Governor Bev Perdue Office of the Governor 20301 Mail Service Center Raleigh, NC 27699-0301 Notification of administrative violations ENTRY OF JUDGMENT It is so ORDERED by the Superior Court of Wake County that the following public policies be amended and adhered to by the State of North Carolina, and all Agencies and Departments, on it's / their issuance of State Driver's Licenses. 1. That the State of North Carolina comes into compliance with Federal Regulations and its own North Carolina General Statutes, and United States Supreme Court decisions on the current, non-procedural issuance of Driver 's License to non-commercial drivers.

2. N.C.G.S., Section 20-4.01(3c) and (32(b) clearly shows that All North Carolina regular drivers licenses" are commercial drivers licenses" Only, and not for "private" Citizens who are not being commercially compensated or working for the State of North Carolina or the Federal Government as defined in Federal and State Statutes.

The Federal Regulations and North Carolina General Statutes clearly point out that a CDL and / or the CMV driver's licenses are issued to those receiving compensation. For-Hire Motor Carrier. A person who transports passengers or property by motor vehicle for compensation. Commercial Drivers License (CDL). A license issued by a state to an individual who resides in the state that authorizes the individual to drive a class of commercial motor vehicle. A "nonresident commercial drivers license (NRCDL)" is issued by a state to an individual who resides in a foreign jurisdiction. Commercial Motor Vehicle.(CMV) Any of the following motor vehicles that are designed or used to transport passengers or property: Passenger Vehicles. a. Excursion passenger vehicles. Vehicles transporting persons on sight-seeing or travel tours. b. For hire passenger vehicles. Vehicles transporting persons for compensation. This classification shall not include vehicles operated as ambulances; vehicles operated by the owner where the costs of operation are shared by the passengers; vehicles operated pursuant to a ridesharing arrangement as defined in G.S. 136-44.21; vehicles transporting students for the public school system under con-

tract with the State Board of Education or vehicles leased to the United States of America or any of its agencies on a nonprofit basis; or vehicles used for human service or volunteer transportation. 3. The State of North Carolina will come into compliance with the Federal Regulations under the Highway Safety Act, 23 CFR 1250. 40% Requirement. 1250.1 Scope. This part establishes guidelines for the States to assure their meeting the requirements for 40 percent political subdivision participation in State highway safety programs under 23 U.S.C. 402 (b)(1)(C).

4. The State of North Carolina will also issue new "tags" upon request by the private Citizen which will state / display the following, either as a "Non Commerical" or "Private" vehicle tag for those private Citizens who are not in engaged in commercial activity. The State of North Carolina will also notify All Law Enforcement Departments of this new tag issuance and that the private Citizen is NOT subject to the Law Enforcement's jurisdiction. 5. The North Carolina Department of Transportation will have these new "tags" recognized as part of the mandatory procedures for States to participate in the National Driver Register (NDR) system. 6. The State of North Carolina will change it procedures and policies on all traffic violations to have them reclassified as Administrative (State or Federal nexus) Only and not as a criminal violation by the private Citizens on the public roads and in its courts.

7. The State of North Carolina will reimburse and compensate Mr. Class for his time, research into the statutes, and injuries and inconveniences caused by the loss of his transportation in this matter by the Agency(cies) and Department(s) under the control of the Governor of North Carolina. . THEREFORE, the Court also, hereby, awards a Judgment of Five Million Dollars ($5,000,000) to Rodney-Dale; Class to be paid by the State of North Carolina's Treasury Comptroller's Office and that all costs in this matter are to be taxed back / (paid for) directly to / by the defaulted Defendants.
