Last Monday night, the City finally, FINALLY, agreed to do what three separate courts have ordered them to, which is pay the river outfitters close to $700,000 as part of the infamous Tube-Tax case from 2007. The City lost the initial case plus two appeals, and rather than get spanked by the States Supreme Court, Council voted unanimously to put a stop to the financial hemorrhaging these constant appeals have caused, which has got to be bad news for the Citys San Antonio based legal team, the members of which have been milking this moo-cow for years. We dont know how much of our money the City has spent trying to save face after implementing an illegal tax, and yeah, we could ask, but with their track record of cloudy record keeping I doubt wed get anything close to the truth. But what happened earlier in the night may turn out to be the bigger story. This tow truck contract madness the City has gotten itself into has corruption written all over it. 17 tow truck companies used to split the police tow business in New Braunfels. The City decided they wanted one company (plus a backup) to do all of the work. So they had each outfit prepare a bid according to a criteria package. Then, at the last Council meeting of 2012, they switched it up to four companies total and threw away the criteria, because the companies they wanted to use didnt meet the specs. We spoke with Garrison Maurer of Comal Towing after Mondays meeting. Maurer has filed a formal complaint against the City.

Theyre charging by the mile, and it costs a lot more taking them to San Antonio than New Braunfels. New Braunfels isnt benefiting one bit by this. San Antonio gets the sales tax, while New Braunfels gets left out. TX Citizen: Who did get the contract? Garrison Maurer: Two of (the companies granted the contract) are the same, they have common ownership, father and son team, same property, same trucks, everything. The son only has one truck, and he got half of the city contract. New Braunfels Towing is the father, New Braunfels Wrecker is the son. Then you have Blue Bonnet Motors and you have Hill Country Customs Collision. Another issue is we didnt even bring up tonight is all these companies are body shops. This is a towing contract. How do you issue a towing contract to a body shop? We didnt even bring that up tonight. TX Citizen: How does the police officer figure into this? Garrison Maurer: The police officer is David Olaf Olson. Hes a senior, ten-year veteran of the police force. His wife is Police Chief Tom Wiberts secretary. Now, Im friends with Olson, fine, but we gotta draw the line somewhere when we allow City employees into the contracts with no disclosures. Nobody disclosed that. Hes employed by Blue Bonnet Ford as a tow truck operator, and in their proposal, hes clearly identified as an employee operating a tow truck. He was also employed by New Braunfels Towing/ New Braunfels Wrecker as well in the past. (Editors note: Officer Olsen is a man of epic proportions, and could probably drag vehicles to the yard with his bare hands.) TX Citizen: Did you meet all of the qualifications for the bid? Garrison Maurer: Yes sir. I have a good size fleet of trucks, I have the heavy-duty wrecker. I have a facility thats inside the city limits. I put it all together in my proposal, as TXCITIZEN.COM were three criteria that the city scored us by. One, you had to have a plan to manage the contract. The second criteria was equipment capabilities and storage facilities. The third factor was past history reference letters. They scored off of those three requirements, and you had to meet the RFP (Request for Proposal) requirements as well.

Its important to note that price was not a factor in the bidding process companies were to be scored against the bid criteria, right up until that criteria became too difficult for particular companies to meet. In defense of the City on the subcontractor issue, while not in the heavy-duty section, the RFP does contain the following language: The City of New Braunfels desires maximum subcontractor participation. Naturally, we believe they meant other local companies, because the document also includes this verbiage: Any wrecker dispatched pursuant to a request from the New Braunfels Police Department must arrive on the scene within twenty-five (25) minutes of being dispatched. Of course San Antonio is often more than 25 minutes away. Especially if theres been a wreck. The result will almost certainly be mayhem as the gravy-train begins to come off the rails. We can expect the next weeks to include a barrage of Cassandraism from both sides of the aisle. Republicans have insisted that they will not raise the debt ceiling without significant cuts to government spending (though the sequestration cuts are not to their liking), and the Democrats have vowed not to buckle to blackmail from Republicans, meaning they have no interest in even slowing spending. We will be told that the government will shut down, that the world economy will crash, that old people will be through out of their homes to starve in the streets, that our credit rating will be lowered again. The reality is that these things are quite likely to happen in the very near future regardless of how the debt ceiling is handled. Our borrowing is holding back not just our
