You may wish to consider applying to a court for an order making your employer formally insolvent, so as to satisfy that meaning. If you know of any other employees, or creditors of the employer, you may wish to make a joint application, which will help to spread the cost. Before taking such action, however, you would be wise to take independent legal advice from a local Citizen's Advice Bureau or a Law Centre. If you are a member of a trade union your union may be able to help you. I would be happy to provide any further details and, if necessary, check and reconsider. If you still disagree with the decision, you can complain to an Employment Tribunal. The form you need to do this is an ET1. You can get one from a Jobcentre Plus office, a Citizens Advice Bureau or by phoning the Employment Tribunal Service enquiry line on 0845 795 9775. All calls are charged at local rates. You can also fill in a form online at www.employmenttribunals.gov.uk. The Secretary of State for Business, Innovation and Skills, at the address given above, should be named as respondent on the ET1 form. There are strict time limits for making a complaint about our decision to an Employment Tribunal so if you do decide to complain you should do so as soon as possible. However a complaint made within three months of the date of this letter will be in time. There is no time limit if your complaint is confined only to our rejection of your claim for Redundancy payment. You can obtain details of the time limits from the Employment Tribunal website.
