Rambus Inc. ("Rambus") respectfully submits copies of (l) the judgment entered by the

) United States District Court for the District of Delaware (the "Delaware Court") today in Micron

3 Tech., Inc. v. Rambus Inc., Civ. No. 00-792-SLR (attached hereto as Exhibit A); and (2) a

4 February 9, 2009 order issued by the Delaware Court directing the Clerk to enter judgment in that

5 matter (attached hereto as Exhibit B). The Delaware Court entered judgment against Rambus on

6 its patent claims and patent counterclaims, and in favor of Micron Technology, Micron

7 Electronics, and Micron Semiconductor Products ("Micron") on their patent declaratory judgment

8 claims and counterclaims. (See Exh. A.)

9 As the Court is aware, Rambus intends to take an appeal to the Federal Circuit from the

10 Delaware Court's spoliation ruling and the just-entered judgment. This Court has previously

II recognized the need for the proceedings in Hynix 1 "to move forward as expeditiously as possible

12 with the anticipation that any appeal from the judgment in that case will presumably be

13 coordinated with any appeal in the Micron Del. Action." (2/3/09 Order Entering Stay of

14 Proceedings, at 3.) Rambus believes that in order to ensure that the Federal Circuit is able to

I5 coordinate the appeal from Hynix 1 with the appeal from the Micron Delaware action, this Court

16 should, if possible, enter judgment in Hynix 1 within the next 30 days. To this end, the parties are

17 in the process of meeting and conferring on the form of judgment to be entered in Hynix 1, and

18 have set a telephonic hearing with the Court to discuss any remaining disputes on February 18,

19 2009 at 10 a.m.
