Kiran, SUB: APPOINTMENT LETTER With reference to your application for employment and the subsequent interview, you had with us, we are pleased to appoint you as a Commi III Production in Band 1 with effect 15/07/2011 appointment shall be probationary initially for six months. You will be based in our outlet at Spaghetti Kitchen Khar. You shall be paid Rs. 7487 (Seven Thousand Four Hundred Eighty Seven Rupees Only) as remuneration per month on cost to company basis and all statutory deduction are liable to be deducted from your remuneration. 1. You will be on probation for a period of six months from the date of joining and depending on your satisfactory performance, the company at its discretion, may extend or confirm you as a permanent employee before expiry of the probationary period. If your services are not confirmed in writing at the end of the period of probation, the same would be deemed to have been extended for a further period, not exceeding three months. After the successful completion of your probation period your services shall be confirmed in writing. 2. During the period of your probation, you shall not be allowed to avail any leave facilities, which are applicable to other permanent employees of the organization. However, upon confirmation you shall be entitled to leave facilities as per the company policy and/ or provided by applicable law. 3. In your capacity as a Commi III you will report to the Unit Chef of the company and will have amongst other things, to discharge such duties as may be assigned to you by the Management, from time to time and you shall diligently carry out all instructions given to you by your superiors in connection with the duties assigned to you to the best of your skill and ability. 4. During the period of your employment with us and thereafter, you will not divulge or disclose any vital information about our trade or business or part with any document of confidential nature which may come to your knowledge by virtue or your being associated with our organization. 5. During probation, the employment can be terminated by a week notice or by payment of one weeks salary in lieu of such notice from either side. In case if you decide to leave during probation period employee has to give one weeks notice to the company. After confirmation, the employment can be terminated by a months notice or by payment of one months salary in lieu of such notice from either side. However in case you decide to leave, you will have to give the company one months notice. The company will reserve the right not to waive the notice period and you will be required to serve the company during the notice period. The company also reserves the right not to adjust your accumulated leave, if any, against any notice period not served out fully. 6. Should you contravene or breach any of the terms and conditions of service contained herein, the company will be entitled to terminate your services forthwith, without compensation, notice period or salary in lieu thereof and without prejudice to other legal rights/remedies available to the company. 7. You shall devote your full time and attention to the work assigned to you and be available any time by your own initiative or when directed to successfully meet and complete all work exigencies. You shall not take up employment either part time or otherwise in any organization during the tenure of your employment with the company.

8. You shall strictly abide by the rules and regulations prevailing in the organization by way of customs and practices or by the statutes for the time being in force. 9. Your appointment and continuance in employment of the organization will always be subject to your being found medically fit and the Management will have the right to get you examined/ re-examined from any Registered Medical Practitioner/ Surgeon, whose finding shall be final and binding upon you. 10. In case of any change in your residential address during the tenure of your employment, it shall be your duty to intimate the same, in writing, to the Management, within 3 days of such change. In the event of non-intimation, the address on records shall be deemed to be the valid address for company communication. All communication sent to you by the company on last known address given by you shall be deemed to have been received by you at current address if sent by post, registered A/D or by courier. 11. If your services are confirmed and you are continued in your post, you shall retire from services of our organization on attaining the age of 58 years unless the services are terminated for any other reasons prior to reaching the age of Superannuation. 12. You will submit to the Personnel Department, your birth certificate, in original along with a certified copy, duly certified by a Gazetted Officer, in proof of your date of birth. The original birth certificate shall be returned to you after due verification. You will also submit certified photo copies of all the certificates of your educational qualifications and other testimonials to the Personnel Department. 13. Your services are liable to be transferred to any other department of the same establishment or any other subsidiary, sister concern or associate companies, situated anywhere in India, upon the terms and conditions as contained herein and you shall in addition abide by the rules and regulations prevailing in the organization to which they are transferred. Refusal or delay in reporting at the concerned location after transfer shall be construed as a breach of the terms of employment and your services are liable to be consequently terminated. 14. You are liable to be suspended pending an enquiry into, any act or omission alleged to have been committed by you. Similarly you are liable to be laid off when the management is unable to provide any suitable work due to either natural calamity or public disorder or any other circumstances beyond the control of the management. 15. You will not seek membership of any local or public bodies without first obtaining special permission of the management. This appointment will be subject to receipt of satisfactory verification of all particulars given by you.
