Since its creation in 1923 with funding received from the Carnegie Foundation, The Hague Academy of International Law has occupied premises at the Peace Palace, alongside the highest judicial institutions such as the International Court of Justice and the Permanent Court of Arbitration. It is a centre for research and teaching in public and private international law, with the aim to further scientific and advanced studies of the legal aspects of international relations. The Academys scientific board, the Curatorium, invites academics, practitioners, diplomats, and other personalities from all over the world whom it considers qualified to give courses, in English or French (with simultaneous interpretation). These courses are on general or specialized subjects and take the form

of a lecture series. The courses are published in the series Collected Courses of the Academy of International Law (Recueil des cours), which now runs to more than 350 volumes and is undoubtedly the most important encyclopedic publication on private and public international law. Since 2008 the Collected Courses are also available in a fully searchable online edition. Every year a select number of specialized courses are published in an affordable paperback edition: the Pocket Books of the Academy. In addition, the Academys publication program features the volumes of the Centre for Studies and Research in International Law and International Relations, and the Colloque/Workshop volumes.

This book, published in 2011, is a product of the research conducted at the Center for Studies and Research of the Hague Academy of International Law in the summer of 2008. The Centre, devoted to the implementation of international environmental law, attracted twenty talented young scholars from nine different countries. This volume contains the introductory report of the two directors of studies, in English and in French, a selection of the best papers prepared by the participants, as well as a general index and a comprehensive bibliography. The topic of the 2008 session is of both practical and theoretical interest. International environmental law, despite the rapid proliferation of treaty instruments in the area, is plagued by difficulties in implementation. The search for enhanced effectiveness of international environmental law has yielded many innovations at the institutional and normative levels. In seeking to better understand these innovations, their emergence, deepening and diffusion, this volume highlights the major shifts in and challenges faced by international environmental law and, indeed, international law itself.

The essays contained in this volume derive from a high-level Workshop organized by the Hague Academy of International Law to determine whether the legal fundamentals that were established a century ago remain relevant today or whether they have been affected by the requirements of todays world. The world of a century ago only faintly resembles the world in which we now live, and it is therefore legitimate to ask whether the rules laid down in 1907 respond to the needs of 2007. How can it be disputed that the requirement for peace, law, the settlement of disputes, and humanitarian principles still exists, and even more emphatically than in the past? But given the new constraints with which our world is faced terrorism, degradation of the environment, the exacerbation of under-development in certain States, and food and energy crises and given the new imbalances that are appearing around the emerging powers, new forms of development, and the ubiquity of new technologies,there is a clear need for reform. The question is whether, in the name of such requirements, it is now possible to depart from certain principles that can be viewed as fundamental achievements. To what extent do the great achievements dating from the dawn of the last century survive among the rules applicable to the century that is now beginning, without excluding the developments and reforms that are necessary in a world that is so different from the world a century ago?

This volume is the product of the Centre for Studies and Research of the Hague Academy of International Law for 2007. A total of 23 young academics and practitioners from 16 countries participated in the Centres summer session, and all contributed to a very valuable scholarly exploration and exchange of views on a vital topic. The volume consists of the introductory reports of the two Directors of Studies (Professor D. Momtaz of the University of Teheran and Professor M.J. Matheson of George Washington Law School), together with contributions by 13 of the Centre participants that were deemed to be particularly worthy of publication, an extensive bibliography and a general index. The topic for 2007 was Rules and Institutions of International Humanitarian Law Put to the Test of Recent Armed Conflicts. It reflects the fact that international humanitarian law has gone through a period of considerable expansion and development in the past two decades, including the conclusion of several new international humanitarian law conventions and codes of offences, the creation of a number of criminal tribunals to prosecute international humanitarian law violations, and the effort by the ICRC to produce a comprehensive elaboration of customary law in the field. But the topic also reflects the fact that this body of law has been seriously tested by the armed conflicts of recent years, which have often been vast in scope, long in duration and severe in their human consequences. These conflicts have challenged both the norms themselves and the new institutions that have been created to enforce them.

The Hague Academy of International Law Monographs, 6 Professor Canado Trindade develops his Leitmotiv of identification of a corpus juris increasingly oriented to the fulfillment of the needs and aspirations of human beings, of peoples and of humankind as a whole. With the overcoming of the purely inter-State dimension of the discipline of the past, international legal personality has expanded, so as to encompass nowadays, besides States and international organizations, also peoples, individuals and humankind as subjects of International Law. The growing consciousness of the need to pursue universally-shared values has brought about a fundamental change in the outlook of International Law in the last decades, drawing closer attention to its foundations and, parallel to its formal sources, to its material source (the universal juridical conscience). He examines the conceptual constructions of this new International Law and identifies basic considerations of humanity permeating its whole corpus juris, disclosing the current processes of its humanization and universalization. Finally, he addresses the construction of the international rule of law, acknowledging the need and quest for international compulsory jurisdiction, in the move towards a new jus gentium, the International Law for humankind. This volume is an updated and revised version of the General Course on Public International Law delivered by the Author at The Hague Academy of International Law in 2005.

Monographs, 5 This book is a revised and expanded version of the General Course delivered by the author at the Hague Academy of International Law. It contains three parts that discuss theory and practice of adjudicatory authority in private international law in comparative perspective focusing on the United States, Germany and the European Union. The first part examines the foundations and emergence of jurisdictional theory elaborating on the types of adjudicatory authority and the design of jurisdictional provisions. Part two covers basic themes and pervasive issues reflecting, inter alia, on the actor sequitor forum rei principle, choice of forum agreements, forum non conveniens, antisuit injunctions and the lis pendens doctrine. The last part explores the role of international instruments for achieving convergence and harmonization. It analyzes the design of judgments conventions and in particular the efforts of the Hague Conference on Private International Law to foster worldwide harmonization. The volume was completed with the assistance of Dr. Eckart Gottschalk.

Latin American Universities in distinct countries, was for many years Judge of the Inter-American Court of Human Rights, and President of that Court for half a decade (1999-2004). The World Trade Organization (WTO) resulted from globalization, through which national law provisions are internationalized and international norms are domesticated. The WTO does not permit reservation by its members who are obliged to ensure the compliance of their laws, policies and other measures. Once a member is found to have violated its obligations, it must rectify the non-compliance measures to avoid retaliation. The quasiautomatic approval procedure of the WTO Dispute Settlement Body has proved to be effective in ensuring the compliance by members and consistency of interpretation of the WTO Agreement. As the multilateral trade institution covers a wide range of sectors from trade in goods and services, and intellectual property to investment and the measures of the members include laws and regulations, administrative decisions and judicial rulings, the impacts of the WTO on the members legal systems are hugely profound and long lasting. In some cases, for the purpose of joining the WTO, the legal systems of the members concerned have been through significant changes.

This monograph considers the ramifications of the legal regime that governs transborder capital flows. This regime consists principally of a network of some 3,000 investment treaties, as well as a growing body of arbitral decisions. Traditionally, conflict of law rules designate only national substantive law as the applicable law. Many unifying and harmonizing substantive law instruments of both States and non-State organizations, however, are designed specifically for application to crossborder relationships. Achieving this objective is, generally, hindered by conflict of law rules. The requirements which non-national law needs to fulfil in order to be accepted as the law governing a cross-border relationship deserve clarification. Not only uniform law, such as the CISG and the envisaged European substantive law instrument for the law of obligations, but, particularly, instruments which are aimed at harmonizing substantive law, challenge the established systems of conflict of laws. In a relatively short time the concept of sustainable development has become firmly established in the field of international law. The World Commission on Environment and Development concisely defined sustainable development as follows: development that meets the needs of the present generation without compromising the ability of future generations to meet their own needs. This definition takes into account the needs of both the present and future generations as well as the capacity of the earth and its natural resources which by clear implication should not be depleted by a small group of people (in industrialized countries). The aim of this book is threefold : to review the genesis and to clarify the meaning of the concept of sustainable development, as well as to assess its status within public international law. Furthermore, it examines the legal principles that have emerged in the pursuit of sustainable development. Lastly, it assesses to what extent the actual evolution of law demonstrates the balance and integration with all pertinent fields of international law as urged by the Rio, Johannesburg, and World Summit documents. This is the second volume in the Hague Academy of International Law Pocket Book series; it contains the text of the course given at the Hague Academy by Professor Schrijver.
