CHED MEMORANDUM ORDER (CMO) No. _______ POLICIES AND GUIDELINES ON THE MONITORING AND EVALUATION OF HIGHER EDUCATION INSTITUTIONS OFFERING BACHELOR OF SCIENCE IN MARINE TRANSPORTATION AND BACHELOR OF SCIENCE IN MARINE ENGINEERING PROGRAMS RE COMPLIANCE WITH THE REQUIREMENTS OF CHED AND THE INTERNATIONAL CONVENTION ON STANDARDS OF TRAINING, CERTIFICATION AND WATCHKEEPING FOR SEAFARERS 1978, AS AMENDED (STCW CONVENTION) x- - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -x In accordance with the pertinent provisions of Republic Act (RA) No. 7722, otherwise known as the Higher Education Act of 1994, CHED Memorandum Order (CMO) No. 40, s. 2008, entitled Manual of Regulations for Private Higher Education of 2008, by virtue of the _______ Commission en banc Resolution No. _______ dated __________________, and in aid of promoting quality maritime education programs in __________________ compliance with the 1978 STCW Convention, as amended, this set of policies and guidelines on the monitoring and evaluation of higher education institutions (HEIs) offering Bachelor of Science in Marine Transportation (BSMT) and Bachelor of Science in Marine Engineering (BSMarE) programs are hereby adopted and promulgated by the Commission, thus: ARTICLE I POLICY, LEGAL BASIS AND OBJECTIVES Section 1. Statement of Policies and Legal Bases The Commission on Higher Education (CHED) upholds Section 1, Article XIV of the 1987 Constitution as well as the declared policy of the State to protect, foster and promote the right of all citizens to affordable quality education at all levels and to take appropriate steps to make such education accessible to all. The Commission likewise recognizes that maritime education, training and certification is a matter of national interest and that protecting, fostering and promoting its quality is an international obligation as a Party to the STCW Convention, the Philippines being a signatory thereof. Hence, the Commission shall ensure that maritime higher education institutions (HEIs), offering BSMT and BSMarE programs shall fully comply with the CHED and the STCW requirements. SUBJECT:

Therefore, CHED under Section 8, [d] and [e] of RA 7722 shall undertake the following: Section 8. xxx .... d) set minimum standards for programs and institutions of higher learning recommended by panels of experts in the field and subject to public hearing, and enforce the same; e) monitor and evaluate the performance of programs and institutions of higher learning for appropriate incentives as well as the imposition of sanctions such as, but not limited to, diminution or withdrawal of subsidy, recommendation on the downgrading or withdrawal of accreditation, program termination or school closure; . . . . x x x Thus, the regular monitoring and evaluation of recognized BSMT and BSMarE programs offered by Private HEIs, State Universities and Colleges (SUCs) and Local Universities and Colleges (LUCs) shall be conducted by CHED annually in pursuance of the foregoing. The pertinent PSG for maritime education, which incorporates the relevant requirements of the 1978 STCW Convention, as amended, shall be the basis of the monitoring and evaluation. The result of the monitoring and evaluation shall, inter alia, be sufficient basis for the retention/revocation of government authority (in case of SUCs/LCUs) or government permit/recognition (in case of private HEIs) and the subsequent phaseout/closure of the HEIs BSMT and/or BSMarE programs. Consequently, the Commission shall issue the list of maritime institutions and programs, which have fully complied with the CHED and STCW requirements to be included in the Philippine Report to the International Maritime Organization (IMO). Section 2. Objectives The monitoring and evaluation as herein provided shall aim to: 1. ensure that maritime HEIs offering BSMT and BSMarE programs shall maintain full compliance with the pertinent CHED and STCW Convention requirements; 2. gather empirical data that could be used as basis for: 2.1 future policy directions; 2.2 review and updating of existing policies, standards and guidelines for maritime education as well as the development/formulation of new ones; 2.3 the grant of appropriate incentive as may be determined and approved by the Commission; and, 2.4 the imposition of sanction to such HEI found not maintaining full compliance with the pertinent CHED and STCW Convention requirements;

DRAFT - DRAFT - DRAFT 3. identify factors that affect the performance of maritime HEIs and their graduates in licensure examinations. 4. ensure that qualified students completing the academic requirements for their bachelor degree (BSMT or BSMarE) are provided with opportunities to get cadetship/apprenticeship onboard appropriate vessels through the HEIs initiative through: (1) government programs like assistance to provide a Training Ship for use by participating group or consortium of HEIs or a (2) mandatory and cadetship program on board foreign vesses anned by Filipino seafarers, (3)through linkages with domestic and foreign shipping companies for Scholarship and/or onboard cadetship program for sponsored cadets; and, (4) other relevant schemes as may be determined by CHED. ARTICLE II MONITORING AND EVALUATION GUIDELINES Section 3. Scope of Monitoring and Evaluation Pursuant to the existing PSG for maritime education (CMO No. 13, s. 2005 and other supplemental CHED issuances thereof), the scope of monitoring and evaluation of maritime HEIs offering BSMT and BSMarE programs as herein provided shall include the following: 1. 2. 3. 4. 5. The scope of monitoring and evaluation as herein provided shall be changed or adjusted accordingly in the event that the aforesaid CHED issuance(s) shall have been revised/modified or in case the Commission, upon the recommendation of the Technical Panel Maritime Education (TPME), issues a new set of PSG for maritime education. Section 4. Major and Minor Deficiency For purposes of interpreting the result of monitoring and evaluation as herein provided, it is important to categorize and specify the major and/or minor deficiencies that may be incurred by the BSMT and/or BSMarE programs of an HEI being subjected to a monitoring and evaluation. A major deficiency refers to a failure to comply or maintain compliance with a particular requirement for each of the areas of monitoring and evaluation as herein provided, which if not rectified for a maximum period of three (3) months shall cause a detrimental effect to the quality of the BSMT and/or BSMarE programs offered by a maritime HEI.

On the other hand, a minor deficiency refers to a failure to comply or maintain compliance with a particular requirement which, if not rectified for a maximum period of six (6) months, shall have detrimental effect to the quality of the BSMT and/or BSMarE programs offered by a maritime HEI and shall thereafter be considered a major deficiency. For purposes of this policies and guidelines, below is a table of major deficiencies that may possibly be incurred by an HEI offering BSMT and/or BSMarE programs. AREAS OF MONITORING/EVAL UATION 1. AREAS OF MONITORING/EVAL UATION

MAJOR DEFICIENCY 3.2 Classroom deficient in any of the following: The standard classroom shall be a minimum of 30 square meters for a class of 25 students and 56 square meters for a class of 50 students. Classrooms must be well lighted and well ventilated. They should contain the necessary equipment and furnitures like chairs, instructors podium, blackboard/white boards etc.

Quality Standards System Every maritime school shall have a certified quality standards system in accordance with the provisions of the Rules for a Quality Standards System in Maritime Academies as contained in Annex IV of CMO no. 13, s. 2005. The QSS of maritime institutions shall be evaluated by CHED authorized agencies at least once a year the procedures for approval of shipboard training in shipping companies where cadets will be placed shall be included in the QSS of the institution The qualifications of internal auditor of the maritime institutions shall be specified in its

QSS, and shall comply with regulation under Section A I/8 of the STCW 95

All other deficiencies that may be incurred by the BSMT and/or BSMarE programs of a maritime HEI being subjected to a monitoring and evaluation that are not specified in the above table shall be considered minor deficiency(s). Section 5. Conduct of Monitoring and Evaluation The conduct of monitoring and evaluation as herein provided shall be in accordance with the pertinent policies and procedures on monitoring and evaluation of maritime education programs as provided for in the Quality Standards System (QSS) of the Maritime Education Unit, Office of Programs and Standards CHED (MEU, OPSCHED) and the pertinent provisions of CMO No. 28 s. 2010 entitled Systems and Procedures for the Joint CHED-PRC Inspection and Evaluation of Higher Education Institutions Offering Board Programs. Section 6. Result of Monitoring and Evaluation As provided under Section 1 paragraph [5] above, the result of the monitoring and evaluation shall, inter alia, be sufficient basis for the retention/revocation of government authority (in case of SUCs/LCUs) or government permit/recognition (in case of private HEIs) and the subsequent phase-out/closure of the HEIs BSMT and/or BSMarE programs. Moreover, as provided for under the certificate of government authority or recognition granted by CHED to a recognized BSMT/BSMarE program, such authority or recognition is subject to revocation if the herein grantee fails to operate in accordance with the laws of the Republic of the Philippines and/or fails to comply fully with STCW 78 requirements, as amended and/or to maintain the prescribed standards of instruction and/or fails to comply with the rules and regulations pertaining to the organization, administration and supervision of private/public Higher Education Institutions (HEIs) in the Philippines. Under Section 28, Chapter 3, Title III of Batas Pambansa Blg. 232, the operation of schools and educational programs without authorization, and/or operation thereof in violation of the terms of recognition, are hereby declared punishable violations subject to the penalties provided in this Act (emphasis supplied). Thus, the failure of the BSMT and/or BSMarE programs of the maritime HEI concerned to fully address and rectify a major deficiency within a maximum period of three (3) months or to fully address and rectify a minor deficiency within a maximum period of six (6) months shall, after due process, be considered as substantial basis for the revocation of the HEIs certificate of government authority or recognition and the subsequent phasing-out or closure of the its BSMT and/or BSMarE programs. In which case, the HEI concerned shall be responsible to facilitate the transfer of all affected students to the HEIs with recognized BSMT/BSMarE programs. Likewise, the CHED Regional Office concerned shall assist in facilitating the smooth transfer of affected students.

DRAFT - DRAFT - DRAFT The CHED may however decide to impose other sanctions such as but not limited to downgrading of recognition to permit status, issuance of a special authority or permit to enable the HEI concerned to operate the BSMT/BSMarE program until the last curricular year or for a period of one academic year or term, or the imposition of other appropriate sanctions against the institution and its responsible officials as may be determined by the Commission.

ARTICLE IV MISCELLANEOUS PROVISIONS Section 7. Sanctions For violation of the foregoing policies and guidelines, CHED shall impose sanctions, as it may deem appropriate pursuant to Republic Act No. 7722 [Higher Education Act of 1994], Batas Pambansa Bilang 232 [The Education Act of 1982], CMO No. 40, s. 2008 [Manual of Regulations for Private Higher Education of 2008 (MORPHE)] and all other applicable CHED rules and regulations and legislations. Section 8. Separability Clause If any part or provision of this Order is declared invalid or unconstitutional, the same shall apply only to that part or provision. The remainder shall remain valid and in force. Section 9. Repealing Clause This CMO repeals Sections 16, 17, and 26 of CMO No. 13, s. 2005 as well as any amendment thereof as provided for under CMO No. 20, s 2010. Likewise, all other existing Orders and Memoranda issued by the Commission, which are contrary to, or inconsistent with any of the provisions of this CMO, are hereby deemed repealed or modified accordingly. Section 10. Effectivity This CMO shall take effect fifteen (15) days after its publication as required by law. Quezon City, Philippines, ______________________, 2011.
