy Test. There are no analogy question on the LSAT

and never have been. Additionally, the analysis questions on the LSAT have nothing to

do with legal analysis. They are stupid “elevator” questions such as “Three people with
hats get on an elevator on the first, two with blue hats get on the second, two the people

have gray suits without while hats, how persons have a gray suit with blue hats?” There

are no question dealing math such percentages and fraction which lawyers use. Finally,

there are no questions testing for formal operations thinking. Lawyers who only have

concrete operations are hacks.

Why Zoning Restrictions on Professionals are a GAAT Violation

By

Throughout the United States there are local zoning restrictions prohibiting

professional home offices in residential neighborhoods. Such zoning restrictions are

invalid under The General Agreement of Tariff’s and Trade (GATT). There is no reason

why an accountant or a lawyer could not have a home office and practice their profession

out of that office in a residential neighborhood. Accounts and Lawyers, typically, only

see one client at a time and therefore traffic and parking would not be a problem. Zoning

regulations prohibiting home offices for Accountants and Lawyers as their primary

offices are clearly unreasonable restrains on a service industry under GAAT. Also, such
zoning regulations also violate 42 USC section 1983 and the zoning authority is liable for

damages.

In the Gospel of Thomas, written by Thomas Judeas Didymous, Saint Thomas the

Apostle, Jesus says of the Gospel of Thomas, “Whoever finds meaning in these words

will not taste death.” This means that those who follow Jesus Christ and have the Holy

Spirit in their hearts Pass Over at the end of their lives and do not die. While it may

appear that the person has died, the normal shock that a person experience at death does

not happen and instead the person just shifts into an alternate reality such as Purgatory.

Logical Positivism as Religion

Logical Positivism says that Religion and a belief in God is irrational and therefore

does not count. In fact Logical Positivism is itself an irrational religious belief and

therefore does not count. You can trash Logical Positivism ten different ways or more,

showing that it is irrational and the idiot, fundamentalist Logical Positivists still believe

in it, saying something like, “Well, Logical Positivism may be stupid and wrong but it

is all I have left.” Can you believe such idiotic stupidity? I say put such Logical

Positivists on the Psychiatric Ward for Schizophrenia.
