The figures in the table are compiled from the Impact Assessments (IAs) produced by government departments, and downloaded into the British Chambers of Commerce IA Database. All government departments are required to complete IAs that evaluate the positive and negative effects of state interventions that have an impact on business. The figures show the governments own estimates of the compliance costs of a series of regulations affecting business up to 1 July 2010. Half of all IAs claim that new regulations provide benefits to businesses, consumers or the environment. However, historically these benefits are only quantified in the minority of cases. As a result it is difficult to calculate the total value of the benefits that it is claimed justify the costs.

The Burdens Barometer has been updated from 2009, and the total net cost of the major regulations to business, approved since 1998 is now:

IAs are sorted by publication date. The total figure excludes the costs to business of the National Minimum Wage Regulations 1999 and subsequent amendments to the rate. Two Legislative Reform Orders, in respect of the Consumer Credit Order 2006, that jointly offer one-off savings of 126m and recurring savings of 50m, have been excluded from the Barometer. The reason for exclusion is that both of these Orders amend regulations that came into force in 2008, but the Impact Assessment did not anticipate the costs now claimed as saved. The Barometer assigns IAs to the department under which they were created. This means that some departments which may have been superseded by machinery of government changes will remain in the Barometer. * Now subsumed into BIS

11 At 30 June 2006 the May 2000 RIA had cumulative costs of 499m, comprising 100m one off costs and 76m of recurring costs. A new final RIA was published in April 2005, which introduced additional one-off costs of 6.5m, and ongoing costs, net of 1m of benefits, amounting to 2m. From April 2008, annual benefits rose to 13m. 19 The 2001 Regulation was replaced by/incorporated into the TSE (England) Regulations 2002, which were also replaced, and are now embodied in the Transmissible Spongiform Encephalopathies (No.2) Regulations Jan 2006. However, Defra states in the 2006 RIA that costs should remain the same. 20 This Regulation came into force in two Parts, stage one in October 1999 and stage two in October 2004 although the RIA was prepared in 2001. Recurring costs for the first five years were 162m p.a. and from October 2004 these became 189m p.a. 21 9.4m was added by the Terrorism Act 2000 and Proceeds of Crime Act 2002 (Amendment) Regulations 2007 starting in December 2008, as a one-off cost. 22 The Maternity and Parental Leave (Amendment) Regulations 2001. In the first three years of this RIA costs are 24m and then in the fourth year costs reduce to 5m p.a. 24 The Electricity and Gas (Energy Efficiency Obligations) Order 2001. This RIA was replaced in Apr-05, when costs ceased accumulating (see Barometer item 58 for the replacement RIA). 36 The 2003 Regulations have been superceded by the 2005 Animal By-Products Regulation 2005. DEFRA states the costs are virtually the same. 39 This was an interim RIA developed while EC Regulation 1831/2003 was under negotiation. These Regulations have been consolidated in the Feeding Stuffs Regulations 2005. In the final Regualtory Impact Assessment Food SA state that the costs should not change. 58 This regulation expired in March 2008 (see Barometer item 94 for the replacement IA). 69 The Food Hygiene (England) Regulations 2005. One-off costs and recurring costs are fixed at 36m and 96m, but benefits vary every year as follows: Year one 45m; year two 90m; year three 136m; year four 181m; years five to ten 262m. Technical Notes
The costs to business identified in the IAs above are net of the benefits that accrue to business. The Barometer is compiled each year from the data included in IAs produced by government departments up to the prior 30 June, with the net costs extended to include the year in which the report appears, i.e. 30 June 2010 in this case. Regulations with IA dates before this period can be included if new documentation is published, highlighting further business costs. These will be included within the latest years total. IAs that reported a net impact on the cost to businesses by July 2010 of above 15m or below -15m were included. New regulations that modify the net impact of existing regulations by less than 15m are included in the existing regulation, with a note added to it. New regulations that modify the net impact of existing regulations by more than 15m are added as new entries in the Barometer. New regulations that supercede existing regulations are added as new entries in the Barometer, for example item 94. The recurring cost of the previous regulation (item 59) is changed to 0 with effect from the date of the new regulation, and a note is added linking to the new regulation. Where IAs give a range of costs the Barometer has taken the mid-point figure. In those cases where certain provisions come into force later than the regulation itself, the reduction in compliance costs has been ignored. Only those regulations with significant burdens net of benefits to business are included. The criteria for inclusion have not changed. Thus the Barometer is purely a matter of arithmetic, totalling the major business costs created by departments and agencies. The Barometer itself offers no judgement on government policy. Some of the references are to RIAs (Regulatory Impact Assessments), the name of IAs prior to 2008.
