________________________________/ MOTION OF ZENAIDA GONZALEZ FOR ORDER AN DIRECTING EXAMINATION OF CASEY MARIE ANTHONY PURSUANT TO BANKRUPTCY RULE 2004 ZENAIDA GONZALEZ (Movant), by and through her undersigned attorneys, and pursuant to Rule 2004, Federal Rules of Bankruptcy Procedure, hereby moves for an order authorizing her to conduct a Rule 2004 examination of Casey Marie Anthony (the Debtor), and for authority to serve related discovery upon the Debtor (the Motion). In support of the Motion, Movant respectfully submits as follows: Jurisdiction 1. The Court has jurisdiction over this proceeding pursuant to 28 U.S.C. 157(a), Case No. 8:13-bk-00922-KRM Chapter 7

(b)(1) and (b)(2)(J). Venue of this case and the Motion in this district is proper pursuant to 28 U.S.C. 1408 and 1409. Background 2. On January 25, 2013 (the Petition Date), the Debtor filed a voluntary petition

for relief under Chapter 7 of the Bankruptcy Code. Mr. Stephen Meininger was appointed as Chapter 7 trustee in the Debtors case. 3. On March 4, 2013, the Chapter 7 Trustee conducted and concluded the 341

meeting of creditors in this bankruptcy case.

At the 341 meeting, the Debtor admitted to receiving funds for living expenses

from her attorneys who, purportedly, received the funds from donors and well-wishers. However, Debtor was unable to identify any details with respect to how much, and from which attorney, funds were transferred. 5. The Debtor also testified to receiving unspecified financial support from friends

but, upon improper instruction from purported counsel, Mr. Greene, refused to answer questions as to the identity of such friends. 6. The Debtor further admitted that certain additional assets were not disclosed on

her bankruptcy schedules and stated she would be amending such. However, to date, the Debtor has not filed amended schedules in this regard. 7. Debtor listed Movants claim as disputed. Movant believes her claim is: (a) valid

and enforceable; and (b) is of a nature to qualify as excepted from the discharge pursuant to 11 U.S.C. 523(a)(6) (the Discharge Action). Movant has not yet taken the deposition of the Debtor, and examination pursuant to FRBP 2004 is required to determine whether Movant has sufficient grounds to file the Discharge Action. 8. Movant and other creditors have an interest in discovering the full extent of the

Debtors income and prospects for future income. Accordingly, to complete its investigation into the Debtor and her assets, and to enable Movant to determine certain issues with respect to the Discharge Action, Movant requests the ability to take the 2004 examination of Casey Marie Anthony and to serve discovery related to the examination. Relief Request 9. Pursuant to Bankruptcy Rule 2004, Federal Rules of Bankruptcy Procedure, on

motion of any party in interest, the Court may order the examination of any entity or entities.

Pursuant to Bankruptcy Rule 2004(b), the examination may relate to the acts, conduct, or property of the Debtor, or to any matter that may affect the administration of the Debtors estate. Rule 2004 also permits a party to serve related discovery, including, but not limited to, request for the production of documents. Id. 10. Movant and other creditors have a strong interest in determining the extent of the

Debtors income and prospects for future income. 11. Moreover, Movant would like to investigate certain facts and testimony related to

Debtors acts with respect to the Discharge Action. 12. Accordingly, Movant requests authority to examine Casey Marie Anthony at a

mutually convenient time and place, and to serve related discovery in connection with the examination. WHEREFORE, Movant respectfully requests this Court issue an Order: (i) directing Casey Marie Anthony, individually, to submit to an examination by Movant, (ii) granting Movant authority to issue discovery in connection with the examination, and (iii) granting such other relief as the Court deems just and proper.
