Deduction of PF
Question: What is the procedure of P.F. deduction of Bus Driver, Khalashi or any other worker engaged through the contractors/ agency. Answer: As per judgment of Delhi High Court i.e. EPFC Delhi vs. Springdales School, a School covered under the EPF and MP Act, 1952 will not be liable for payment of EPF Contribution of the employees such as drivers, conductors or the cleaners as engaged by the transport Contractor himself for providing transportation to the students and the staff. Since the management of the School has been paying to the Contractor on the basis of trip-basis, so, there is no casual or even remote connection with his employees as engaged by the Bus Contractors. But it depends as to how the Agreement has been signed with the Transport Contractor. Question: When an employee is to retire, 3 months PF Management Contribution is sent to DAVCMC PF Section in advance. Afterwards if the loss of pay occurs in respect of that employee, what is the process to be followed? Answer: Answer: The main purpose for processing the PF claim of the retiree in advance is that the retiree should get all the dues in the day of his retirement after clearing all his dues like advance taken, library books etc. If he has got office accommodation, he should pay all the dues like electricity bill, water bill, telephone bill etc. According to revised instructions kept on our web-site the case of retiree can be processed two months in advance and if the School can do this exercise quickly then the claim can be sent to this office one month in advance. About loss of pay afterwards no such case has come to our notice. Question: If an employee resigns on or before 10 years of continuous service and he has worked on regular basis only for 8 years. Members who continue in service on Superannuation till the end of the year their PF will be deducted upto that period. National Awardee who get extension in service their PF will be deducted upto the date of extension subject to 65 years of age.

PF Nominations/PF unclaimed
Question: Question: declaring If an Employee expires without declaring the nominee's share how will the claim be settled? Answer: Answer: If the member has not filled-up Nomination Form before he expires, the case will be treated as No Nomination Case, and the PF amount will be paid to the heirs of the member after receipt of succession certificate from the court under Succession Act. If, nomination is there in the name of more than one person, and percentage of share has not been mentioned then the claim will settled between the nominees with equal shares.

is What is the procedure if we need to change the nominee name and the name after marriage?

Answer:

For change of Nominee after marriage, simply the Revised Nomination Form is to be filled-up and sent to DAV PF Trust under PF Scheme and to Local PF Office under Pension Scheme.

If an Employee leaves the job without resignation or information and does not bother to fill the PF Claim Form How do we solve the issue?

Answer:

The School can write to the member at his residential address to clear the dues, if any, and also for settlement of his PF claim etc. If he does not bother, nothing can be done. The PF accumulations of the member will be transferred to Unclaimed A/c after 3 years.

PF LOAN
Question: Question: Why EMI of refundable loan out of Provident fund is not included of interest amount? 60,000/1,000/For example: Loan taken Rs. 60,000/-, EMI 60 (5 years) of Rs. 1,000/- each. There is no calculation of interest amount. Employee has to go to DAVCMC office and deposit interest amount of loan. Answer: It is not possible to include interest amount in EMI of refundable Loan at the time of grant of loan as interest is subject to change every year. Moreover, certain Schools change the EMI at School level and in certain cases the EMI is missing in Monthly PF Schedule. It should be avoided. Further, Our Computer Calculates the interest automatically every year and it is shown in Annual Statement of Accounts. On the basis of this, the member can pay the interest through the School. There is no need for the employee to go to HQ for this purpose .

TRANSFER OF PF
Question: If employees transfer from one school to another DAV school, what is the procedure of transferring their PF and Pension scheme? Answer: For transfer of PF the member should apply to this office on plain paper through the Principal of the School. For transfer of Pensionable Service, the member will have to fill-up Form No. 13 and to deposit in the Local PF Office. Penalty - delay in depositing PF Question employees In some occasions if the regular salary bill of all employees for a month delayed about 40 to 50 days due to financial compulsion and lack of funds, is there any penalty charged for monthly Provident Fund contribution ? Answer: Damages/penal interest will be charged on late Monthly PF Contribution after 6th of the month as per instructions already issued.

PENSION SCHEME
Question: Is there any difference in retirement rules for Teaching/Non teaching / Administrable staff. The procedure to prepare especially the pension cases be explained. Answer: Same Pension Scheme is applicable to both teaching and non-teaching staff of your School whose PF is being remitted to DAV PF Trust this office and Pension Contribution to Local PF Office. Question: The date of birth of our one school teacher is 16.10.1953. She will complete her 58 years on 16.10.2011. Answer:

The Pension Contribution of the teacher should be calculated upto 16.10.2011 on the maximum Pensionable pay of Rs. 6,500/- and remitted to PF Office

Question:

If an employee resigns on or before 10 years of continuous service and worked he has worked on regular basis only for 8 years. At the time of resignation What about the pension contribution?

Answer:

The member will get withdrawal benefit from Local PF Office, as per Table-D of Pension Scheme. If the member has rendered 8 years service and his pay at the time of exit is Rs. 6,500/-, the member will get Rs. 53,430/-. Question:

If an Employee is transferred, what procedure has to be followed to get his/her pension accumulations transferred to the new place of posting. As we are facing lot of problems with regional PF Commissioners. please advise us on this issue.

Answer:

The member will have to fill-up Form 13 for transfer of his Pensionable Service from previous Pension A/c No. to present pension A/c No. In case of any problem with the Local PF Office, the School can write to PF Section for sorting-out the issue.

Question:

Hyde Pension Scheme from Hyderabad : Before 2005 if employee worked in different places, local pension office is not considering previous school What service they are considering only from April, 2005. What is the procedure to get it Transferred/Regularized.

Answer:

RPFC Hyderabad is settling the claims of the members on the basis of Form 3(PS), 7(PS) and 8(PS) deposited with his office from the date of set-up of the school. In case of transferred employees, if any problem is there we will try to sort-out the same, if a reference is received from the School.

Case History: A teacher worked in this School from 01.01.1987 to 31.03.1999. Is she eligible for Monthly pension scheme? If she is eligible for for pension what will be her date of leaving service.

Answer:

Yes, if she has completed 10 years service under Pension Scheme (including the service under Family Pension Scheme). Her date of leaving will be upto the date she has drawn the pay and her Pension Contribution was remitted to Local PF Office.

EDLI
Question: Answer: resigns If an employee resigns or retires, what about his EDLI benefits? EDLI benefit is given to the nominee only in death cases (while in service)

ESIC SCHEME
Question: are ESIC contributions are being demanded by the regional officer since the ESIC scheme is applicable to school w.e.f 28.8.2006. Whether such demands demands for contribution is tenable in the eyes of law. Answer: Your school will have to implement the ESIC Scheme w.e.f. 28.08.2006 when the ESIC Act was made applicable to Education Institutions.
