saya who said that the
signing of the peace
covenant is designed to
ensure that the conduct
of elections in Baybay

been initiating several
peace covenants as part
of their measure to en-
sure that the conduct of
the elections here in the
region would be orderly
and peaceful.
The first signing of
similar act was done in
Calbayog City in Samar
which has been identi-
fied as one of the 15
concerned or hotspot
areas in the country due
to intense political rival-
ry, presence of private
armed groups and that of
the New Peoples Army.

It has been observed that yearly request for confrmation of units are
processed without undergoing the formalities of a petition prescribed by
the rules. Te authorized unit is confrmed without knowing who requested
the confrmation especially when the operator has already died, has gone
abroad, or the unit has been sold to another party without the approval of
the Board.
In this regard, no request for confrmation of unit shall be processed with-
out the fling of a verifed petition pursuant to Rules of Practice and Proce-
dure before the Land Transportation Franchising and Regulatory Board.
All Regional Memorandum Circular inconsistent herewith are hereby
amended, cancelled and revoked accordingly.
Tis Regional Memorandum Circular shall take efect ffeen (15) days

There is nothing
wrong to impose air-

many television and ra-
dio stations do we have

paigns of the government. People
get information about what their gov-
ernment is doing from billboards and
streamers scattered all over. Aside from
bannered information, advertisements on
television, radio and newspapers are also
resorted to. We are bombarded on a daily
basis of the many things that government
does but we seldom feel anything that
government is doing. Many programs and
projects are advertised with the huge im-
ages of the politicians prominently dis-
played more than the important details
about the program or project.
The law that requires the placement of
billboards on every project is intended to
inform about the cost and nature of the
project so that the people can oversee
its implementation. It is supposed to
banner the cost, specifications and the
timeframe for its completion. Unfortu-
nately, the information is trivialized for
they are buried in small letters under
the bold names and shameless faces of
the government officials who claim the
project as their own. These government
officials had developed the temerity to
claim credit on the project as if it is be-
ing implemented using their money.
The billboard of their shameless faces
cost much out of the dilapidated funds
that are mere remnants of percentage
cutters.

THE QUESTION ABOUT FASTING
The disciples of John approached [Jesus] and said, Why do we
and the Pharisees fast [much], but your disciples do not fast? Jesus
answered them, Can the wedding guests mourn as long as the bride-
groom is with them? The days will come when the bridegroom is taken
away from them, and then they will fast.
WHY YOU DO NOT FAST?
The followers of John the Baptist, like many other people, fasted
frequently in order to follow the requirements of the Law and also to
use it as a technique in spiritual growth. Until very recent times, fasting
was a common penitential activity of the Church. It was an effective
penance and a means of purifcation of the soul. Even though it is dif-
fcult to do it under the conditions of modern life, it is still a spiritually
helpful practice. If the demands of the work we do are so great that we
would not be able to fast and do our work right, then we should try to
fast at least some times, so that we cam make a sacrifce for God and
that we may experience deeper union with Him. Have we neglected

has been one of the
most popular and fin-
est programs of the
Rotary Foundation.
The objective of this
program is to learn
more about the coun-
trys culture, share
and enhance their vo-
cational expertise,
explore avenues of
service, meet and de-
velop new friends, and
experience the warm
Rotary hospitality.
Just recently, Dis-
trict 3860 Zone 3C
hosted a GSE Program
where 5 inbound GSE
Team from Texas,
USA visited various
cities across the Vi-
sayas including Taclo-
ban City where they
stayed for 4 days here
in Tacloban City. The
GSE Team is com-
posed of Jennifer Gra-
ham as Team Leader,
Erin Spencer, Gladys
Reyna, Charles Keel-

from Texas, USA.
The 5 Clubs of Zone
3C acted as host clubs
as each clubs hosted 1
visiting Rotarian. The

The visiting GSE
Team made a courtesy
call at the office of
Mayor Alfred Romual-
dez last February 11 at
the City Hall and the
gracious Mayor briefed
the visiting team of the
socio-economic stand-
ing of Tacloban City
and proudly informed
the group that Tacloban
is now a highly urban-
ized city in the many
investments coming in
from big businessmen
of the country in the
likes of the Ayalas, Go-
kongweis and Lopezes.
I learned from the visit
of the GSE Team that
Mayor Romualdez was
very familiar of the so-
cio-economic status of
USA as he lived there
for several years and
travelled extensively
to the different parts
of USA.
Through the initia-
tive of Asst. Gover-
nor Ralph A. Salazar,
District 3860 Zone
3C hosted a Cultural
Night to the visiting
GSE Team attended by
Rotarians from 5 Ro-
tary Clubs of Tacloban
City which was also
attended by District
Governor Peter Rodri-
guez who comes from
Ormoc City and the
host Rotarians from
Calbayog City.
It was indeed a
memorable night, as
the GSE Team present-
ed a power point in-
formation about their
culture, and socio-
economic status of the
state of Texas where
they come from.
There was also the
wonderful presenta-
tion of the Leyte Ka-
lipayan Dance Troupe
where they showed our
local dances like the
Tinikling, Pandango sa
Ilaw and the Maglala-
tik. They enjoyed the
show so much that
they themselves tried

BE IT ORDAINED, AS IT IS HEREBY ORDAINED, by the Sangguniang Bayan of Capoocan,
Leyte in session assembled, that:
AN ORDINANCE APPROVING THE MOTORCYCLE HELMET ORDINANCE OF
CAPOOCAN, LEYTE, PROVIDING PENALTIES THEREFORE AND FOR OTHER PURPOSES.
Section 1. TITLE. This ordinance shall be known and referred to as THE MOTORCYCLE
HELMET ORDINANCE OF THE MUNICIPALITY OF CAPOOCAN, LEYTE
Section 2. DEFINITION OF TERMS. The following terms, words or phrases as used in this
Ordinancearedefnedasfollows:
(a) Standard Protective Motorcycle Helmets are those appropriate types of helmets for
motorcycleridersthatcomplywithspecifcationsissuedbytheDepartmentofTradeandIndustry
(DTI).
(b) Motorcycle from the legal point of view and for purposes of registration, taxation, rider
licensinganduseinthisordinance,motorcycleisdefnedasapoweredtwo-wheelmotorvehicle.
(c) Traumatic Brain Injury (TBI) also known as intracranial injury. It occurs when an ex-
ternalforcetraumaticallyinjuresthebrain.TBIcanbeclassifedbasedonseveritymechanism
(closedpenetratingheadinjury),orotherfeatures(e.g.occurringinaspecifclocationorover
a widespread area). Head injury refers to TBI, but is a broader category because it can involve
damage to structures other than the brain such as the scalp and skull.
TBI is a major cause of death and disability worldwide, especially in children and young
adults. Causes include falls, vehicle accidents, and violence. Prevention measures include use
of technology to protect those who are in accidents, such as seat belts and sports or motorcycle
helmets, as well as efforts to reduce the number of accidents, such as safety education programs
andenforcementoftraffclaws.
d. Strict enforcement of the helmet law means that the Municipal Government of Capoocan,
Leyte adopts and enforces the Motorcycle Helmet Act of 2009 without reservations or what-
soever guided with the principle that the law may be harsh, but it is still the law is only to avert
serious harm or even death among motorists or their passengers during road mishaps.
Section 3. DECLARATION OF POLICY
It is hereby declared the policy of the Municipality of Capoocan, Leyte to undertake all neces-
sary measures in order to protect and safeguard all constituents specially the motorcycle riders/
drivers front and back passengers from the deadly road mishaps involving motorcycle and other
transport vehicle and for its purpose. It shall strictly enforce wearing of the standard protective
motorcycle helmets within the territorial jurisdiction of the Municipality of Capoocan, Province of
Leyte.
Section 4. COVERAGE
This Ordinance shall have full force and effect within the territorial jurisdiction of the Munici-
pality of Capoocan, Province of Leyte.
Section 5. MANDATORY USE OF STANDARD PROTECTIVE MOTORCYCLE HELMETS
Pursuant to R.A. No. 10054, otherwise known as the Motorcycle Helmet Act of 2009 and
Section 16 of R.A. 7160, all motorcycle riders and back riders shall at all times wear the standard
protective motorcycle helmets while traversing in any type of road and highway within the territo-
rial jurisdiction of the Municipality of Capoocan, Leyte regardless of whether it is for a long travel.
The helmet should be worn properly in order to obtain the level of protection the headgear
can provide. Whether it is a full face or open helmet that is being worn by riders and back rid-
ers, its integral parts such as the retention system or strap that holds the gear to the head and
the children guard or full face guard should be used properly in accordance with the instructions
from the manufacturer otherwise, misuse of those fxtures may diminish the overall protective
capabilities of the helmet. If a full-face helmet is equipped with a face shield, it may also provide
a measure of eye protection, however, a tinted face shield that will conceal the face of the user
is strictly prohibited.
This mandate is also applicable even for enlisted personnel of the Armed Forces of the Philip-
pines and enlisted personnel of the different Law Enforcement Agencies.
Section 6. EXEMPTION
The following situations/circumstances may exempt the motorcycle riders or back riders from
wearingthestandardprotectivemotorcyclehelmetsasdefnedinthisOrdinance,towit:
(a) While under an emergency situation whereby a sick, ailing or dying person is being trans-
ported in a motorcycle to the nearest hospital for an immediate medical intervention;
(b) Whileintheperformanceofhotpursuitoperationbylawenforcementoffcers,and
(c) Whilewearingturban/headdressonaccountofreligiousbeliefandaffliation.
Section 7. DUTY OF LAW ENFORCEMENT AGENCIES
AsidefromtheLandTransportationOffce(LTO),thelocalPoliceOffcersandTraffcEnforc-
ers shall ensure that the mandate of this Ordinance be strictly enforced in the Municipality of
Capoocan, Leyte and to this end, they are duty bound to execute and maintain the monitoring
and apprehensions of persons violating this Ordinance in their respective localities or areas of
jurisdiction.
IncasesofjointoperationsbytheLTOandtheLGUthroughthelocalpoliceandtraffcen-
forcers, a Memorandum of Agreement (MOA) between the two (2) government entities may be
entered into stipulating therewith the manner by which the operations will be conducted for the
purpose of proper coordination and for the effective implementation of this Ordinance.
Section 8. DUTY OF THE DEPARTMENT OF TRADE AND INDUSTRY (DTI-LEYTE)
The Department of Trade and Industry shall conduct regular inspection and monitoring of all
establishments engaged in selling and/or dealing helmets to the standards set by the Bureau of
Product Standards (BPS) of DTI. Only motorcycle helmets bearing the Philippine Standard (PS)
mark or Import Commodity Clearance (ICC) of the Bureau of Product Standards (BPS) shall be
sold to persons with motorcycle or to persons who has yet to purchase a motorcycle.
Section 9. PROHIBITED ACTS
The following acts are prohibited under this Ordinance, to wit:

(a) Driving or back riding a motorcycle without wearing protective motorcycle helmet as de-
termined by the Bureau of Product Standards (BPS) of DTI.
(b) Improper wearing of helmet contrary to Section 5 of this Ordinance;
(c) Wearing of helmet with tinted face shield;
(d) Selling/dealing of non-compliant helmets to the standards set forth by the Bureau of
Product Standards (BPS) of DTI;
(e) Non-performanceofoffcialdutiesmandatedunderthisOrdinancebyalawenforcement
agent referred to in Section 7 of this Ordinance;
(f) Tampering, alteration, forgery and imitation of the PS mark and the ICC certifcates in
the helmets to make the same appear to be compliant to the standards set forth by the Bureau of
Product Standards (BPS) of DTI.
Section 10. LIABILITY
The liability for the infraction of the provisions of this Ordinance as to the mandate of wearing
the standard protective motorcycle helmet shall rest upon the driver/rider regardless of whether or
not the back rider is a minor or of legal age. Therefore, the safety of back riders is the responsibility
of the driver/rider.
Section 11. INFORMATION CAMPAIGN
It shall be the duty of the Local Government Units within the territorial boundaries of the Mu-
nicipality of Capoocan, Leyte to conduct massive information campaign within their respective
jurisdictions to properly apprise their constituents about the existence of this Ordinance and the
manner by which this will be implemented in their localities.
Section 12. PENAL PROVISION
First Offense - AfneofFiveHundred(Php500.00)pesos;
Second Offense - AfneofTwoThousand(Php2,000.00)pesosandimprison-
ment for a period of two (2) months;
Third Offense - AfneofTwoThousandFiveHundred(Php2,500.00)pesos
and imprisonment for a period of six (6) months.
If it is a law enforcement agent violating the provisions of this Ordinance, he shall be meted out
withadministrativesanctionsinadditiontothefneandimprisonmenthereinprovided.
Section 13. FINES PAID shall accrue to the Local Government Unit that apprehended the
violators and the disposal of which will be determined by the LGU concerned.
Section 14. REPEALING CLAUSE. All ordinances, executive and administrative issuances
found inconsistent with the provisions of this Ordinance shall be repealed accordingly.
Section 15. SEPARABILITY CLAUSE. If any part, section or provision of this Ordinance shall
be held invalid or unconstitutional, the remaining part, sections or provisions shall retain its full
force and effect.
Section 16. EFFECTIVITY. This Ordinance shall take effect after its approval and the require-
ment of posting and publication prescribed in R.A. 7160 are complied with.

bled on the 26th day of September 2012 in Capoocan, Leyte.
